Modern Jewelry will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the lot listing itself. Modern Jewelry makes no warranties of any kind, express or implied, related to the description or information in any listings or lots (See "DISCLAIMER" below). It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Bidder is solely responsible for conducting his or her own investigation before placing a bid. Under no circumstances shall Bidder have any kind of claim against Modern Jewelry or anyone else if the internet service fails to work correctly before or during the live auction. Modern Jewelry will not be responsible for any missed bids from any source. Internet Bidders who desire to make certain their bid is acknowledged should use the absentee bidding feature and leave their maximum bid before the auction begins. Modern Jewelry reserves the right to withdraw or re-catalog lots in any auction. Bidder specifically waives the right to initiating a credit card chargeback dispute on any basis of claim and agrees that Bidder will pay Modern Jewelry a minimum of $300 plus hourly charges and costs for any such chargeback dispute opened, due to the severe administrative burden of such disputes and their direct violation of the dispute provisions above. Judgment to fraud is committed when Bidder violates the provisions of the dispute resolution and accordingly Bidder is liable to Modern Jewelry for all damages, losses and costs, including resulting time charges. VENUE These terms and conditions, the contents of any listing and the contractual relationship between Modern Jewelry and any Buyer shall be interpreted under and governed by the laws of the State of California. SEVERABILITY If any portion, section, or provision of the Terms and Conditions is deemed invalid, illegal, or unenforceable, such portion shall be construed separately and shall not affect the remainder of the Terms and Conditions. ASSIGNMENT Any assignment without modern Jewelry?'s written authorization will be deemed void.
