All lots will be bid on and sold in accordance with these Conditions of Sale, as well as the Glossary and published advertisements. Whether bidding in the auction or buying in the Gallery, buyers are bound by these Conditions and the Glossary, which are referred to in the advertisements or notices published, which together form the contract of sale between the successful bidder (buyer), (auctioneer) and the consignor (seller) of the lot or item. Item descriptions or photographs do not constitute warranties and each item is sold ?as is? in accordance with the Conditions of Sale and Glossary. Condition of lots: All items are sold ?as is? ?where is?. All sales are final. Condition reports from auction catalogs or galleries are not guaranteed and their accuracy may vary. It is the responsibility of prospective bidders or buyers to inspect the property. All condition reports, measurements, opinions and values provided by FactionArtProjects are not guaranteed. Neither the auction house, gallery and consignor are responsible for the accuracy of printed or verbal descriptions or their authenticity. All items will be available for online inspection prior to sale. It is the sole responsibility of the buyer to carefully inspect and determine condition, age, value and any other relevant information. All weights and measurements are approximate. Artist names and signatures are not guaranteed unless the lot is accompanied by a certificate of authenticity. Provenance will be provided when available, but is not guaranteed. Any statement regarding condition is offered as a courtesy to the customer; it is an opinion only and should not be treated as a statement of fact. Factionartprojects.com is not responsible for errors or omissions. The absence of a condition statement does not imply that the lot is in perfect condition or completely free of wear, imperfections or effects of time. Artwork frames are not included as part of the purchase unless otherwise stated in the description. In the event of non-payment by the buyer, we may require payment of non-payment charges: 25% of the final price. Buyers are not obliged to accept our packing/shipping service and may make other arrangements if they wish. In the case of auction sale, all bids are subject to a non-refundable buyer?s premium of 22% to be added to the winning bid placed at the time of sale for each lot and any applicable local sales tax and shipping charges. Any buyer or bidder representing another buyer is personally and individually responsible for any obligations set forth in these terms and conditions. The buyer?s credit card will be charged within 4 days of the after the invoice is sent. In case of non-payment, we reserve the right to send to the collection agency, in which case the bidder will be responsible for all legal fees, additional collection fees and collection agency fees. The contracted agency will actively work to collect all such funds. This may affect your credit rating. Shipping: Factionartprojects.com offers IN-HOUSE shipping service. All items must be packaged, shipped at the buyer?s risk. In the event you require insured shipping, please inquire. Invoices will be adjusted with shipping charges if buyer chooses in-house shipping. Shipping returns After 30 calendar days from the date of the auction without the buyer having made the payment, Factionartprojects.com will consider the sale as concluded without prejudice to any legal action that may be taken in such circumstances. 30 days from the receipt of the piece by the buyer, claims on the lots will not be accepted in any case, and if there are any in time, the shipping costs or subsequent return will be charged to the buyer. Remember that if you are the winning buyer of the lot, the final invoice will indicate the amount bid plus the Factionartprojects.com commission with the corresponding taxes on the commission and shipping costs. The only commission that Factionartprojects.com applies to the sale of any lot is 22%+Taxes.
