As a live auction gallery all of our goods are on consignment, one way that auctions houses make money is by charging a buyer's premium on top of your purchase price. PLEASE TAKE THIS INTO CONSIDERATION WHEN BIDDING!!! If you bid $100 it is actual $120, $500 is $600... Take all of this into consideration when bidding! ● Preliminary Invoices will be sent out the next BUSINESS day after the sale. ● Books & some flat art will be packed and shipped by Quinn’s & Waverly Auctions Staff. Each individual book is carefully hand wrapped, and packed with wrapping to fill mediums size boxes. ● There will be a min. $10 fee per box included in your shipping quote. To estimate shipping charges assume that the avg Book weighs 3 lbs, large books can be in excess of 10 lbs. We get approx. 10 avg size books per box. Go to www.UPS.com and quote your desired shipping with your estimated weight. Don't forget to include the $10 per box handling fee. Individual books and papers will have a reduced handling fee. ● Special Shipping Instructions cannot be guaranteed unless arrangements are made prior to or immediately following the sale. Buyer's may choose to have a third party pick up and pack their books. Payment is expected within 5 days of receipt of this invoice. ● NPB (Non-Paying Bidders) will be filed if payment is not received within 30 days following the date of sale...NO EXECPTIONS! ● Feedback will only be left once feedback is received by the seller ● We are a live (bricks & mortar) auction house, all our goods are on consignment... NOTHING IS NEW. Please request condition reports if you don't feel that it is adequately given in the description. We do our best to highlight condition problems, we don't get them all. FULL PAYMENT: All items must be paid for in full within 5 days of receipt of invoice. Items paid for but not removed after 30 days will be forfeited. Nothing may be removed until it is paid for. Payment for purchases must be made by cash, credit card (Visa, MC & American Express), or check, personal or business, if approved by the Auctioneers. All sales are subject to Virginia State Sales Tax laws. Bidder agrees not to stop payment on checks or disallow a sight draft and is responsible for any expense due to collection of bad check. Return check fee is $25.00. The Auctioneers reserve the right to repossess, at any time, at your location, the merchandise involved. 2. AUTHENTICITY: Quinn’s Auction Galleries & Waverly Auctions have made every effort to accurately describe and catalogue all property to be sold; note, however that catalog descriptions are somewhat interpretive. All major defects have been noted, along with comments on general overall condition. HOWEVER IT BEHOOVES THE SERIOUS BIDDER TO EXAMINE THE MERCHANDISE PERSONALLY. Quinn’s & Waverly assume no risk, liability or responsibility for the identification or authenticity or authorship, of any property identified in its catalogues or lists of sale, except as stated in Paragraph 2a. The descriptions of items appearing in the auction catalog and any advertising prior to an auction are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by the Owner (or his agents or officers) or the Auctioneer (or his agents or officers) concerning any item shall be construed as a warranty, either expressed or implied. The Auctioneer reserves the right to withdraw any property at any time before the fall of the hammer in its sole and exclusive discretion. 2a. LIMITED WARANTY: If merchandise purchased is found to be substantially at odds with the condition as described, or if upon collation the item is found defective in text or illustrations, or if an autograph, photograph, or graphic can be proven not genuine, then it may be returned for full refund, as follows: For those attending, return must be made the day of the sale unless otherwise provided. For absentee bidders, return must be made within two weeks (14 days) of receipt of property, providing written notice detailing the reason for return is given first within five (5) days of receipt of property, and providing that the item is in the same condition as when sold. All returns must be completed within 30 days of sale date, absolutely no exceptions. 3. RESERVES: In some cases items may be subject to reserve as indicated in the catalogue or by the auctioneer. The auctioneer and its representatives reserve the right to bid on behalf of the consignor up to, but not exceeding the reserve price. In certain instances, the Consignor may pay less than the standard commission rate where the Company or its representative is a successful bidder on behalf of the Consignor. Where the Consignor is indebted to the Company, the Company may have an interest in the offered lots and the proceeds therefrom other than the broker's Commissions, and all sales are subject to any such interest. 4. BUYERS' RESPONSIBILITY: After a Bidder has won the bid with his/her high bid, they have become the new owner of the item, even though they may not have paid for the item yet. We encourage buyers to insure their purchases during shipping, as merchandise purchased online is not covered by Quinn's & Waverly Auctions, and is the responsibility of the buyer. 5. DISPUTES: The Auctioneer shall designate the winning bidder after each item is auctioned. If a dispute arises between two or more bidders, the Auctioneer reserves the right to reopen the bidding. The Auctioneers' designation of a buyer is final. 6. INJURY AND DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by Bidder or his agent, and further agrees to hold Auctioneers harmless from any personal injury to himself or his Agents and any property damage incurred on auction premises. 7. AGENTS ONLY: The Auctioneers are acting as the Owners Agents only. 8. ESTIMATES: A range of estimates is given for each lot, with a low estimate and a high estimate. The estimates are merely guides for bidders and an opinion of the auctioneer or representatives of the price a lot might bring at auction. Estimates are based, where possible, on prices that similar items have sold for in the past. Estimates should not be relied on as a representation or prediction of the actual price a lot will be sold for. Actual selling prices could be significantly different from estimates. Quinn's Auction Galleries will not be liable if the actual selling price is different from the estimate. Estimates do not include the buyer's premium, any applicable taxes or other charges. 9. STORAGE: ITEMS NOT PAID AND SHIPPED OR PICKED UP WITHIN 7 DAYS FOLLOWING THE AUCTION WILL BE SUBJECT TO A $3.00 PER DAY STORAGE CHARGE. If items are not picked up within 30 days the item will become property of Quinn’s. No refunds will be made and the purchaser forfeits all rights to the item(s).
