TERMS & CONDITIONS OF SALE: These Conditions of Sale set out the terms upon which Gilded Curio LLC ("we," "us," or "our") sells property by lot in this catalog. By obtaining a Bidder Number, you acknowledge that you have read and agree to these terms and conditions. 1. PAYMENT: Payment is due upon the receipt of the invoice. The purchase price will be the sum of the hammer price plus the 18% buyer's premium, total in-house shipping cost, and any applicable sales tax. All merchandise purchased is payable directly to Gilded Curio LLC. 2. SHIPPING: (a) For your convenience, we professionally package and ship all items in-house, ensuring a seamless process from purchase to delivery. Your final invoice will include the total in-house shipping cost. You will find the flat-rate shipping fee displayed on each item's page, which provides for premium packing material, labor, insurance, and postage to the lower 48 states in North America (including the District of Columbia). (b) Local pick-up is unavailable for this auction, and we do not release items to third-party shippers. All items have to be shipped directly to your desired location. Gilded Curio LLC will not cancel a sale due to shipping costs. (c) Our standard processing with economy shipping has an estimated timeline of 15-20 business days after receiving payment, excluding holidays. Upon shipment of all or part of your order, you will receive a shipping notification with your tracking number via email. Delivery times are estimated and cannot be guaranteed. Due to unforeseen circumstances, handling times, including item preparation, may take an additional 5-10 days. (d) All items ship to the address specified on your registered LiveAuctioneers account. Please indicate any special shipping instructions immediately after the auction. Address changes are prohibited, and we do not allow any shipment to be re-routed. We do not ship to P.O. Boxes, APO/FPO addresses, or select U.S. Territories and countries. (e) All shipments with a declared value of $500 or greater will require a signature. (f) In the unlikely event the carrier damages your item while in transit, the carrier will require at least ten (10) photos to file a claim. The images must include close-up shots of the area(s) of concern, pictures of the item as a whole, and the packaging (photographed from all sides). As a courtesy, we will work with you and the carrier to provide a satisfactory solution. In no event shall an item be returned to us. 3. DIMENSIONS: All measurements and weights are approximate. 4. CONDITION: Gilded Curio LLC attempts to describe each item accurately and call out any flaws that may affect its value. We do not report common nicks and scratches. The absence of a condition note in the lot description does not mean the item is perfect. In all cases, the final determination is the buyer's responsibility. We are not professional conservators or restorers and, therefore, cannot guarantee the contents of a condition report. Any reference to a specific period or culture is only the opinion of Gilded Curio LLC and is not a guarantee of authenticity. 5. ESTIMATES: Each lot in the catalog features a low and high estimate representing that range, which is a conservative auction evaluation in the opinion of Gilded Curio LLC. Actual prices realized for items can fall below or above this range. Reserve prices are always the confidential information of Gilded Curio LLC and are not disclosed to bidders unless expressly stated as such during bidding. In placing any bid, the bidder understands and agrees that the bid, once accepted by Gilded Curio LLC, will be the winning bid if there is no higher bid by another bidder and if the bid exceeds any reserve or reduced reserve on the lot. All bids are binding, irrevocable, and non-cancelable by the bidder. 6. ALL SALES ARE FINAL: Gilded Curio LLC does not offer refunds or returns. All lots are sold "AS IS" without recourse, and all sales are final. In no event shall an item be returned to us. We do not make any warranties or representations of any kind or nature concerning the property. In no event shall we be responsible for the correctness of the description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property. Bidding on any item indicates your acceptance of these terms. We do not accept cancellations. As a condition of registration and bidding, all bidders are required to agree that they will not initiate a chargeback and that they are waiving any chargeback rights that may exist under the agreement between the bidder and the bidder's credit card company. If a chargeback is initiated, the buyer remains liable for the purchase price (including any buyer's premium), plus costs of collection and attorneys' fees. 7. WITHDRAWAL: Gilded Curio LLC reserves the right to withdraw any lot at any time before the commencement of this auction for such lot and shall have no liability whatsoever for such withdrawal. 8. REGISTERING TO BID: At our discretion, Gilded Curio LLC reserves the right to refuse participation in any auction, reject any bid, and refuse to acknowledge any bidder. The highest bidder acknowledged by Gilded Curio LLC will be the purchaser. The first bid received has precedence if we receive identical absentee bids for an item. Should a dispute arise after the auction, our sale record is conclusive. We will also have complete discretion to reopen the bidding, cancel the sale, or re-offer and resell the property. 9. BIDDING: Gilded Curio LLC will appoint an individual auctioneer to administer a live auction. The auctioneer may accept bids from (a) written bids left with us by bidders before the auction, (b) telephone bidders, and (c) Internet bidders, including bidders through third-party bidding sites. Bidding generally starts below the low estimate and increases in steps, called bid increments. The auctioneer will decide where the bidding should start. Bid increments may vary from auction to auction. 10. ENFORCING THIS AGREEMENT: If the purchaser breaches any of its obligations under these terms, including its obligation to pay the total purchase price of all items for which it was the highest successful bidder, Gilded Curio LLC may exercise all of its rights and remedies under the law, including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach, and (b) offering at public auction, without reserve, any lot or item for which the purchaser has breached any of its obligations, including its obligation to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale. 11. GENERAL: We reserve the right to amend our terms and conditions without notice. If we lose our internet connection, Gilded Curio LLC reserves the right to cancel or reschedule the remainder of the auction. Last Updated November 4, 2023
