Auction items can be picked up at our location in Oakville CT BY APPOINTMENT between Tuesday 7/11 - Friday 7/21 M-F 10am to 3pm (Saturday 7/15 Pickup is avalable). All items must be picked up before Saturday 3/29/2022 2. Lots must be picked up within the dates listed or a $5 per day per lot storage fee will applied to any items not picked up in the listed window. NO EXCEPTIONS! 3. We DO NOT currently provide any in house shipping options. Shipping is provided through 3rd party shippers only (More information below) 4. It is your responsibility to read these terms & conditions in full before bidding. PICKUPING UP YOUR PURCHASES: All of the items in this auction will need to be picked up at 28 Main Street, Oakdale CT, Tuesday 7/11/2023 - Friday 7/21/2023 Monday through Friday from 10:00am EST to 3:00pm EST. We are offering Saturday 7/15/2023 for pickup appointments as well during the same hours. All lots must be picked up No later than Friday 7/21/2023. Any lots remaining in our gallery after Friday 7/15/2023 at 3:00pm est will be subject to storage fees of $5 per lot per day to be paid before your items can be released. It is expected that ALL of our customers have read the auction terms & conditions thoroughly prior to bidding and fully understand the pickup requirements. East-Wing will not be responsible for missed pickups. It is ultimately your responsibility to reach out to us prior to make the necessary pickup arrangements for your items. We request bidders to reach out to the auctioneer after the close of the auction to arrange your pickup time via Phone or email. TERMS OF PICK-UP Removal shall be at the sole expense, liability, and risk of the purchaser. All successful bidders who have not previously made 3rd party shipping arrangements are expected to pickup their purchases within the pickup window. If your purchases are not picked up within the pickup window the auctioneer reserves the right to charge a storage fee of $5 per day / per lot. Your items will not be released until the storage fees are paid if your items not picked up within the pickup window. Your items will be held for a maximum of 30 days, after which they will be considered forfeited, and East-Wing Estate Sales may reoffer the items for sale. Forfeited invoices will not be refunded under any circumstances. It is ultimately your responsible to ensure you are available and prepared for the pickup, packaging, and moving of your purchases at the pickup location within the listed pickup window. There will be no moving assistance for you at the pickup location. You are expected to bring with you all the necessary packing materials and moving assistance required to remove your items. Please do not bid if you cannot make the arrangements to properly move the items you are purchasing. If at any time a member of our staff feels that you are not adequately prepared, or incapable of properly moving an item where we feel there is a risk of damage to our facility, or injury of yourself and others. We will ask you to stop until you can make the proper arrangements to move the items in question. If you cannot get the help required to safely move a large item before the close of the pickup window your items will be forfeited and considered abandoned with no refunds or credit. If during the removal of your purchases from our facility, you damage property in any way you will be required to pay for the damages incurred at your sole expense. SHIPPING - PLEASE NOTE! SHIPPING IS EXPENSIVE and the cost of shipping may exceed the purchase cost of your item. East-Wing has NO control over the shipping quotes given by 3rd party shippers. It is advised that you call or email the shipper BEFORE bidding to find out the shipping costs on an item BEFORE you bid. East-Wing Estate Sales DOES NOT provide shipping services in house. We must be notified directly if you need to have your purchases shipped, we will assume you are picking your purchases up in person if no shipping request was sent to the auctioneer prior to the pickup date listed above. You must arrange your own 3rd party shipping. With this option for your items must be pickup up by the shipper within the pickup window, with no exceptions unless previously arranged with the auctioneer. East-Wing is not responsible for errors or omissions by any third-party agent. Below are our preferred shippers who work with us regularly, however you are welcome to hire any shipper you like as long as the items are picked up within the time frame listed above. Refunds will not be issued under any cercumstances. We will reach out to you by your email on file only, and after a final notice is sent after 14 days we will not contact your any further. East-Wing is not responcible for errors in your customer account information, or if the email entered is invalid. ABSENTEE BIDS & RESERVES: We accept absentee bids by phone (subject to availability), by mail, or in person. Absentee bids need to be requested no later than 24 hours before the auction. We will require a valid Credit Card to be placed on file before any absentee bids can be accepted. If you mail in your absentee bids, please call us to confirm that we received them. All absentee bidding is handled as though you are in attendance. We will bid on your behalf on all designated lots at the bidding increments just above where competition stops. Please check these increments before placing your bids to understand where your bids may end up. All absentee bids will start at the listed starting bid unless there are two or more competing absentee bids at a price higher than that in which case, we will place you bid at the next highest bidding increment. Because of the way our bidding is structured, it is possible that several people will leave identical bids, the winning bid will go to the bidder who placed / sent in their absentee bid first. All absentee bidder names and bids are held in strictest confidence, disclosed only in the event of a question after the sale. Absentee bidding is a convenience offered to our customers and while we will make every effort to execute your instructions, East-Wing Estate Sales is not liable or responsible for any errors or failure to do so. A reserve is the confidential minimum price established between the auctioneer and the consignor. East-Wing may implement a reserve on a particular lot by bidding on behalf of the consignor up to the reserve price. If the bidding on a lot fails to reach the reserve price, the lot will be bought-in by the auctioneer and the highest underbid brought to the attention of the consignor for consideration. If the consignor decides they would like to sell the item at the highest offered bid, we will reach out to the bidder and offer them the lot at the underbid price. PHONE BIDDING: When telephone bidding is available, telephone bid lines are given on a first come, first-serve basis - please reserve your phone bid as soon as possible. All requests for phone bids must be placed 24 hours before the auction. If you need condition reports or more information on a particular lot, contact the auctioneer prior to requesting the phone bid. At the time of the auction, we will call you at the phone number(s) given ONLY. If you are unsure of where you or your agent will be during the sale, we recommend you leave absentee bids instead. All requests for overseas phone bids must be accompanied by absentee bids, which will be executed on the buyer's behalf should there be any problems with telephone connections. Your phone number and lots will be confirmed before the auction. Please do not change your phone number after your phone lines have been confirmed; if you do, East-Wing Estate Sales will not be responsible for any breakdown in communications. Bids are placed on the phone at the sole discretion of East-Wing Estate Sales, and at the caller's risk. Telephone bidding is a convenience offered to our customers and while we will make every effort to execute your instructions, East-Wing is not liable or responsible for any errors or failure to do so. PAYMENT: All invoices must be paid in full no later than 5 days after the close of the auction. Invoices for successful bidders will be sent out the evening of the auction close. If we have a Credit card on file for you, it will be automatically billed after the close of the auction. We do not accept payments in person, or via cash or check with no exceptions. If you need to use a different card than the one you registered with you will need to call us as soon as possible. For payments taken over the phone your billing address registered to your account must match the card you are providing over the phone with no exceptions. Any invoice greater than $5,000 usd payment must be made by a bank wire or other certified funds. Contact us for wire instructions. (LiveAuctioneers customers will have their cards automatically billed 72 hours after the close of the auction. Or you can make a payment using there LivePayments system anytime). East-Wing will not tolerate credit card chargebacks on items that have been delivered / Picked up to / by the customer for any reason. All items sold by East-Wing are sold absolute As-Is Where-Is with no guarantees, or warranties either expressed or implied. Any delivered or picked up items subject to a chargeback will be considered as stolen merchandise and reported immediately to local authorities. Returned checks and chargebacks will be subject to a $50 fee billed automatically to your card on file regardless of the outcome of the dispute or returned check. For purchases of Gold, Silver and High Value items: If you are purchasing gold, silver or other high value items (What constitutes a "High Value Item" is up to the sole discretion of the auctioneer), we may require additional verification from you prior to releasing the items to you or a 3rd party shipper. For invoices containing Gold, Silver or High value items payments must be made via bank wire or other certified funds, no other payment methods will be accepted. Due to an increased number of fraudulent accounts all new customers must adhere to this rule. Known customers may pay for these type purchases normally with their card on file. This however is up to the sole discretion of the auctioneer. BUYER'S PREMIUM A buyer's premium of 25% will be added to the hammer price of each item. Sales tax is then applied to the invoice total unless a valid resale certificate is already on file. We will require a copy of your resale certificate as well as the CT Resale Form (Found on our website) to be filled out and sent to us via email prior to the tax being removed. The information on the resale certificate must match the information on your account for the tax to be removed we cannot remove the tax if the information does not match. It is ultimately your responsibility to provide us with a copy of your certificate. The buyer's premium is non-refundable under any circumstances. WARRANTIES: Condition reports are made to the best of our ability but are not guarantees. No employee is authorized to make any warranties, expressed or implied, on behalf of East-Wing Estate Sales, LLC. Items described as "Appears to", "possibly", "probably" or "attributed to" are not to be considered a guarantee, but rather the matter of opinion of the auctioneer. No guarantee is made in relation to an items condition. All bids are binding, and you (The seller) are expected to have reviewed the listing and photos for accuracy, lot contents and condition. Once you place a bid on any item in the auction there are no options for refunds, returns, or exchanges. All items are sold AS IS, WHERE IS as seen in our photos and ALL SALES ARE FINAL. Once a bid is won it is ultimately the buyer's responsibility to gain possession of their purchases regardless of the situation or any previous arrangements made with the auctioneer. In any situation where a purchase is canceled or merchandise is returned by the buyer; shipping costs, fees, and the buyer's premium are non-refundable. AUCTIONEER'S DETERMINATION: A lot will be sold to the highest bidder as determined at the auctioneer's sole discretion. The auctioneer will also have the sole discretion to resolve any disputes between bidders and determine whether to pass or re-offer a lot for sale. The auctioneer may reject or challenge any bid or advance in the bidding. WITHDRAWAL OF PROPERTY FROM SALE: East-Wing Estate Sales, LLC reserves the right to withdraw property from the sale for any reason without notice and with no liability for such withdrawal. RESCISSION BY PURCHASER If within thirty (30) days after the sale the original purchaser gives written notice to East-Wing Estate Sales alleging that the age, authenticity, condition, genuineness, quantity, period, culture, source, or origin as set forth in the terms of sale and warranted by East-Wing Estate Sales, as evidenced in the written condition report obtained by the purchaser, were materially inaccurate and misleading and substantially overstated the value of the Property, and returns the Property with five (5) days of receiving this permission in the same condition it was in at the time of sale and proves the truth of such allegations to the satisfaction of East-Wing Estate Sales, the sale of such lot will be rescinded, East-Wing will refund the full purchase price to the purchaser. Refunds shall not include costs of transportation or shipping, insurance, or other expenses that may have been incurred by the purchaser. After 30 days from the date of purchase (NOT the date of delivery) the guarantee will expire and all items are then sold as-is, where-is and there will be no returns for any reason. This limited right of rescission is available only to the original purchaser and may not be relied upon by any heir, agent, transferee, assign, or other third party or assigned to any subsequent transferee of the Property which gives rise to the claim. The purchaser acknowledges and expressly agrees that the provisions of this paragraph state the sole and exclusive remedy available to a purchaser in the event of nonconformity in Property purchased. The purchaser understands and agrees that the exclusive remedy for any breach of the warranty shall be a rescission of the sale and a refund of the original purchase price (bid plus buyer's premium), as well as any applicable taxes paid. Neither East-Wing Estate Sales nor its consignor shall be liable for damages beyond the remedy expressly provided for herein, such as but not limited to, direct, indirect, special, incidental, punitive, or consequential, including the loss of profit or revenue, cost of obtaining alternative property, claims of customers of the purchaser or otherwise.

If you have not contacted East-Wing Estate Sales & Auction Company to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
