TERMS AND CONDITIONS OF SALE
The following are the terms and conditions applicable to your purchase of product from BIDMAN. Please review them carefully. By tendering payment for the product you agree to these terms and conditions.
All silver, gold and/or jewelry lots or invoices containing said lots MUST be paid for via Zelle, wire transfer or cashier?s check, no other forms of payment will be accepted.
1) BIDMAN AGREEMENT:
By registering to bid for this auction either in-house or online and/or placing a bid in this auction the BIDDER/BUYER agrees to all the terms and conditions stated and by doing so constitutes a binding contract between Helmuth Stone Gallery and the bidder/buyer. When bidding on any lot offered by BIDMAN, the bidder indicates acceptance of the following Terms of Sale. Any participation in the auction binds you to agreement of these terms whether or not you read or understand said terms. The Terms in writing contained herein are subject to change without notice and bidder agrees that the most recently published Terms of Sale as published or amended on the website at the beginning of the auction shall apply.
2) TERMS:
BIDMAN makes every effort to accurately describe all items offered in its sales. All items are sold as is, where is, with all faults. There are no warranties or representations of merchantability, of fitness, nor of any other kind, express or implied. All items are available for your examination prior to bidding. Your bidding will signify that you have examined the items as fully as you desire, or that you have chosen not to examine them. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to age, condition, materials or any other feature of items being sold. Our goal is to provide prospective bidders with accurate and detailed information. We recommend prospective bidders examine all items in which they have an interest. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you not bid on the item in question. We do not give refunds. All sales are final. No statement written or oral made by the auctioneer shall be deemed a warranty or assumption of liability by BIDMAN or by any seller represented by BIDMAN.
JEWELRY: Strung jewelry is usually antique or vintage and may need restringing. Some colored gemstones may have been treated to improve their appearance through methods such as heating and/or various clarity enhancements. These methods are considered common by the international jewelry trade but may require special care of the stone over time. We do not obtain a gemological report for every gemstone sold in our auctions. When we do receive gemological reports, they are described or photographed in the catalogue. Gemstones are not removed from mounts or settings unless stated in reports. Assume all jewelry information is approximate or send a third-party to inspect and verify when a report is unavailable. Estate jewelry may need cleaning. NOTE: ALL JEWELRY MUST BE PAID FOR BY ZELLE, WIRE TRANSFER OR IN-PERSON CASHIERS CHECK ONLY. WATCHES AND CLOCKS: Almost all clocks and watches are repaired in their lifetime and may include parts that are not original. We do not warranty any individual component as authentic. Watchbands may not part of the original watch and may not be authentic. Clocks may be sold without pendulums, weights, or keys. We do not give warranty that any watch or clock is in good working order. Certificates are not available unless described in the catalogue. Wristwatches may have been opened to find out the type and quality of movement. Water-resistant cases may not be waterproof. ART AND OTHER ITEMS: BIDMAN is familiar with repair and certain types of restoration; however, we are not restorers or conservators. If information beyond the scope of our provided condition or your requested condition report is needed, we suggest you contact a reputable appraiser, restorer, or conservator prior to bidding. Antique and vintage gilding and craquelure to canvas will require careful handling by your shipper. COINS AND PAPER MONEY: ALL COINS AND PAPER MONEY MUST BE PAID FOR BY ZRLLE, WIRE TRANSFER OR IN-PERSON CASHIERS CHECK ONLY. There are no exceptions to this rule. OTHER: Assume electrified items and lighting have been repaired at some point, missing parts, or need to be serviced. Wiring is not guaranteed, ever. Textiles, upholstery, and rugs may need cleaning. Writing instruments may not contain ink or write. Assume finish terms such as silver, bronze, gold, copper, etc., relate to finish and not actual material unless stated or specified in grams or with a troy ounce or karat weight. All weights are approximate and provided as a courtesy. We are not obligated to accept any item on consignment to resell in a future auction. It is recommended you view items in person or contact a specialist prior to bidding if any hesitation as to condition, age, color, odor, tarnish, dust, stains, size, origin, or nature of any item. By bidding, you signify that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the items for you. Condition and descriptions in each auction lot entry are based on opinion and are provided for guidance only, without legal obligation. Photos are provided as an additional proof source of condition. Please view ALL detail pictures prior to requesting additional condition reports. Images also constitute online condition report. Please use the messaging feature with additional requests. Items sold AS IS, WHERE IS. NOTE: Condition reports, photos and video or digital images are provided as a courtesy and should not be used as a substitute for inspecting the items in person. All items are sold as is in accordance with the Terms of Sale. If a paper catalog is printed prior to auction, all descriptions and photos posted online supersede any printed catalog information, including dimensions, piece count, areas of repair or damage shown in photos. We reserve the right to update lot information at any point prior to the fall of the hammer in the description or by live, online announcement via the sales platform. Buyer should solely rely on updated information posted online the day of auction. Use caution when entering an auction! Please understand you have a responsibility to pay and remove items in a timely manner. If you are unable to do so, we recommend you enlist the help of an agent to handle on your behalf. Your bid is your commitment to the full terms listed herein. Any departure from these terms could result in a permanent dispute on your record and removal from bidding platforms.
3) CLERICAL INTERNET ERRORS
BIDMAN undertakes the execution of online bidding as a convenience for clients and is not responsible for any inadvertent failure to execute bids, or for any error in the execution of bids. IN THE EVENT OF A TIE BID, THE LIVE AUCTION FLOOR ALWAYS TAKES PRECEDENCE OVER INTERNET, TELEPHONE AND ABSENTEE BIDS. Regardless of the circumstances, if you click BID and subsequently BUY the item, you have purchased it. We will not cancel the sale of an item due to a mistaken click. The live auction online CANNOT duplicate exactly the live auction on the gallery floor, increments may often vary. We are not responsible for a loss of internet connection and technical complications beyond our control.
4) BIDDING
Bidding will begin at a price appropriate in auctioneer?s discretion. The auctioneer always reserves the right to withdraw a lot for any reason he deems appropriate. At the auctioneer?s discretion, no bid of less than one half the low estimate will be accepted from any source: phone bidding, absentee bidding, internet bidding, or bidding in the gallery. All lots in this catalog are offered subject to a reserve, which is the confidential minimum hammer price at which a lot will be sold. In executing a reserve, the auctioneer has the right to bid on behalf of the Consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. If the reserve is not met, the Auctioneer has the right to withdraw the item from the sale.
- The auctioneer shall have absolute discretion in determining the successful bidder. At the fall of the auctioneer's hammer, title to the offered lot will pass to the bidder acknowledged by the auctioneer. The bidder thereupon assumes full risk and responsibility and will pay full purchase price for the said lot.
- The auctioneer may decide that any original bid is not commensurate with the value of the article offered, or that any advance thereafter is not of sufficient amount, he may reject the same.
- The auctioneer reserves the right to withdraw any item at any time before the sale of the item.
- Once we declare that an item is sold, we cannot reopen the bidding. It is the bidder?s responsibility to get our attention prior to our saying: sold. We reserve the right to reject any bids deemed inappropriate or to withdraw any item(s) for lack of appropriate bids. If an item is withdrawn from the auction, it will be offered again only at the auctioneer?s discretion.
- No merchandise will be released before the end of the auction.
A. Absentee Bids - We accept absentee bids by phone, when available, by email, in person, or by fax. Absentee bids are requested no later than 6:00 p.m. on the Friday before the auction. If you fax your absentee bids, please call us to confirm receipt. All absentee bidding is handled as though you are in attendance. We will buy all designated lots for you at the bidding increment just above where competition stops. Please check and comply with these increments. "Plus" bids: it is possible that several people will leave identical bids. A bid with an added "plus" bid to the next increment would win the piece. All absentee bidder names and bids are held in strictest confidence, disclosed only in the event of a question after the sale. Absentee bidding is a convenience offered to our customers and, while we will make every effort to execute your instructions, BIDMAN is not liable or responsible for any errors or failure to do so.
B. When telephone bidding is available at the auction, telephone bid lines are available on a first-come, first-served basis - please reserve as soon as you are able. We must hear from you no later than 12 noon on the Friday before the auction. Determine the lots on which you most want to bid before reserving the lines. If you need condition reports, please request and review them prior to reserving phone lines. We will call you at one phone number ONLY during the auction. If you are unsure of where you or your agent will be during the sale, we recommend you leave absentee bids. All requests for overseas telephone lines must be accompanied by absentee bids, which will be executed on the buyer's behalf, should there be any problems with telephone connections. Your phone number and lots will be confirmed before the auction. Please do not change your phone number after your phone lines have been confirmed; if you do, BIDMAN will not be responsible for any breakdown in communications. We strongly recommend landlines, as to date, they are more reliable than cellular phones. One of the reasons people bid by phone is to monitor how much they're spending. However, if you bid by phone, you must be willing to bid to the low estimate should the bidding go that far. You may, however, leave absentee bids for any amount. Bids are placed on the telephone at the discretion of BIDMAN, and at the caller's risk. Telephone bidding is a convenience offered to our customers and, while we will make every effort to execute your instructions, BIDMAN is not liable or responsible for any errors or failure to do so.
C. Auctioneer's Determination Final - A lot will be sold to the highest bidder as determined in the sole and exclusive judgment of the auctioneer. The auctioneer will also have the sole and exclusive power and authority to a) resolve any disputes between bidders, b) determine whether to pass or re-offer a lot for sale, c) reject or challenge any bid or advance in the bidding, and d) otherwise regulate the bidding and its increments.
D. Bid results ? BIDMAN will only contact successful bidders. Please allow 24-48 hours post auction to receive your official invoice from BIDMAN. The invoice will include item, hammer price, premium, packing and handling, shipping, insurance, and any other charges that apply. Please hold phone inquiries regarding bid success until after receiving your invoice. For verifications, BIDMAN cannot provide winning bid information until the second business day after the auction. BIDMAN will not provide bidder information to any outside sources.
E. Reserves - A reserve is the confidential minimum price established between BIDMAN and the consignor. BIDMAN may implement the reserve at this auction by bidding on behalf of the consignor up to the reserve. If bids on a lot fail to reach the reserve, the lot will be bought-in.
F. Estimates - The estimates provided in this Catalog are our opinion of the price that a willing buyer would pay for the Property at auction. These estimates are opinion, based, where possible, on prices paid for comparable items sold in the past. They are neither a representation nor a prediction of the actual selling price that will be realized at auction, post-auction sale, or upon resale, which may be substantially different from these estimates. We shall not be liable in any way for such a difference.
5) PAYMENT
Methods of Payment and Fees: Acceptable methods of payment are Zelle, Cash, Personal Check, Certified Check, Wire Transfer or Live Auctioneers Payments (plus processing fee). All wire transfer payments are subject to any banking related fees. All payments must be paid in full within 3 days of the date of the invoice. We reserve the right to hold all goods paid for by check until payment has cleared. Late Payment Charge: If payment is not received within thirty (5) days of sale, BIDMAN, reserves the right to impose from the date of sale a late charge of 3% per week of the total purchase price and deny all future credit. In addition, BIDMAN reserves the right to (a) charge a storage fee of $10.00 per day commencing one day after the payment is late, and/or (b) cancel the transaction, in which event neither party will have any further rights or liabilities to the other party in connection with such transaction. In the event of such cancellation, BIDMAN shall be freely entitled to hold or dispose of the product in any manner it decides, and you will have no right, title or interest, whether express or implied, or by operation of law or otherwise, of any kind in the product.
Total invoice purchases over $2,000 REQUIRE a wire transfer, Zelle payment, check, money order or bank issued checks. Please note that in the event that we cannot reach the buyer within 3 business days we will attempt to charge the credit card on file for payment.
6) SALES TAXES
You are required to pay all state and local sales and use taxes, and if applicable, any federal luxury tax, on the total purchase price, except to the extent an exemption applies. Currently, the California sales tax rate is 6.25%. If you would like to claim a sales or use tax exemption, you are required to provide us with a fully executed, valid, complete and accurate resale certificate and any other documentation we may reasonably require to verify the exemption. You will be required to pay taxes at the time payment is made on your product.
7) SHIPPING AND/OR REMOVAL OF PROPERTY
As a convenience, BIDMAN offers packing and shipping services domestically and internationally for some of the lots we offer for sale. IN-HOUSE SHIPPING CAN BE PROVIDED FOR ANY ITEMS THAT FIT INTO A LARGE USPS FLAT RATE BOX. We will contact you after the sale with a quote.
If the catalog states that we CAN directly ship, shipping and handling will be included on the invoice. If the catalog states that we CANNOT directly ship, the buyer is responsible for arranging shipping. The buyer is responsible for all shipping, handling, insurance, signature confirmation and pick-up costs. We will send you a list with recommended shippers after the auction end.
All successful absentee bidders on lots eligible for in-house shipping, will receive a shipping quote from BIDMAN to be sent with their invoice. This shipping quote includes the cost of standard shipping as well as charges for materials and labor. Please indicate any special shipping instructions on the bid form. Purchases paid by personal check will not be shipped until funds have cleared our bank.

BIDMAN is not liable for any damage to purchases that are not removed from our property within ten (10) business days of the auction. Failure to remove property from BIDMAN after ten (10) calendar days after the auction will result in BIDMAN storing your property, with no liability to BIDMAN, and you agree to hold BIDMAN harmless for any damages associated with said storage. No storage fees will be charged if the merchandise is picked up or shipped within 10 days of the auction. After this period of time, the purchaser will be assessed a $10.00 per lot per day storage fee until the merchandise is picked up or shipped. If a storage fee is assessed, it is payable in full prior to removal of any merchandise from BIDMAN premises.
Purchaser agrees that after 15 days after the date of the auction, if the purchased merchandise has not been removed or other arrangements have not been authorized by BIDMAN personnel in writing, the merchandise shall be sold at auction at no reserve. All costs of notice, advertising, commissions, the sale and additional storage fees per lot at $10.00 per day will be assessed against the proceeds of the sale. Any funds remaining after the resale of the items and payment of auction fees and storage fees will be distributed as required by law.
All international customs, duties, and other tariffs are the responsibility of the buyer. BIDMAN and all third party shippers will declare the selling price as the value in all cases.
8) BUYERS PREMIUM
There will be a buyers premium of 24% for all bidders (internet bidders and absentee bidders) added to the hammer price of each lot for the hummer price of up to $50,000. All lots sold over $50,000 have a premium of 23%.
9)LIABILITY
If we are prevented by fire, theft, pandemic, act of God, or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid, by the purchaser for such property and filed with insurance. Technology: In the unlikely event internet connection is lost, even briefly, BIDMAN reserves the right in its sole and absolute discretion to pause the auction as needed or cancel/reschedule to another online session or in-person auction.
10) LIMITATIONS OF LIABILITY
BIDMAN acts in many cases as the agent for the consignor and in no event will be liable for any breach or default by the consignor.
11) EXPORTS AND PERMITS
It is your sole responsibility to identify and obtain any necessary export, import, firearm, endangered species or other permit for the lot. Any symbols or notices in the sale catalogue reflect our reasonable opinion at the time of cataloguing and are for bidders general guidance only. We make no representations or warranties as to whether any lot is or is not subject to export or import restrictions or any embargoes.
12) CONFIDENTIALITY
These terms and conditions will be considered confidential. Neither party will disclose the existence of these terms and conditions to any third party without the prior written consent of the other party. The provisions of this paragraph shall survive the termination or expiration of these terms and conditions.
13) ARBITRATION
In the event any dispute arises between BIDMAN and you concerning respective rights or duties hereunder, each party agrees to notify the other party immediately and to first attempt to resolve the matter by negotiation. If no mutually agreeable resolution is had after fourteen days (14), a party may demand arbitration. Any arbitration shall be under the Commercial Rules of the American Arbitration Association (AAA) and held in Chicago, Illinois. One arbitrator shall conduct the arbitration and decide the matter. Judgment on any award shall be binding and may be entered and enforced in any court of competent jurisdiction.
14) AGREEMENT REGARDING GOVERNING LAW, VENUE, AND LEGAL RIGHTS
I hereby understand and agree that any controversy or claim arising out of or relating to BIDMAN Bidder Terms & Conditions of sale, which includes this provision (hereafter referred to as ?Terms & Conditions?), BIDMAN, or the breach thereof (hereafter referred to as ?Claims?), shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. I hereby irrevocably submit to the personal jurisdiction of the appropriate court in Cook County, Illinois in any action or proceeding arising out of or relating to the Claims and their enforcement, and I agree that any and all Claims must be adjudicated, heard, determined, and resolved in said court, and I hereby irrevocably waive any objection on the ground that any such action or proceeding in said court has been brought in an inconvenient forum. BIDMAN failure to exercise or enforce any right or provision of these Terms & Conditions or any other legal rights, shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms & Conditions by BIDMAN must be made in writing and signed by an authorized representative of BIDMAN specifically referencing the provision(s) contained within the Terms & Conditions to be waived. Headings used in the Terms & Conditions are for convenience only and are not to be relied upon. If any provision of the Terms & Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms & Conditions shall remain in full force and effect. These Terms & Conditions will inure to the benefit of, and are intended to be, enforceable by BIDMAN, its parents, subsidiaries, affiliates, successors, assigns, members, directors, officers, and licensees. There are no third party beneficiaries to these Terms & Conditions; a person or entity who is not a party or signatory to these Terms & Conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term or provision of these Terms & Conditions.
SALES TAX
Local Taxes Apply unless exempt by law. Proper documentation is required.
Autopay
If you have not contacted Bidman to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
