All property is sold "as is where is", and neither the auctioneer nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, or description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability. All sales are final, no returns under any circumstances. Prospective bidders should inspect the property before bidding to determine its condition, size, and whether or not it has been repaired or restored in anyway. The highest bidder as determined by the auctioneer shall be the purchaser. In the case of a tie bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or reoffer the lot for sale. If any dispute arises after the sale, our sale record is conclusive. Although in our discretion we will execute absentee bids or LiveAuctioneers bids as a convenience to clients who are not present at auctions, we are not responsible for any errors or omissions in connection therewith. A&S Antique Auction Co. offers the LiveAuctioneers tool as a convenience to our clients. Please be aware that in rare cases, an absentee bid submitted through the Internet may not be accepted by the auctioneer conducting the sale (if, for instance, an equivalent absentee bid was placed directly through A&S Antique Auction Co.). This may occur even when the Internet absentee bid was placed earlier than an equivalent absentee bid. The auctioneer has final discretion over which bids to accept, as described elsewhere in this document. We do not offer in house shipping and all shipping payments will be made directly to The UPS Store of Waco. The UPS STORE CHARGES A $5 PICK UP FEE PER CUSTOMER. In house bidding terms: For buyers attending the live auction, all merchandise purchased must be paid for the day of the auction, no exceptions. For in house auction purchases, A&S Antique Auction Co. accepts cash, Visa, Master card, preapproved personal checks and business checks as payment. We do not charge a buyer's premium to in house bidders. We reserve the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, A&S Auction Co. may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach, and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has failed to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale. In no event will the liability of A&S Auction Co. to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item. Bidding on any item indicates your acceptance of these terms and all other terms announced at the time of sale whether bidding in person, through a representative, by Internet, or other absentee bid.
