TERMS & CONDITIONS Bidders are required to register with proper identification prior to the sale and may be asked to provide additional documents to support the application to bid at the WOVENSOULS auction. Upon receiving the approval to bid in the WOVENSOULS auction, the bidder agrees to comply with and be specifically bound by the provisions laid down below. 1. WOVENSOULS has made every effort to accurately describe to the best of its knowledge all items offered in its sales and believes that the information presented in any listing has come from reliable sources. Such information is presented solely for the convenience of the Purchaser. The description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property are only opinion-based appraisals offered and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed as a warranty of representation or an assumption of liability. 2. Prospective bidders should investigate a lot thoroughly before bidding and make their own assessment and judgment about origin, age & condition. All items for sale are AS IS, and it is the bidder's responsibility to assess the exact characteristics of each item. 3. By bidding the Bidder acknowledges that the Bidder has investigated the lot to his or her satisfaction, or, that Bidder has chosen not to do so, and agrees to accept the lot being bid on with no objections after the sale closes. If you are uncertain please contact us with your questions and information / photo requests prior to bidding. If you are still uncertain after we reply, please refrain from bidding. 4. The bidder understands that all the items are pre-owned and have been used before in their original cultural context. Bidders understand that unless otherwise stated the pieces are likely to be imperfect and that stains, losses, repairs, tears and other age and usage related problems are likely to be present. 4. Any and all bids made by a Bidder constitute irrevocable offers to purchase the lot at the maximum bid amount of the Bidder and may not be withdrawn by the Bidder under any circumstances. 5. All sales are final. No lots are sold on approval. Placing a bid is a legally binding obligation. There are no returns or exchanges. All lots are sold as is, where is, with all the faults, imperfections, omissions and errors in the written description, estimates, appraisals, graphics and photography. 6. Wovensouls reserves the right to reject any bid. 7. In the event of the dispute between bidders, or in the event of doubt on our part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sale record in conclusive. 8. If the auctioneer decides that any bid is below the value of the article offered, he may reject the same and withdraw the article from sale, and if, having acknowledged an opening bid, he decides that any advance thereafter is insufficient; he may reject the advance and may thereafter withdraw the property 9. At the end of the auction, title to the offered lot will pass to the highest bidder acknowledged by the auctioneer, (subject to fulfillment by such bidder of all of the conditions set forth herein), and such bidder thereupon assumes full risk and responsibility from that point onwards. 10. Invoices will be e-mailed within 24 hours of auction closing. All purchases must be paid for in full upon receipt of email invoice. 11. Payment is acceptable by Paypal, Direct Bank Deposit, Wire Transfer, Bank draft & cash. 12. In the event that a bidder does not respond to Wovensouls's request for payment or does not fulfill complete payment within three business days, a second request for payment will be sent. A final request for payment will be sent soon thereafter and if payment in full is not received within 5 days from the day of the auction, the account will be reported to Live Auctioneers as a non-responsive bidder and the Bidder will not be able to participate in any further auctions. In this case, Wovensouls reserves the right to put items back up for auction / sale. 13. Buyers are required to pay for all packing, shipping, insurance charges and customs duties applicable. 14. Please be aware that for larger and/or valuable items, shipping as well as insurance charges can be substantial. 16. Buyers are also advised to inform themselves about the applicability to customs duty or import duties to their purchases in the country. 17. We provide handling, packing and shipping services solely as a convenience for our Bidders on request. Alternately buyers may arrange for pick-up, packing & shipping through their own vendors. 18. Goods will only be released when full, cleared payment for the invoice total has been received. 19. In case the bidder arranges the pick-up, the goods will be released only upon receipt of a copy of the written instruction from the buyer. 20 In case the bidder requests Wovensouls to pack and ship the goods, we will arrange for packing through a local service provider and we will arrange shipping through DHL. 20. Wovensouls is not liable for any loss, damage, omission, or delay by any packing, shipping, or transport, company or individual, whether contracted by you or by Wovensouls. 21. In case the buyer requests Wovensouls to ship the goods, the DHL tracking number and the photo proof of shipping will be provided. 22. The buyer is expected to stay informed about the actual delivery date through the shipper's website and make arrangements to receive the delivery. 23. In the event that the buyer is not present for the delivery and the item is sent back to sender, the buyer will be required to pay for re-shipping as well as any other penalties that may have arisen due to the initial missed delivery. 24. We will use reasonable efforts to carry out online bids and do not accept liability for equipment failure, inability to access the Internet or software malfunctions related to the execution of online bids. 25. WOVENSOULS reserves the right to modify or add clauses to the terms and conditions mentioned above. 26. In the unlikely event of a dispute arising, Singapore jurisdiction and the laws of Singapore will be applicable. We stand behind our claims of authenticity. Our claims of age and origin are made 'to the best of our knowledge'. Unless explicitly stated as 'perfect condition', all items are used pre-owned items and are assumed to have imperfections arising from age and usage. Please ask fro detailed condition report prior to bidding. The items are being offered in as-is condition as will be described in reasonable details through the text description and the photos. The description of dyes, origin and other details mentioned in the listing are based on what we know about the piece. Bidders are expected to make their own independent judgement prior to bidding.
