TERMS AND CONDITIONS These terms and conditions apply to all items offered herein by Gems and Gifts Inc. and any other items that are linked back to Gems and Gifts Inc. (collectively ?GGI?). Please read all Terms and Conditions as by purchasing a product with GGI, you agree to these terms and conditions and anything stated herein. These terms and conditions govern your use of, and any purchase from GGI, and constitute an agreement between the consumer (?Bidder?) and GGI. GGI reserves the right to modify, amend or make any changes to these terms and conditions at any given time without prior notice. Changes will always be effective and updated once made, via website and/or any affiliate site, such as Auctioneers.com, and all sites in which GGI has posted sellable product. If you do not agree to the terms and conditions set forth, then you must not purchase and item with GGI. These terms and conditions of sale are made by and between GGI/Auction house (?GGI?) and the Winning Bidder, Purchaser, Buyer or Agent (?Bidder?). All property in the sale is offered to the following terms and conditions and is applicable to all Bidders. Please be advised that by placing a bid you are entering in to a legally binding contract with GGI and must abide to all terms and conditions set herein These Terms and Conditions of Sale shall take precedence over any statements made to the contrary by the auctioneer, staff or affiliates. 1.Product a.All product is sold as described. All product will be sold ?as is.? All information about the product has been fully disclosed and can be viewable per images. b. GGI takes pride in its ethical standards when describing product and promises to honestly disclose all in each product description. c.The full state of condition of the product will be stated in description and will always be given as an opinion and may be deemed subjective. No warranty is expressed, implied or provided, since all opinions can and do vary among individuals. d.GGI is in accordance with all the general practices used in the industry when describing a product. e.General quality standards and practices are always used when labeling and describing all specs of a product. f.At times data, prices and/or information may be inaccurately displayed. This may be due to typographical errors. GGI reserves the right to correct any and/or all errors when they occur without any prior notification. 2.Bidding Process and Sales a.All Bidders must register with LiveAuctioneers.com to participate in the online bidding. b.GGI reserves the right to contact LiveAuctioneers.com to verify all information prior and after any bidding process. c.At the end of each auction, or when the statement ?sold? has appeared during the auction, the highest Bidder is responsible for purchasing the item at the winning price along with Buyers Premium and/or any applicable taxes and fees. d.The highest Bidder acknowledged by the GGI and/or Auctioneer, shall be the purchaser and sole winner of the auction. e.Placing a bid constitutes you as eligible for corresponding auction and by placing a bid, you are entering in a legally binding contract between GGI. All terms and regulations that constitutes an auction bid, winning bid and/or sale, are stated herein. f.By placing a bid, you agree to take part in the corresponding auction and are entitled to follow all rules and place bids accordingly, and is conclusive proof that you are taking part in the auction. g.Highest Bidder must complete full transaction of sale within a 24-48 hours from auction ending and/or hammer falls. Please contact GGI if other arrangements need to be made. h.A dispute will be filed with the auction house and/or payment institution if a sale has not been completed within 72 hours of confirmed sale. i.The winner of the auction shall always go to the highest bidder. j.The winning bidder has legal obligation to purchase item/product from seller, GGI. GGI reserves the right, at any time, to cancel transaction, withdraw item and/or refuse service to bidder/winner without prior notice. k.All items offered by GGI constitute a reserve price. The reserve is a confidential minimum price for each item that must be met before the item can be sold. If the reserve price is not met, the item will not be sold. l.GGI reserves the right to refuse any bid, advance the bidding in any manner, determines a successful bidder, continue the bidding to cancel a sale, and reoffer and withdraw an item for all GGI auctions, without any prior notification. m.Should a tie in the bidding process occur, GGI has the right to reopen the auction to all bidders. GGI will also contact both parties to offer other alternatives and/or similar items. n.Losing Bidder may want to contact GGI incase winning Bidder did not complete sale. The losing Bidder will be able to purchase item at winning bid, as long as bid has reached the reserve amount. o.Items that have not been placed in auction and have not been completely processed and sold, GGI reserves the right to replace the item for auction for a different price. p.Once a Bidder has won an auction, an invoice and full description of sale will be presented to the winning Bidder. q.All statements contained the catalog and/or any bill or sale, invoice shall be constituted as an opinion as typographical errors may occur. Please refer to original auction or contact GGI for any discrepancies or differences, in amounts, weights and measures, and/or accounting. r.GGI reserves the right to withdraw any property, statements, descriptions stated during any auction and reserves the right to reject any bid from any Bidder upon our own discretion. 3.BUYERS PREMIUM (need to find out what this is) a.Buyers Premium of 10% will be added to every sale. The final price will always include the Buyer?s Premium unless otherwise noted. 4.Payment Policy a.All payment(s) must be fully received before any item/product is shipped out. b.No property will be released until payment is made in full with an approved method of payment. All checks, drafts, wires and/or any forms of payment must be cleared first. c.All payments must be paid in US dollars and can be paid in multiple forms. d.Forms of Payment include: Credit Cards, PayPal, Cashier?s Checks, Personal Checks, Money Orders, Wire Transfers, International Drafts. e.Any fees incurred from any of the above payment structures, will be incurred and paid for by the Bidder. Full invoice, including fees, must be paid before item is shipped. f.GGI will contact Bidder if any issues or problems occur during payment processing. g.Please contact GGI if you have another form of payment. This payment will need pre-approval from GGI before processing. h.Contact GGI for wire and banking information if this is preferred method of payment. i.GGI reserves the right to contract with collection agencies, credit bureaus and/or other legal agents in order to collect payments, unpaid invoices and/or product. 5.Orders and Shipping a.GGI provides free shipping to all customers. Each shipment will be fully insured and accompanied with a certificate appraisal. b.The winning Bidder will need notify GGI on which courier service will be best for delivery. c.GGI ships all product via United States Postal Service, United Parcel Service (UPS) and Federal Express (FedEx). FedEx and UPS will be the default delivery services. If another courier service is needed, please contact GGI for further assistance. 6.Returns and Exchanges a.GGI provides a hassle free return policy. If you are not happy with purchase, you can return the item/product without any penalties and/or fees. b.Please be sure to contact GGI within 3-5 business days of receiving any item(s) that are damaged, defective or not as described. c.Any returns must be accompanied with a Return Merchandise Authorization (RMA) number. Please contact GGI right away to receive an RMA and proper instructions for return. d.Bidders must provide each return with a satisfactory reason for return. e.All items must be returned in the original form and received as the same condition it was sent. Any items that do not come back this way, will be entitled to penalty and fees and/or GGI will not recognize the return and a refund will not be given. f.Items must not be modified, altered /and or changed in any way. If items has been modified, altered and/or changed, GGI will not constitute a refund and item will be sent back to Bidder. g.Shipping the return back to GGI is full responsibility of the Bidder. h.Bidder must handle all costs for shipping item/product back to GGI. Item must be fully insured. i.In the event of any dispute and/or claim between Bidders, Auctioneers and/or GGI, the Bidder must contact GGI immediately for claim to be valid. A representative from GGI will issue a reference number and upper management will be notified and dispute will be handled with Bidder and/or end-user. j.In the case of a sudden emergency, due to, but not limited to, a fire, burglary, damage or an act of god, and GGI is responsible for sending out product and/or refund, GGI will refund and/or return all property and funds minus any incurred fees after all has been restored. k.After 30 days of the sale, GGI and the auction house will be released of all liabilities and no claims can be made against GGI and/or the auction house. l.GGI has a NO CHARGEBACK policy. By accepting these terms and conditions the Bidder agrees to not filing any chargebacks and agrees to follow all terms set herein. The Bidder must contact GGI for any returns and/or exchanges. m.Bidder may file chargeback if claim is legitimate and has been acknowledged by GGI and/or product has been fully misrepresented at time of auction. 7.RETURN PROCESS a.Call GGI and retrieve RMA number. b.Include with the return the original invoice and letter stating the RMA # and a brief description for the reason of return. c.Please make sure all product is in its original form (the way it was received) and put items back in to original jewelry boxes. d.Please make sure all items are properly secured. Please use tape and/or any packing material to help keep product safe. Remember, the item is fully your responsibility before it arrives to us. e.Take the item to a FedEx or UPS location. Put the item in a small box and then in a medium/large box. Double boxed packages are fairly more secured. f.Fill out necessary form for shipment and mail package to i.GGI 606 S. Hill Street #1105 Los Angeles, CA 90014 213.352.2484 g.Please do not state the word ?Jewelry? or ?Gems? anywhere in the address or on the box. h.Please make sure to insure the package the same amount as your purchase. i.Keep note of tracking number and contact GGI letting them know package is on the way. j.Shipping costs will not be refunded by GGI. 8.Pricing Policy a.Product prices are always subject to change without any prior notice. b.If a product has been priced wrong due to typographical error, GGI has the right to cancel the order and/or change the price to the order without any prior notice. c.If the order has been shipped and the product was priced wrong, GGI reserves the right to cancel order, stop shipment and/or charge the customer for any monetary differences that may have occurred. d.No employee, agent and/or representative from GGI is authorized to make any changes or authorize any monetary decisions. All authority will need to be approved by the manager with stated proof. All proof will be noted by manager and will serve as the cross check. e.Any statements made in this Terms and Conditions supersede any oral commitment. 9.Shipping and Receiving a.GGI will ship any winning item/product, free of charge for all domestic shipments. b.A minimum fee of $49.99 will be charged for all international shipments. Cost for international shipments may increase if destination is remote and/or destination has extra fees involved. c.All items will be shipped within 2-5 business days after auction has and transaction has been fully processed. d.Tracking information along with full details will be disclosed to the winning Bidder, upon full completion of sale. e.All items will be shipped in new jewelry boxes and shipped in new outside packaging. We do this to keep all claims valid with the carrier service. f.If for any reason the package is received and seems to be damaged, do not open package. Please contact GGI immediately and we will coordinate and a return shipment. Insurance may need be claimed if product is damaged. Again, please contact GGI in case of any damage to package and/or ring. g.Any return shipments will be the responsibility of the end-user. Please see ?Returns and Exchanges? for full details in regards to return shipments. 10.Certificates a.Each item is backed up by a certificate provided by a third party representative. b.The third party representative is a GIA Graduate Gemologist, fully certified with over 15 years of experience in the industry. Please visit www.gemologylab.com for more information. c.Each certificate provides full details on specifications for all aspects of the item. d.Each certificate shows an appraisal value that is solely used for insurance purposes. The resale value shall not constitute the actual value of the item in any given market. e.All statements and information listed on each certificate is sole opinion of the inspector and shall never be taken as true fact. f.The appraisal certificate shall not be used for resale purposes. g.All values are based on a common valuation practice and is accordance with the general practices that are commonly used in the industry. If so, GGI holds the right to take action in a court of law.
