Auctions at Himalayan shall have no responsibility for any error or omission in the description. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. All items are sold strictly AS IS, WHERE IS and ALL SALES ARE FINAL. Absolutely no returns will be accepted. Winning bidders agree to receive Showplace catalogs and auction updates via email. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, Himalayan Auction House may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach, and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has breached any of its obligations, including its obligation to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale. 9. Himalayan Auction House may, in its discretion and at purchaser's request, package and arrange for delivery as directed by the purchaser. In such event, purchaser agrees that (a) all such packaging, handling and delivery is at the sole risk of the purchaser and that Himalayan Auction House shall have no liability for any loss or damage to such items, and (b) purchaser shall pay in advance, all packaging expenses, including labor, materials, carrier's fees and all insurance charges. Please arrange seventy-two hours in advance for collection and delivery. Himalayan Auction House shall not be responsible for obtaining any permits or licenses on behalf of purchaser and no sale shall be cancelled or refunded for lack of purchaser's noncompliance with permitting and licensing issues. HIMALAYAN AUCTION HOUSE WILL NOT CANCEL SALE DUE TO SHIPPING. All items must be paid for within three (3) business days from the date of auction. All invoices must be paid in full to retrieve items. The purchase price payable by LiveAuctioneers buyers at auction shall be the final bid plus a 25% buyer's premium. All purchases are subject to California sales tax rate of 8.75% unless a valid resale certificate is presented. A resale tax form must be completed in full prior to time of purchase. Wire transfers are required for amounts over $5,000 domestically and $2,000 internationally We will arrange shipping for most items within two weeks after payment is made, except furniture and other large or heavy items. We will charge a certain packaging service charge, and we will customize a special box for the items, which will be included in the freight. Such items must be paid in full before leaving our gallery. Merchandise that we do not ship must be picked up within 2 weeks of the payment date. Items not picked up after 2 weeks will be subject to a monthly storage fee. Any merchandise not removed within 60 days of the sale date will be considered abandoned.

If you have not contacted Himalayan Auction House to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
