The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, the auctioneer shall have absolute discretion either to determine the successful bidder, in which event his determination shall be final or, to re-offer and re-sell the article in dispute. If any dispute arises after the sale, ArtMeetsStreet LLC sale record shall be conclusive as to who was the purchaser, the amount of the highest bid and in all other respects.
Bidding Guidelines: Bidding, whether by absentee bid, or internet, constitutes a bidder's acceptance of these conditions. The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer retains the absolute right to reject any bid, to withdraw, pass or divide any lots, to combine multiple lots, to advance the bidding at his or her absolute discretion and (in the case of error or dispute, whether during or after the sale) to determine the successful bidder, to continue the bidding, cancel the sale or to re-offer and sell the lot in question. Under no circumstances are the consignors' or agents acting on their behalf, permitted to bid on their consignment. In the event of any dispute after the auction Mercer Auctions LLC sale record shall be conclusive.
Reserves: Unless indicated otherwise, lots may be offered subject to a reserve, which is the confidential minimum price below which the lot will not be sold. The reserve for any lot shall not exceed its published estimate. ArtMeetsStreet LLC shall act to protect the reserve by bidding through the auctioneer, who may open bidding on any lot below the reserve by placing a bid on the seller's behalf. The auctioneer may continue to bid on behalf of the seller up to the reserve amount, either by placing consecutive bids or by placing bids in response to other bidders. Lots without reserves are typically opened for bidding at 50% of their low estimate. In the absence of a bid at that level, the auctioneer may proceed backwards at his discretion or deem the lot unsold if a bid is not recognized.
Total Sales Price - The total sales price of an item includes (i) the hammer price of the item (ii) the buyer's premium (iii) applicable sales and other taxes due on account of the sale, (iv) packing, shipping transportation and insurance charges, and customs fees and charges and duties, if applicable, and (v) any other amount due from the Buyer as provided in the Seller's e-commerce Policies posted on the Item Detail Page. Buyer may be charged tax based on the laws and regulations in the state where the Seller has nexus.
ArtMeetsStreet LLC has endeavored to accurately describe all items being sold, but all property is being sold "AS IS", "WHERE IS".
ArtMeetsStreet LLC attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. We recommend prospective bidders examine all items in which they have an interest. By placing a bid absentee or via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them.
ArtMeetsStreet LLC strongly encourages all prospective buyers and/or his/her agent to carefully examine and inspect any and all items they wish to bid on before the auction. The buyer avail himself of his own expert, appraiser, or authenticator and rely solely on his advice or judgment.
Pre-sale estimates: Every lot offered for auction at this sale will have an estimated price range which reflects the opinions of our specialists. These estimates are based on what comparable items have sold for at recent auctions. They also reflect condition, rarity, quality and provenance (history of ownership).
Estimates are prepared well in advance and do not include any applicable taxes or buyer's premium. The estimates are subject to revision.
Forgeries: Notwithstanding the preceding Condition, any Lot which proves to be a deliberate forgery (as defined) may be returned to us by you within 14 days of the auction provided it is in the same condition as when bought, and is accompanied by particulars identifying it from the relevant catalogue description and a written statement of defects. If we are satisfied from the evidence presented that the Lot is a deliberate forgery we shall refund the money paid by you for the Lot including any buyer's premium provided that (1) if the catalogue description reflected the accepted view of scholars and experts as at the date of sale or (2) you personally are not able to transfer a good and marketable title to us, you shall have no rights under this condition.
Internet Bids: ArtMeetsStreet LLC are carried live through LiveAuctioneers. You will be responsible for registering as a bidder on their website at Live Auctioneers. All bidding on the Internet is in real time and will be accepted only during the actual auction.
Unsold Property: If any lots fail to reach the reserve then they will be "brought-in" or "passed" by the auctioneer and either offered for sale at a later auction or returned to the seller. It is possible to make an after auction offer. Please contact the administrator who will be present at all auctions.
The right of return provided by this Condition is additional to any right or remedy provided by law or by these Conditions of Sale.

What payment methods can bidders use??
Almost every kind of credit and debit card is accepted, including Visa, MasterCard, American Express, JCB, Discover, and Diners Club. Live.Payments also supports Bank Transfers (ACH transactions) and Zip (previously QuadPay) for even more payment flexibility.
What is the processing fee??
For credit card payments, Live.Payments charges a competitive rate that is a flat fee regardless of card type (Amex, Visa, etc.) or origin (the U.K., Canada, etc). Bank Transfers (ACH transactions) are subject to a lower processing fee, and allow you to offer your bidders a lower cost payment method.
Note: Buyers from outside the continental United States not using Live.Payments must pay via bank wire transfer for purchases over $1000. Please email our office for wire instructions.
Sales Tax:
Online purchases may be subject to sales tax. Please see the following for more details. If you are tax-exempt, you can submit your tax-exempt certificate to prevent the collection of tax. Learn more about tax-exemption.
The buyer shall not acquire title or take possession of the lot until all amounts (including the hammer price and applicable taxes) due to ArtMeetsStreet LLC have been paid in full.
All payments must be received no later than 72 hours after receipt of invoice after the auction. After 7 days of non-payment a dispute will be opened and we have the right to relist the item if we so chose. Interest on delinquent accounts will be assessed after (14) days from auction date.
Shipping:
Items will be shipped out of our Washington, DC warehouse. Unfortunately we are unable to offer local pickup at this time.
Material is generally shipped within 14-21 business days of payment received in full.
ArtMeetsStreet LLC will arrange for shipping of your property. Buyer will be responsible for the cost of shipping, signature and insurance on the item. Once the property is shipped and out of our control we no longer cover the property.

Disputes - In the event of a dispute, the Auctioneer will be the final judge as to which Bidder is successful. The Auctioneer may at his sole discretion, re-open the bidding on a particular item. Title shall pass on all items sold when the Auctioneer says "SOLD". The Purchaser assumes total and full responsibility for all goods at that time, and is responsible for payment for all items whether or not the Purchaser actually takes possession at that time. If any dispute arises after the conclusion of the Auction, the records of the Auctioneer and Clerk shall stand as conclusive. Any loss or damage by breakage, natural disaster, theft or any other cause is therefore the sole and entire responsibility of the Purchaser.
Return Policy - All sales are final. There are no cancellations, returns or refunds. Under certain circumstances, we may make an exception and allow a cancellation, return or approve a refund. However, in the case of a return the Buyers Premium and Shipping cost will not be refunded. If a winning bid is canceled for any reason, and the winning bidder wishes to back out, an 10% fee will be charged to the winning bidder (non-performer) to cover the costs associated with listing and the non-performer may be blocked from future bidding.
