Auction Terms 1. The auction will be held on a voluntary basis on behalf of and for the account of a third party. This does not affect any lots belonging to the auctioneer - these lots will be clearly marked with a certain code. All other lots are marked with a number showing the owner. There is no claim of the buyer for a disclosure of the consignor's name. 2. All descriptions are made up with great care and to the best of the auctioneer's knowledge and all conscience. The catalogue descriptions and any verbal notations of the auctioneer are no warranted characteristics of the goods and shall not be regarded as assured properties. The lots to be auctioned shall be inspected before the auction during the preview period as listed in the catalogue. All pieces are sold in their present condition: "as is, where is". In case that you have any complaints on the bought lots we will carefully review them and forward your claim to the consignor. In case of buying by written purchase order (absentee bid), complaints will only be accepted if a description is substantially and obviously incorrect. Any notice of a claim shall be given immediately - in all instances you must give written notice to us within the legal deadlines after the sale of the property, setting forth the basis for your claim. Should such a reclaim be accepted, the buyer shall be entitled to claim for the total buying price as a maximum. Any other claims shall be excluded. If a lot comprises three or more items, a complaint for minor defects of individual items shall not be accepted. Lots being described with certain defects shall not be reclaimed for other defects. During preview and auction each visitor shall be held responsible for any damage he may cause. The auctioneer has the right to exclude any person from the preview and auction for any reason. 3. The auction will be carried out strictly following the numbering in the catalogue. The catalogue text shall be binding, however, if he deems it to be suitable, the auctioneer shall be entitled to separate, combine, bring forward, put aside or withdraw any item from the auction. The auctioneer will first call up each item at it's limit price (minimum price) as stated in the catalogue. These limit prices shall not be underbid. Bidding will increase in regular increments of approximately 10% unless determined otherwise by the auctioneer or according to the auction houses' published bid increments list. Any given bid for a certain lot will be valid until the official end of the auction. The highest bid will be called three times and if there is no more overbid, the item is sold as the hammer falls. In case of more than one person making equal highest bids, the winner will be determined by drawing lots. In case of any dispute or if a higher bid has been missed, a new call will for this lot will be made or the item will be sold to the second highest bidder by decision of the auctioneer. The auctioneer is entitled to refuse bids without any further note. In this case the previously given lower bid remains binding for the bidder. In case of a bid below the reserve price this bid is binding for 3 weeks or until the lot is finally sold at this price if the consignor agrees to accept this underbid. If the there is a bid at or above the reserve-price the lot will be sold without further notice immediately to the prior bidder. Title to the lot shall pass with the fall of the auctioneer's hammer, thereupon a sales agreement is entered into between the consignor, represented by the auctioneer, and the successful bidder. Upon transfer of title, the buyer assumes full responsibility, including risk of loss and damage, etc. 4. It is the obligation of the lot's winner to pay the purchase price to the auctioneer and pick up the item immediately. All bidders strictly buy in their own name, on their own behalf and for their own account. 5. The purchase price comprises the net hammer price and the buyer's premium of 22% incl. applicable German VAT of 19%. Foreign bidders are entitled to get a refund of the VAT on the buyer's premium if they verify their personal data and proof the export of the goods to a Non-EU-country by presenting a legally stamped export-declaration of the German customs. For personally attending bidders the total amount shall become due immediately and shall be paid in cash. Any invoices made up during the auction are subject of a revision. For purchase orders from absentee bidders the payment of the purchase price is due within 10 days after the date of invoice. The ownership shall only be transferred after full payment. Any banking fees are to be paid by the buyer. 6. Should any buyer fail to pay the full purchase price in time he shall lose his rights as the successful bidder. Such items then will be auctioned at his cost during one of the next upcoming auctions without any prior notice to him. In such a case the defaulter shall be liable for the losses in turnover and for any extra costs for the repeated auction. He is not entitled to any surplus profit. The auctioneer is entitled to collect or sue out purchase money and/or secondary obligations on behalf of the consignor(s). In case of overdue payments an interest rate of 1.5% per month is applicable. In case that the collection of the purchased goods is delayed for more than 14 days the auction house is entitled to store them in the name and at the expense and risk of the buyer. This also might be arranged in cooperation with an autonomous storage company. 7. Written purchase orders (absentee bids) shall only be accepted if received by the auctioneer at least 1 hour before the auction starts. Absentee bids will be handled with greatest care but without any guarantee. Any given prices in absentee bids are made in EURO if no other currency is clearly mentioned. Absentee bids neither contain the buyer's premium nor the VAT. The auctioneer shall handle absentee bids in the bidder's interest, utilizing the highest absentee bid only as far as it is necessary to overbid the second highest by only one increment. Moreover, the auctioneer shall be obliged to maintain secrecy on written absentee bids until the hammer falls. 8. The buyer pays actual shipping costs. For absentee bidders the packing and shipping costs will be invoiced as given by the forwarder/courier. We will try to select the best and safest way of shipping by comparing different forwarders and couriers. Shipping rates are depending on destination, size and weight of the lot(s). We are able to quote the estimate shipping costs in advance. Worldwide insured shipping is possible. 9. Unsold lots also can be bought in the clearing sale after the auction within the next 30 days following the auction. These auction terms are valid for the auction and the clearing exactly in the same way and meaning. 10. Place of jurisdiction and performance for all parties involved is Freising, Germany. German law is applicable even for foreign bidders. 11. The bidder declares his explicit acknowledgment and agrees with these auction terms by placing a bid or a written absentee bid. Should any of the above mentioned paragraphs be or become invalid completely or in part, all other obligations shall remain unaffected thereby. Important Note: Your bid is a contract. Place a bid only if you're serious about buying the item. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property bid on from the auction house/seller. You should contact the auctioneer/ seller to resolve any questions before bidding. Auktionsbedingungen 1.Die Versteigerung erfolgt freiwillig. Sie wird vom Versteigerer im fremden Namen fuer fremde Rechnung durchgefuehrt, mit Ausnahme der Eigenware. Alle Versteigerungsobjekte haben eine Nummer, mit der der Besitzer bzw. Einsender als solcher deutlich gemacht wird. Die Eigenware betreffenden Ziffern werden im Katalog (wenn ein solcher aufgelegt wird) gesondert angegeben. Ein Anspruch auf Bekanntgabe des Namens des Kommittenten besteht nicht. 2.Die Katalogbeschreibungen stellen keine zugesicherten Eigenschaften dar. Alle zur Versteigerung gelangenden Gegenstaende koennen vor der Auktion besichtigt und geprueft werden. Sie werden in dem Zustand versteigert, in dem sie sich befinden. Der Auktionator bzw. das Auktionshaus uebernimmt keine Haftung fuer offene oder versteckte Maengel sowie Zuschreibungen, jedoch verpflichtet er sich, unverzueglich vorgetragene Maengelruegen des Erwerbers innerhalb der gesetzlichen Gewaehrleistungsfrist an den Einlieferer der bemaengelten Sache weiterzuleiten. Fuer Katalogbeschreibungen und dazugehoerige schriftliche Erlaeuterungen sowie muendliche Angaben des beauftragten Versteigerers wird nicht gehaftet, es sei denn, dass dem Auktionator grobes Verschulden vorzuwerfen ist. Die Angaben des Versteigerers stellen ebenfalls keine zugesicherten Eigenschaften dar, sie geben lediglich seine persoenliche Meinung wieder. Der Versteigerer kann Nummern vereinigen, trennen, ausserhalb der Reihenfolge anbieten oder zurueckziehen. 3.Der Aufruf beginnt in der Regel mit dem genannten Limitpreis. Regelmaessig wird um 10 Prozent gesteigert. Ein erklaertes Gebot bleibt bis zum Abschluss der Versteigerung ueber den betreffenden Gegenstand wirksam. Der Zuschlag wird erteilt, wenn nach dreimaligem Wiederholen des hoechsten Gebotes ein Uebergebot nicht gegeben wird. Erfolgt ein Zuschlag unter Vorbehalt, so ist der Bieter auf die Dauer von drei Wochen an sein Gebot gebunden. Erhaelt er nicht innerhalb dieser Zeit den vorbehaltlosen Zuschlag, so erlischt es. Wird ein Vorbehalt durch den Einsender nicht genehmigt oder bietet jemand das Limit, kann die Katalognummer ohne Rueckfrage bei dem Bieter des Vorbehalts an einen hoeher Bietenden abgegeben werden. Es bleibt dem Bieter des Vorbehalts ueberlassen, sich ueber die Genehmigung seines Gebots selbst zu informieren. Fuer das Wirksamwerden des Zuschlags genuegt eine muendliche oder schriftliche Erklaerung des Versteigerers an den Bieter. 4.Der Versteigerer kann ein Gebot ablehnen; in diesem Fall bleibt das vorher abgegebene verbindlich. Geben mehrere Personen das gleiche Gebot ab, so entscheidet ueber den Zuschlag das Los. Bei Uneinigkeit ueber einen Zuschlag kann der Versteigerer nach seinem freien Ermessen den Zuschlag sofort zugunsten eines bestimmten Bieters wiederholen oder den Gegenstand nochmals aufrufen. Will ein Hoechstbietender sein Gebot nicht gelten lassen, so kann der Versteigerer diesem trotzdem den Zuschlag erteilen und die sich hieraus ergebenden Rechte weiterverfolgen; er kann aber auch den Zuschlag auf das naechstniedrigere Angebot erteilen oder den Gegenstand neu aufrufen. 5.Der Zuschlag verpflichtet zur Abnahme und Zahlung. Mit ihm geht die Gefahr fuer vom Versteigerer nicht zu vertretende Verluste, Beschaedigungen, Verwechslungen usw. auf den Kaeufer ueber. Jeder Bieter kauft in eigenem Namen und auf eigene Rechnung. 6.Das zugeschlagene Gebot (Kaufpreis) ist der Nettopreis. Auf den Zuschlagspreis wird ein Aufgeld von 18% erhoben. Zum Aufgeld kommt die gesetzliche Mehrwertsteuer von derzeit 19%. Ausländische Kaeufer erhalten die Mehrwertsteuer auf das Aufgeld rueckverguetet, wenn sie eine Bestaetigung der Grenzkontrollstelle ueber die Ausfuhr und ueber die Richtigkeit der angegebenen Personalien erbringen. Der gesamte vom Kaeufer zu entrichtende Betrag ist sofort faellig, falls das Gebot persoenlich abgegeben wurde. Bei Erwerb durch erteilten Bieterauftrag ist die Gegenleistung innerhalb von 10 Tagen nach Rechnungsdatum faellig und zu erbringen. 7.Waehrend oder unmittelbar nach der Auktion ausgestellte Rechnungen beduerfen wegen Ueberlastung der Buchhaltung einer besonderen Nachpruefung und eventuellen Berichtigung. Irrtum vorbehalten. 8.Das Eigentum am ersteigerten Gut geht erst nach vollstaendiger Bezahlung auf den Ersteigerer ueber. Ersteigertes Auktionsgut wird nur nach geleisteter Barzahlung ausgeliefert. Geraet der Kaeufer in Zahlungsverzug, so werden Zinsen in Hoehe von 1,5 Prozent je angebrochenen Monat berechnet. 9.Kommt der Ersteigerer mit seiner Pflicht zur Zahlung oder Abnahme des Gutes in Verzug, so kann der Inhaber des Auktionshauses anstelle der gesetzlichen Rechte auch weiterhin Erfuellung verlangen. Er kann den Gegenstand auch bei einer der naechsten Auktionen nochmals Versteigern. Falls hierbei der Gegenstand veraeussert wird, erloeschen die Rechte des saeumigen Kaeufers aus dem erteilten Zuschlag. Er haftet aber fuer einen etwaigen Ausfall einschliesslich Kosten der Versteigerung, umgekehrt hat er auf einen Mehrerloes keinen Anspruch. Der Auktionator ist ebenfalls berechtigt, ersteigerte Ware, die nicht innerhalb von 14 Tagen nach der Auktion abgeholt ist, bei einer Fremdfirma auf Kosten des Ersteigerers einzulagern. Im Falle einer verzoegerten Abholung (14 Tage und laenger) uebernimmt der Auktionator ausserdem keine Haftung fuer Zustand und Vollstaendigkeit der Ware, insbesondere bei Konvoluten. 10.Gegenstaende, die nicht unverzueglich, spaetestens jedoch 14 Tage nach der Auktion abgeholt werden, koennen im Namen, sowie auf Kosten und Gefahr des Kaeufers bei einem Spediteur eingelagert werden. Der Versand erfolgt auf Kosten und Gefahr des Kaeufers. Bieterauftraege werden auf das Gewissenhafteste erledigt; sie sollen genaue Angaben enthalten und spaetestens einen Tag vor Versteigerungsbeginn schriftlich erteilt sein. 11.Die vorstehenden Bedingungen gelten sinngemaess auch fuer den nachtraeglichen freihaendigen Erwerb von Auktionsgut. 12.Erfuellungsort fuer beide Teile ist Freising. Gerichtsstand ist Freising, wenn der Kaeufer Vollkaufmann ist, eine juristische Person des oeffentlichen Rechts oder ein oeffentlich-rechtliches Sondervermoegen ist oder der Kaeufer im Geltungsbereich der deutschen Gesetze keinen Sitz hat oder sein Aufenthalt im Zeitpunkt der Klageerhebung nicht bekannt ist. Die Rechtsbeziehungen richten sich nach deutschem Recht unter Ausschluss des Einheitlichen Gesetzes ueber den internationalen Kauf beweglicher Sachen und des Einheitlichen Gesetzes ueber Abschluss von internationalen Kaufvertraegen unter bewegliche Sachen.
