1.By placing a bid, you are entering into a legally binding contract with iStone Jewelry. If you are the winning bidder, you shall have a legal obligation to purchase the property bid from iStone Jewelry. Place the bid only if you need to buy the lots. In addition to the hammer price per lot, there is a 10%-25% buyer's premium for each lot sold at auction. The winning bidders are the highest bidder acknowledged by our auctioneer. iStone Jewelry will have the final discretion in determining the winning bidders and in resolving any dispute between bidders. In case of any disputes after the auction, the sales records of iStone Jewelry shall prevail. The winning bidders must pay for the entire invoice before any items are removed or shipped. All items must be paid within three (3) business days from the auction date. GST is charged according to state regulations.The winning bidders can pay by credit card, wire transfer or Live-Payment. iStone Jewelry reserves the right to hold any purchase until confirmed receipt of all funds. 2. Shipping iStone Jewelry provides packing and shipping services solely for the convenience of our bidders. We will ship the lots ten (10) business days after we received the full payment barring any unforeseen shipping delays. We mainly use the United States Postal Service (USPS), UPS or FedEx for shipping the lots. When a bidder's item(s) are shipped, the bidder will receive an email/message confirmation with tracking information. Special shipping and handling requests may be accommodated on a limited basis at iStone Jewelry's sole discretion and may incur additional handling charges. Large, heavy, fragile or otherwise unusual items will incur additional charges. By acknowledging this Agreement, Buyer agrees to any additional charges as may be necessary to accommodate special shipping and handling requests. In the event a Customer's items are returned to iStone Jewelry for any reason including but not limited to an incorrect delivery address or the Customer (or adult) was not present to receive and sign for the package, then iStone Jewelry reserves the right to charge the customer for the new shipping cost. iStone Jewelry will ship items to foreign locations using the same classes of mail and additional postal services that it uses to ship to US locations, to the extent that such services are available. iStone Jewelry shall not be liable for any shortfall of insurance either on foreign shipments or on the non-coverage of additional invoice charges exceeding bid amounts. WINNING BIDDERS ARE RESPONSIBLE FOR ALL INTERNATIONAL CUSTOMS, DUTIES AND/OR TAXES. We will not be responsible for any losses if the tracking information shows the package was signed for and was delivered to the correct address. If an item is lost in transit, we reserve the right to reship a similar replacement item or provide a refund. 3.Payments If you choose to pay by credit card, please note that Live Auctioneers will impose an additional surcharge on the transaction amount. All items must be paid for within forty-eight (48) hours from the date of auction. iStone Jewelry reserves the right to replace items with similar items should payment be received after this forty-eight (48) hour payment window. iStone Jewelry reserves the right to delay shipment of items until all funds have been received and cleared. Please note, if you have not contacted us to arrange payment within three (3) business days after the auction date, Live Auctioneers will charge your credit card on file for the full amount due on your invoice. 4.All lots sold by iStone Jewelry are evaluated by a third-party authoritative appraisal company, where a professional gemmologist evaluates the weight, size and grade of the gemstone and/or metal to determine the lot's replacement value.All appraisals are for insurance purposes only and do not determine the actual value of the jewelry at auction. The sole purpose of the evaluation is to protect the buyer in the event of damage or loss of a jewelry item purchased from iStone Jewelry. iStone Jewelry is not responsible for the opinions and appraisals of any third party appraisals company and its experts. 5.Return Policy All items are SOLD AS IS, with all disclosed faults. ALL SALES ARE FINAL. Returns may only be made with written authorization of iStone Jewelry, at the sole discretion of iStone Jewelry. We do not accept any return or refund if there is no quality issue with the lots.To request a return, bidder must provide a written request within three (3) days of receipt of the lot, fully explaining the basis for the return. Under no circumstances will any amount in addition to the winning bid be refunded.Any unauthorized returns will be rejected.iStone Jewelry also reserves the right to reject any returns or exchanges that do not comply with the requirements listed above. A restocking fee of twenty percent (20%) will be deducted from the Hammer and Buyer's Premium Invoice total. Shipping, handling and insurance charges are non-refundable. Customers are responsible for fully insured return shipping. The Customer must make sure to carefully package and provide tracking information for the item(s) they are returning. All authorized returns must be received in the same condition as when they were originally shipped to the Customer, otherwise they will be returned to Buyer at Buyer's expense. Any unauthorized returns will be discarded and the winning bidder will relinquish any and all claims to these items. Refusal to accept merchandise delivered by iStone Jewelry to the winning bidder constitutes an unauthorized return in direct violation of these Terms and Conditions. 6.iStone Jewelry and its consignors disclaim all warranties, express or implied, including, but not limited to, the implied warranties of merchantability or fitness for any particular purpose. There is no guarantee that the lots sold is as described by the auctioneer or catalogue. Neither iStone Jewelry nor its clients are responsible for any description of the rarity, quality, condition, size, importance or provenance of the lots. While iStone Jewelry representatives do their best to describe the item for sale, any oral or written representations made by the auctioneer or any iStone Jewelry representative are opinions only and should not be considered a warranty or representation of the sale of the property.Any low or high estimates provided in any auction catalog or by the Auctioneer prior to, or during a live auction does not constitute an appraisal and does not represent a resale value. Estimates are calculated based on a combination of previous sales for similar items, supply and demand, rarity, and targeted price range. Estimates are not Reserves and do not indicate a minimum price needed for an item to be sold. Estimates are provided merely as an estimation of similar items in new retail conditions and are meant to compare the sale of new items versus purchasing a second hand or used item(s). 7.Bidders are responsible for determining the age, size, condition and value of the lots before place the bid. By bidding, you are indicating that you have inspected the lots to your satisfaction or choose not to inspect it. If iStone Jewelry is unable to deliver any lots to the purchaser due to fire, theft or any other reason, its liability shall be limited to the purchase price paid by the bidder for the property. By registering for and/or placing a bid in any iStone Jewelry, you acknowledge that you have read, understand and agree to our Shipping, Payment & Auction Policies. If you have not contacted iStone Jewelry Co LTD to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
