By bidding in this auction you acknowledge that you, the Bidder, or Serious Buyer (or Bidder, or Winning Bidder, each of which terms may be used in place of each other) hereby agrees to be obligated by all of the terms and conditions of this auction as described herein, or any lot listings by APPEL AUCTION. These terms and conditions, and the information contained in any lot listing binds the entire agreement between Buyer and Fine Judaica Inc. These terms and conditions, and the information contained in these listings may only be altered by APPEL AUCTION. By joining in this auction, Buyer agrees that Buyer is obligated by all the terms and conditions and the information included or mentioned in any listings, including Fine Judaica Inc., - officers and all other affiliates. Any issues occurring from any dis-agreements between APPEL AUCTION. GENERAL TERMS AND CONDITIONS and the contents of any listings, any invoices, or the LIVE AUCTIONEERS General Terms and Conditions; these General Terms and Conditions shall supersede and govern all of the above confirms, to the best of its knowledge that the information presented in any listing has come from reliable sources. Such information is presented solely for the convenience of the Buyer. Fine Judaica Inc., makes no assurance of any kind related to the information presented in any listing. At the close and reconciliation of the auction, Fine Judaica Inc., shall determine the actual winning Bidder of each lot and may, in its sole discretion, at any time, offer any Bidder a duplicate item at the Bidder's maximum bid on the lot. In the event of any dispute between bidders, or in the event of doubt on Fine Judaica Inc., including the validity of any bid, Fine Judaica Inc. will have the exclusive final discretion to determine the successful Bidder, cancel the sale, or award the lot to the next highest Bidder or Bidders or to re-offer and resell the lot in dispute. Fine Judaica Inc. is not responsible for any errors or omissions in connection. Fine Judaica Inc. reserves the right to protect any reserve price by placing floor bids; to place bids on behalf of any buyer or seller; to bid for its own account or to remove any lot from sale without notice. Any bid entered by a Bidder shall be determined in the sole discretion of Fine Judaica Inc. to have exceeded or not to have exceeded any reserve. CONDITIONS OF SALE
1. The items in the lots of this catalog are sold in AS IS condition. Most of the items offered are quite old and should be inspected for defects and losses prior to bidding. APPEL AUCTION. will try to describe these items for the consignor as accurately as possible. However, the descriptions pertaining to age, origin, authorship, and condition are only the OPINIONS of our experts and are not binding. Prospective bidders are encouraged to exercise due diligence prior to bidding.
2. The final purchase price of the lot will be the auctioneer's hammer price plus 23% until reaching $100,000. From $100,001 upwards, the additional premium will be 15%. The purchaser must pay any New York Sales Tax of 8.875%.
4. All lots may be picked up by appointment at our Gallery: APPEL AUCTION. 1453 36th Street Brooklyn NY, and paid for at that time. Shipping will be made available by a Third party, (shipping charge will be determent by location.)
5. The auctioneer will acknowledge the highest bidder. His word is final. The auctioneer reserves the right not to accept any bid he deems unfit. He may advance the bidding up to the reserve (the minimum confidential amount that the consignor is willing to sell the object for). If a dispute arises, the auctioneer has the right to cancel the sale and re-offer the lot.
Autopay
If you have not contacted Appel Auction to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
SALES TAX
