10 | 10 : The Collector's Auction

1. Each lot in this catalog is offered for sale subject to the terms set out below. By bidding at the auction, the buyer and all bidders agree to be bound by these Terms and Conditions, whether bidding in person, through a representative, by phone, by Internet, or other absentee bid. To register as a bidder, you must show photo identification and present a credit card in order to open an account with HL CHALFANT: Fine American Art & Antiques (hereinafter HL CHALFANT). 2. Warranties and Guarantees: This is a guaranteed auction as expressly stated in this paragraph. All information in the written description concerning age, authenticity, genuineness, quantity, period, culture, source, or origin is warranted for a period of thirty (30) days from the date of sale by HL CHALFANT. After 30 days, all sales are "as is" and no refunds will be issued unless dually agreed to by HL CHALFANT and the Purchaser. This warranty extends to only the original buyer of record, or otherwise referred to as the registered bidder. This Warranty does not cover subsequent owners or assigns of the Property. This disclaimer of liability on our part applies whether the information is included in the catalogue, advertisements, announcements, or communicated through our representatives, bills of sale, or elsewhere, and whether written or oral. 3. Certain lots may be subject to a reserve or minimum price as agreed upon by HL CHALFANT and the Consignor. The Auctioneer will execute the reserve on behalf of the Consignor. 4. Qualifying to Bid as an Agent of the Purchaser: If you are acting as another's agent, HL CHALFANT may request a letter of authorization from the principle purchaser. If the agent of the principle purchaser is paying by check, the check must include the agent's name as an authorized user of the account. 5. Bidding Increments: The auctioneer has the sole and exclusive discretion and authority to regulate the bidding and its increments. Auctioneer's Determination Final: A lot will be sold to the highest bidder as determined in the sole and exclusive discretion of the auctioneer. The auctioneer will also have the sole and exclusive authority to resolve any disputes between bidders, determine whether to pass or re-offer a lot for sale, and otherwise regulate the bidding and its increments. 7. Buyer's Premium, Purchase Price, and Taxes: All bidding at the auction and all purchases will be in U.S. Dollars. A buyer's premium in the amount of 10% of the successful high bid, also called the hammer price, will be added to the amount of the hammer price for all lots purchased at auction. Upon the announcement by the auctioneer and the hammer falling, the successful bidder becomes the purchaser and is responsible for the amount of the hammer price, the buyer's premium, and applicable taxes. All sales shall include Pennsylvania sales tax (6%). No Pennsylvania sales tax applies to the sale of coins or bullion, but will apply to the sale of paper money. 8. Absentee Bids: HL CHALFANT accepts absentee bids by phone, e-mail or in person only. Absentee bids communicated by e-mail require phone confirmation prior to the action. Absentee bids are requested no later than 6:00 p.m. on the day before the auction. All absentee bidding is handled as though you are in attendance. HL CHALFANT will buy all designated lots for you at the next bidding increment above the highest bid from all other bidders. For example, if the highest bid from all other sources is $1,000, but the absentee bid is $1,500, the hammer price will be $1,100, sold to the absentee bidder. Because of our structured bidding increments, it is possible that absentee bidders will leave identical bids. In the event of identical absentee bids, the first left bid at the high amount will prevail and win the lot. Absentee bidders will be given the option to add a "plus bid" to an absentee bid amount. In the event that identical absentee bids are the high bids, the "plus" bid will allow the auctioneer to go to the next bid in the increment and sell the lot to the "plus" absentee bidder. In the event of identical absentee bids at the high bid amount and both of the bidders have opted into the "plus bid" option, the bid will increase to the next increment and be sold to the first absentee bid received by HL CHALFANT. For example, if the high bid is $500, which is the amount of two absentee bids, and both of the absentee bidders have selected the "plus bid" option, the bid would be increased to $550 and would sold to the first absentee bid received by HL CHALFANT. The hammer price will be determined at the sole discretion of the auctioneer. While we will make every effort to execute your instructions, HL CHALFANT is not liable for any errors or omissions. 9. Telephone Bids: Lines are available on a first-come, first-served basis. HL CHALFANT must receive notification that you intend to bid by phone no later than 6:00 p.m. of the day preceding the auction. You will be called at one phone number only during the auction. All overseas telephone bidders must leave absentee bids, which will be executed on the bidder's behalf, should there be any problems with telephone connections. Telephone bids are placed at the discretion of HL CHALFANT: American Fine Art & Antiques, and at the caller's risk. While we will make every effort to execute your instructions, HL CHALFANT is not liable for any errors. 10. Methods of Payment and Fees-Acceptable methods of payment: Accepted methods of payment are Cash, Check, Credit Card and Wire Transfers. Credit Cards will be accepted by purchasers present at the auction on the day of the sale and by other bidders at the discretion of HL CHALFANT. Payment from absentee and phone bidders is due within 72 hours of notification of successful bids. All other payments are due upon receipt of invoice. HL CHALFANT reserves the right to hold all goods paid for by check until payment has cleared. 11. As a service to our customers HL CHALFANT offers Internet Bidding, both Absentee and Live, through Live Auctioneers. The Auctioneer is not liable for, nor has control of, online transmission speeds or bid increments placed by registered Internet users. HL CHALFANT reserves the right to limit lots offered for auction through Live Auctioneers and is not liable for any errors or failure in execution of any bid in connection with this process. Bidders must read the Terms and Conditions published on that site as terms, bidding deadlines, and buyer's premiums differ slightly than bidding directly with HL CHALFANT. 12. Responsibilities of Purchaser: On the fall of the auctioneer's hammer, title to the Property immediately transfers to the successful bidder who, in turn, becomes the purchaser of the Property. The purchaser assumes full risk and responsibility for the purchased Property, including all costs and expenses of handling, shipping, insurance, taxes, export, and otherwise, and is liable for the full purchase price, plus the buyer's premium, applicable taxes, and any other associated expenses. The purchaser will pay for and remove the purchased Property from the premises of HL CHALFANT within on the day of the sale unless arrangements are made with HL CHALFANT to store the Property for pick up at a later date. If the purchased Property is not removed in this time and no arrangement is made with HL CHALFANT, the purchaser may thereafter be assessed a $10 per lot storage charge per day. HL CHALFANT may, at its discretion, remove the purchased Property to public storage at the purchaser's risk and expense. All associated charges will be added to the total invoice and must be paid in full before the Property will be released. 13. Estimates: The estimates provided in any catalogue distributed by HL CHALFANT are nothing more than an opinion of auction value. Estimates are neither a representation, nor a prediction, of the actual selling price that will be realized at auction, post-auction sale, or upon resale. HL CHALFANT shall not be liable in any way for such a difference. 14. Withdrawal of Property from Sale: HL CHALFANT reserves the right to withdraw property from the sale for any reason, without liability for the withdrawal. 15. Purchaser Default Remedies: If any of the Terms of Sale are not fully complied with by the purchaser, the purchaser will be in default without need of notice by HL CHALFANT. The purchaser shall be liable to HL CHALFANT and the consignor for the total purchase price, including all premiums, charges, and expenses specified in the Terms of Sale. The Purchaser hereby waives any rights it may have regarding HL CHALFANT's legal obligation to mitigate damages. In event of Purchaser's default, the purchaser will be responsible to HL CHALFANT and the consignor for any deficiency, any and all costs and expenses, including reasonable attorneys' fees, collection fees and expenses, late charges, and other damages. HL CHALFANT may, at its discretion, apply any proceeds of sale otherwise due to the purchaser or monies of the purchaser in HL CHALFANT's possession to reduce or satisfy the purchaser's obligations. 16. Legal Disputes: In the event of any legal disputes, the bidder/buyer agrees that the laws of the Commonwealth Of Pennsylvania shall govern. Additionally, bidder/buyer agrees to jurisdiction and venue for any legal dispute to be exclusively in the Chester County Court of Common Pleas. BIDDER/ BUYER HEREBY AGREES TO WAIVE TRIAL BY JURY IN ANY LITIGATION IN ANY COURT, WITH RESPECT TO, IN CONNECTION WITH, OR ARISING OUT OF THESE TERMS OF SALE. Finally, bidder/buyer agrees to be liable for any and all attorney's fees incurred by HL CHALFANT in the event of any legal dispute.
