Auction Pickup will be held on Tuesday 11/12/24 to Sunday 11/17/24 from 10am to 4pm by appointment only. Please email us at info@townauctionhouse.com to schedule a pickup appointment. All bidders registering to bid via Live Auctioneers must provide a valid Visa, MasterCard or Discover card and a current email address. We may ask you to validate a credit with us as well. Bidders anticipating placing bids of $10,000 or more must speak with a rep from Town Auction House & Gallery for approval to bid. WARRANTIES AND GUARANTEES: a. All property is sold AS IS, where is and without recourse, and neither the consignor(s) nor Town Auction House makes any representations or warranties, expressed or implied, with respect to size, count, weight, style, authenticity, period material, or manufacturer copyright or reproduction right or any other warranty except as specified below on any lot sold. b. All measurements and weights are approximate. c. Town Auction House is not responsible for typographical errors. d. Bidders are strongly encouraged to ask for any questions prior to bidding. Unless noted on the listing, all items are previously owned (NOT NEW). e. Bidders must expect signs of wear consistent with age and use. All images will try and reflect the most accurate color possible. Keep in mind there is no photography equipment and/or software that can match EXACT color. If you have questions about the color of an item, please contact Town Auction House directly. f. The catalog details are meant as a descriptive guide only. Buyers are encouraged to use the preview to examine merchandise. Descriptions are based on the opinion of Town Auction House. All images are deemed part of the description. g. There are NO RETURNS, CREDITS, OR EXCHANGES. Everything is sold AS IS. h. Town Auction House will not guarantee the authenticity of any signature unless so stated at the time of auction and will only guarantee the medium in which the particular work is executed. i. In the event Town Auction House guarantees authenticity (stated at the time of auction); the Buyer must notify Town Auction House within seven (7) calendar days of receiving any information which causes the buyer to question the authorship, and such notice shall be given no later than thirty (30) calendar days from date lot was delivered to buyer/authorized representative. 2. BIDDING: a. Town Auction House reserves the right to withdraw, combine, or divide any lot at its sole discretion prior to the commencement of bidding. b. The purchase price payable by the buyer shall be the sum of the final bid ("hammer price") plus a buyer's premium of 25% and any applicable sales tax. c. A percentage of lots may have a reserve price, which is the confidential minimum price below which such lot will not to be sold. No reserve will exceed the low estimate of the lot. Reserves are agreed upon between consignor(s) and Town Auction House. d. The Auctioneer may execute bids on behalf of absentee bidders and on behalf of consignor(s) up to a reserve price. e. Town Auction House reserves the right to reject any bid, as well as the right to refuse to acknowledge any bidder. The highest bidder acknowledged by the Auctioneer will be the purchaser. In the event of a dispute between bidders, the Auctioneer has the final discretion to determine the successful bidder or to reoffer the lot in dispute. If any dispute arises after the sale, Town Auction's sale record shall be conclusive. 3. PAYMENTS: a. Payment types accepted: Cash, Money Orders, Certified Bank Checks, Zelle, Venmo, Wise, Mastercard, Visa, American Express, Discover, Wire Transfer, International Wire Transfer, or ACH. b. We do not accept personal checks,Paypal, or international credit cards. c. Invoices in the amount of $10,000 and over must be guaranteed funds such as wire transfer/ACH. International wire transfers are subject to a bank service fee of $50.00. d. Precious metals and luxury items must be paid for with guaranteed funds when exceeding $10,000. e. Guaranteed funds are considered wire transfers, ACH transfers, bank check, and cash. f. Bidders give Town Auction House & Gallery permission to charge the credit card supplied at the time of registration if payment is not made within the auction's specific payment time frame. All bidders will have a dispute placed on their account and will be blocked from bidding with us if payment is not made within the designated payment period. The dispute will be resolved only once the payment is received. The credit card supplied at the time of registration may be charged if payment is not made within the auction's specific payment time frame. g. The Payment Time Frame is 3 Days after Auction closing. h. All LiveAuctioneers bidders will receive an invoice through LiveAuctioneers with the option of using Livepayments which will carry a processing fee of 3.75%. The credit card limit is $10,000; anything above that amount will require an ACH through LivePayments with a processing fee of 1%. Town Auction House reserves the right to hold purchases until the buyer's check clears our bank. Returned checks are subject to a $50.00 service charge. 4. ITEM PICKUP: a. The item's pickup location and address are on the invoice sent by Town Auction House. b. The winning bidder or their shipping agent must bring all necessary packing material and help to move larger items. c. Town Auction House is not responsible for moving or loading items into vehicles due to insurance liability. d. Damage that occurs during shipping by a confirmed, third-party shipper is the responsibility of the shipper. e. All invoices must have a signature from the bidder or shipper before leaving our facility, which confirms the condition as stated in the catalog. f. Items will not be released without confirmation of a shippers name and arrival date. All confirmation must be in writing through email and on file by the end of the advertised pick-up window. g. Items left after the pickup window will be charged a fee of $50 plus $10/day storage fee per item. Pickup times are clearly detailed in each sale so please expect to pay fees if you are unable to have a shipper collect items by the deadline. There will be no exception to this. h. Items remaining 30 days post-auction will be considered abandoned and forfeited without a refund and become the property of Town Auction House. 5. SHIPPING: a. A sale cannot be voided due to unforeseen shipping costs. b. Shipping and insurance are the responsibility of the bidder. c. Town Auction House does not offer shipping services. d. LiveShipping is an option on checkout. Any questions pertaining to using that service must be directed to LiveShipping. e. Bidders must be aware of the shipping costs before bidding on an item. f. All gold, silver, and luxury items will be held up to 14 days after payment is received and cleared before items can ship or be picked up by a confirmed shipper. Have questions? If you have not contacted Town Auction House and Gallery to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
