Terms and Conditions: Glorious LLC are an irrevocable agreement between the bidders, winning bidders and Glorious LLC. Bidders accept and agree to abide by all TERMS AND CONDITIONS set by Glorious LLC after participating in our auctions. Before bidding on an item, it is the bidders' sole responsibility to identify, check, examine and definitively decide on all aspects of the item's conditions, authenticity, and effectiveness. It is the responsibility of the prospective bidders to examine the pictures and reports before bidding. All reports, dimensions, value judgments, age and quality information are provided by Glorious LLC. Please note that all appraisals are for insurance purposes only and do not determine the true value of the jewelry at auction. Appraisals are done for the sole purpose of protecting the buyer in the event that jewelry purchased from Glorious LLC is damaged or lost. Glorious LLC is not responsible for the opinions and evaluations of any third party appraisal firm and its experts. Glorious LLC and its representatives do not claim any expertise. Any notice of condition is given as a courtesy to a customer; this is just an opinion and should not be taken as a statement of fact. Glorious LLC cannot be held responsible for any errors or omissions. The absence of a condition statement does not mean that the lot is in perfect condition or completely free from the effects of wear and tear, defects or aging. The bidder takes full responsibility for the items when the hammer falls or when an online auction expires. A bid entered by the bidder by mistake is not a reason to cancel the bid or sale. The bidders agree to pay the hammer cost of the lot + the shipping fee and, if any, other costs related to the auction. Bid increases will be adjusted before the auction starts. However, the auctioneer reserves the right not to follow exactly as shown. Actual starting bids may be higher than those shown online, as Live Auctioneers change their starting bids based on our bid increases. Making a realistic bid before the auction starts can give you an advantage. It is recommended that you bid maximum to win. Each bidder is responsible for his own account and bid. Any offer made on your account will bind you to the offer in accordance with these terms and conditions. If any entity bids for a lot, then the person executing such bid on behalf of the entity hereby agrees to personally guarantee payment for any successful bid. Nothing in any listing will be construed to disclose any reserve price. In the submission of any bid, the bidder understands and accepts that the bid once accepted by Glorious LLC will be the winning bid if no other bidder has a higher bid and any reserve or reduced reserve is exceeded by the bid. A representative of the Glorious LLC will run these reserves by bidding for the sender. In any event, and whether a lot is reserved, the auctioneer may reject any bid or increase the bid that is out of proportion to the value of the lot in question. We reserve the right to reject bids submitted before or after the auction has concluded. Glorious LLC and senders reserve the right to bid for any party. Unless specifically stated otherwise, all lots are subject to a reserve price, which will be hidden from bidders. Glorious LLC will act to protect the reserve, if necessary, by bidding during the bidding process. Glorious LLC may bid for any lot under reserve by placing its own bid. Glorious LLC may continue to bid on its behalf up to the reserve amount by placing consecutive bids or bidding in response to other bidders. If there is any dispute between the bidders or Glorious LLC has any doubt as to the validity of any offer, Glorious LLC shall have the final discretion to identify the successful bidder or to rebid and resell the disputed product. If any dispute arises after the sale, the Glorious LLC sales record finalizes the event. While Glorious LLC will make every effort to ensure accuracy, if the lot's reserve price is not exceeded, Glorious LLC may, in its sole discretion, reduce any reserve price below the bidder's bid at any time without the knowledge or notice of any bidder. In case of any dispute, the sales record kept by the auction house is final. Digital records of the sale will be used for approval. All customs duties and other charges related to the batch sent to the buyer's country will be paid by the bidder or the buyer in accordance with the laws of the buyer's country only. The Bidder shall be responsible for all collection costs, including court costs and reasonable attorneys' fees. By participating in the auction on the internet, the bidders are deemed to have accepted that the Courts where the auction will be held have jurisdiction. By signing up for this auction, you are entering into a legally binding contract. Therefore, if you win your bid, you are obligated to pay. The bidder specifically agrees that by placing a bid, it will not engage in any disputes or claims for refunds with an online venue, credit card or any other third party. Bidder specifically waives its right to initiate a credit card chargeback dispute based on any claim. If the bidder violates these disputes resolution provisions, the bidder shall confesses to the fraud decision committed by him against the Glorious LLC and also acknowledges that the bidder is liable. For all damages, losses and costs, including time charges, arising from chargebacks or any claims, the bidder agrees to pay the Glorious LLC a minimum of $500 plus hourly fees and charges for any such chargeback dispute filed. If you refuse delivery of the package to complete your order, you will be liable to pay a restocking fee of 25% on the total hammer price paid, at the discretion of the auctioneer. The buyer is responsible for the entire shipping and insurance process. Sometimes you may notice that an item has been relisted. This can happen for a variety of reasons, including a previous auction winning bidder not paying for the item, multiple variants of the same item, or one of several items listed in the reserve, and the reserve not being met. Most jewelry comes from a jewelry manufacturing company that carries more than one similar item. There are times when we encounter extreme delays in receiving batches from shippers, so this may delay shipment. However, this is very rare. In the rare case that a lot cannot be received from the sender, the auction will be cancelled. Payment Instructions Invoices are sent via email within 24 hours of the auction. If the invoice does not arrive within 24 hours, it is the responsibility of the winning bidder to contact the auction house to request a new invoice. However, please check your spam folder before contacting us. Alleged non-receipt of invoice does not relieve the winning bidder from paying for the won item(s). Payment must be made no later than 48 hours after receiving your invoice. If you have not contacted Glorious LLC to arrange payment within 48 hours of invoice submission, we will charge your invoice amount to the credit card you used to register for the auction. All International bidders must pay via bank transfer for invoices exceeding $1000 unless prior arrangement has been made. We reserve the right to request wire transfers for all purchases in excess of $1000 from bidders with whom we have not done business before. This Auction bid is in US dollars. For items purchased online, an invoice will be sent to you within 24 hours after the auction closes. The invoice will provide a link for you to pay instantly and securely online. If you are unable to pay through the online check-out system, it is always your responsibility to contact Glorious LLC. The bidder hereby waives, releases, remises, acquits and forever discharges Glorious LLC and any consignor, and shall indemnify and hold them harmless against any claims, actions causes of action, demands, rights damages, costs, expenses or comp at all directly or indirectly known or unknown foreseen or unforeseen which the bidder now has or which may arise in the future on the account of any or in any way growing out of or connected with any defects, latent or otherwise or the physical condition of any items or lots of purchased or any law or regulation applicable thereto Glorious LLC or consignor shall provide notice to bidder promptly of any such claim, suit or proceeding. We take care of all shipping / handling. Buyer will pay the Shipping / Handling Cost. The Bidder will pay the shipping and handling charges to be included in the final invoice and the Auction Company will undertake all shipping and handling. The shipping cost depends on the value of each package. The shipping fee is included in the invoice, which the bidder must receive after the auction. All international packages may be subject to customs, duties, and other taxes. Bidders are responsible for paying these taxes. If you are tax exempt, please send an e-mail to info@bidir.com to submit your tax exemption document to avoid tax collection . Glorious If the LLC approves a refund, the buyer will be responsible for a 25% restocking fee based on the item's hammer price, all shipping costs and the buyer's premium. The restocking fee, shipping costs and buyer's premium will be deducted from the return. Sales tax will also be adjusted for reimbursement. Shipping and Handling will be handled by Glorious LLC through third party licensed shippers (e.g. USPS, FedEx, UPS, etc.). Shipping charges will be included in your invoice. Insurance is not included in the shipping cost. If the buyer requests insurance, Glorious LLC will update the shipping charges to include the insurance. Glorious LLC will not be liable for packages lost by third party licensed shippers if insurance is not claimed. After the payment of Live Auctioneers has been processed to the Glorious LLC, Glorious LLC will process the transaction within 10-15 business days. Watches, bags, and high-value diamond / gemstone pieces may take longer than usual to ship due to the high value and testing process. We do a thorough final quality check before shipment. If the product does not meet our quality standards during the final quality check, we will cancel the sale and refund the buyer. For all sales on any platform, Glorious LLC has full and complete discretion to cancel the sale for any reason. After the shipping label is created, the buyer receives an automated email from the third-party shipper with the tracking number. Note: You cannot merge invoices because invoices are processed by payment timestamp. Shipping and handling charges may vary based on industry prevailing rates. If we are prevented from delivering any item to the buyer due to fire, theft or any other reason, our liability will be limited to the amount actually paid by the buyer for the property in question. If you bid and are deemed the winner of any item by Glorious LLC but fail to pay in accordance with the invoice or if you file a dispute with any third party payment agent such as a credit card company. This fee is 25% of the hammer price as liquidated losses. By bidding on any party of this type, you hereby agree to pay for any such damages liquidated as a result of irreparable damage to the Glorious LLC. In addition, if the winning bidder fails to make any payment under these terms and conditions, including liquidated damages as described herein, we reserve the right, at our sole discretion, to notify the creditor and collection agencies of such payment. In the very unlikely event that we lose our internet connection or the items have inappropriate data due to technical faults in the system, such as images incompatible or unavailable, incorrect information, items with prices or certificates, Glorious LLC reserves its sole and absolute discretion and refuses to refund the auction and / or cancel all winning bids. The auction is subject to a buyer's premium, which will be added to the successful bid, applicable local sales tax, and shipping and handling charges upon sale of each lot.
