By bidding with DAGS either directly or through another online auction provider (e.g. Live Auctioneers), you are agreeing to abide by all associated auction terms and conditions. 2. Your bid constitutes a legally binding contract. If you bid on a lot and win (even if the bid was placed accidentally), you are liable for payment. 3. The auctioneer reserves the right to reopen bidding on a sold lot (under extreme circumstances only) and is the sole determinant concerning all bid disputes and the final authority in regard to all auction terms and conditions. 4. Each lot won is subject to a 10% buyer's premium. 5. Unless exempted by law, all purchases are subject to NY state sales tax (this is also applicable to out-of-state buyers who pick up their purchases in NY). 6. NY state law requires that all dealers have a valid, signed VA Dept. of Taxation Sales & Use Tax Certificate of Exemption on file with us (form ST-10 or ST-14). This is required per auction for non-NY dealers. We must also have a current copy of the non-NY dealer tax exemption certificate on file. 7. Absentee bids placed IN PHONE at our gallery are accepted any time prior to the sale of the lot. THE DEADLINE FOR ALL OTHER ABSENTEE BIDS IS TWO HOURS PRIOR TO THE START OF THE AUCTION. 8. On the Live Auctioneers platform, ON-SITE BIDDER or FLOOR BIDDER means any non-Live Auctioneers bidder; therefore it could be 1) someone physically present at the auction, 2) someone bidding remotely by telephone, or 3) someone who placed absentee bids directly with our auction house. 9. The auctioneer reserves the right to make verbal corrections to the catalogue and provide additional information from the auction block at the time of sale. Absentee bids placed directly with the auction house will not be executed on lots found to be other than as described in the catalogue unless a member of our auction staff has personally conveyed the updated catalogue description to the absentee bidder. The auction house does NOT have access to absentee bids placed through Live Auctioneers. 10. Requests for additional information or images on catalogued lots will be accepted until 24 hours prior to the start of the auction. 11. INVOICING & SHIPPING SERVICE: We will email invoices to winning bidders within 2 business days of the sale (initial invoices for a typical one-day sale are usually sent the Monday after an auction). You must reply to confirm receipt and make arrangements for payment and shipping or pick up. IN-HOUSE SHIPPING SERVICE: WE PACK FOR SHIPPING VIA USPS/UPS. We do assume that items are to be shipped. We do not crate/ship furniture or oversized objects; however we can pack and ship most other items. Invoices include Shipping & Handle included. 12. Winning bidders must contact us by 5:00 PM Eastern Time on the Friday following an auction to confirm receipt of invoice and to make payment and shipping or pick up arrangements. Any lots won should be reflected in your Live Auctioneers account. 13. PAYMENT: We accept cash, certified check, money order, and PAYPAL. If payment is made with an uncertified check, items may be held for up to 10 business days before we ship or release for pick up. CREDIT CARD: via phone or e-mail @ 347 238 0639 14. PAYMENT IS DUE WITHIN 2 DAYS OF THE DATE OF YOUR INVOICE. If your request for packing/shipping is made by 5:00 PM ET on the Friday following the auction, payment in full is due within 2 days of the date of your FINAL invoice (includes shipping charges). 15. Accounts that are unpaid after 10 days of the sale date will be subject to a 2% monthly finance charge. 16. Each returned check is subject to a $50.00 service charge. 17. The buyer is liable for all fees/costs associated with the collection of balances due, including attorney's fees. 18. Unless pre-arranged with DAGS., any merchandise not removed within 1 weeks of the sale date is subject to a storage fee; any merchandise not removed within 14 days of the sale date is considered abandoned. 19. No refunds will be considered on any lot. 20. Additional conditions of sale apply as noted on our website and/or as announced by the auctioneer prior to the auction. 21. These terms and conditions, as well as the respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of New York. The purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the Commonwealth of New york. 22. All catalogue descriptions are believed to be accurate in the matter of authenticity and condition, but ultimately all lots are sold AS IS. Antiques, by their very nature, will exhibit wear, minor losses and breaks, and small repairs commensurate with age. We only note condition issues that in our opinion significantly affect the integrity of the item. Returns will only be considered for items found to be fake/reproduction and/or have significant damage/restoration not noted in the catalogue description. 23. All measurements are approximate. Requests for more precise measurements must be received at least 24 hours prior to the start of the auction. 24. All lots are sold strictly AS IS with no guarantee as to age or condition. No refunds will be considered on lots. 25. Fine jewelry is guaranteed only regarding gold content and authenticity of diamonds. Authenticity of other stones and grades of any stones are not guaranteed.
