AMERIGEM LAB AND APPRAISAL SERVICES LLC., TERMS & CONDTIONS OF SALE Effective for sales starting October 1, 2024 These Conditions of Sale (as defined below) constitute the entire terms & conditions on which property listed in the auction catalog shall be offered for sale and sold by Amerigem Lab and Appraisal Services, LLC. By registering to bid and/or by bidding on any items offered in the auction, you agree to be bound by the Conditions of Sale. The terms “Amerigem Lab and Appraisal Services, LLC,?? “we, us??, and “our?? refer to Amerigem Lab and Appraisal Services, LLC., a company located in Avon, CT. The terms “you?? and “your?? refer to the auction bidder or buyer of each lot listed at auction. 1. As used herein, the term “hammer price?? refers to the ending and final closing price that a bidder or buyer has submitted and successfully won in our completed online auction. A COMMISSION is retained by us and payable by the buyer and shall be calculated based on the final closing price and the COMMISSION percentage listed herein. Amerigem Lab and Appraisal Services, LLC., will charge 25% COMMISSION on all final closing prices. If buyer successfully bids on several of the lots offered by Amerigem Lab and Appraisal Services, LLC., each lots final closing price would be charged a COMMISSION of 25% unless an agreement is made with Amerigem Lab and Appraisal Services, LLC., in advance. The terms “purchase price?? refers to the “hammer price?? and COMMISSION charge to buyer. Buyers may be subject to any state, county, and local sales tax or duties which Amerigem Lab and Appraisal Services, LLC., by law, may be required to collect and remit sales tax to the appropriate state. This tax is calculated according to each state, counties, or local governments registered tax law and is in addition to the “purchase price??. If buyer is tax exempt by law, buyer would need to show official documented proof to Amerigem Lab and Appraisal Services, LLC. The forms must be from appropriate government agencies who originated the official document, including official seals when provided. 2. Each prospective buyer must complete a bidder registration through Liveauctioneers site before they are allowed to submit a bid. You must be 18 years old or over to bid in our auction. We reserve the right to request further information, including regarding the source of funds, to complete bidder identification and registration procedures, including completing any anti-laundering and anti-terrorism policies required by law. If we feel that the bidder identification and registration policies are not satisfied, we may in our sole discretion decline to register any bidder or reject any bid or cancel any bid on any sale from bidder. 3. Unless otherwise agreed upon in advance, payment is due and payable within three (3) business days following the auction sale. We reserve the right to refuse to accept payment from a source other than the registered bidder or buyer of record. Once an invoice is issued, we cannot change the buyer’s name on an invoice. Accounts must be settled in full before property is released. Amerigem Lab and Appraisal Services, LLC., uses Autopay by Liveauctioneers for payment processing. If after three business days full payment is not made, we will charge the credit card that you used to register for auction from the amount of invoice. 4. All property sold at auction is sold “AS IS?? and any statements contained in the catalog regarding description of item, weights, measurements, gradings, provenance, culture, source, period, origin, size, quality, rarity, condition of the item, ARE QUALIFIED STATEMENTS OF OPINION AND NOT REPRESENTATIONS, WARRANTIES, OR ASSUMPTION OF LIABILITY. Amerigem Lab and Appraisal Services, LLC., shall not be held responsible for any error or omission in the catalog description of any property. No employee or agent of Amerigem Lab and Appraisal Services, LLC., is authorized to make on behalf of company any representation or warranty, oral or written representation to respect to any property at auction. WE RESERVE THE RIGHT TO WITHDRAW ANY PROPERTY BEFORE, DURING, AND AFTER THE AUCTION DUE TO CONCERNS OF AUTHENTICATION OR LACK OF AVAILABILITY OF PROPERTY. 5. Amerigem Lab and Appraisal Services, LLC., catalogs include low and high value estimates for each lot, exclusive to the buyer’s premium and tax. The estimates are provided as an approximate guide to current market value based primarily on previous auction results for comparable pieces and should not be interpreted as a representation or prediction of actual selling prices. Since auction prices can change the low and high value estimates are subject to revision if needed. Please contact our support team if you have any questions. 6. Unless otherwise indicated prior to auction, all lots in the catalog are subject to a RESERVE. The reserve is the minimum auction price that the seller is willing to accept for the lot. This amount is confidential and does not exceed the low estimate value. 7. Winning bidders are responsible for shipping. Amerigem Lab and Appraisal Services, LLC., uses Liveauctioneers shipping platform. During pre-bidding, buyers will have the opportunity to receive an estimate for shipping. Please note: THIS WILL BE AN ESTIMATE ONLY. Final shipping quotes are based on several criteria’s: Box dimensions, closing price, zip code or shipping address, package insurance. Upon completion of the auction, Amerigem Lab and Appraisal Services, LLC., will email an invoice to buyer including all shipping charges. Once paid, buyer will receive a tracking number for shipment. Package will be shipped to the address you provided when completing your bidder registration information. Every package will be required to have insurance as well as signature of receipt of package. WE WILL NOT BE HELD RESPONSIBLE FOR ANY LOSSES IF THE TRACKING INFORMATION SHOWS THE PACKAGE WAS SIGNED FOR AND DELIVERED TO THE CORRECT ADDRESS THAT YOU ASSIGNED FOR SHIPMENT. IF AN ITEM IS LOST IN TRANSIT, WE RESERVE THE RIGHT TO RESHIP A SIMILAR REPLACEMENT ITEM OR, PROVIDE A REFUND. 8. If we are prevented by fire, theft, or any other reason whatsoever from delivering any property to the buyer or a sale otherwise cannot be completed, our liability shall be limited to the sum actually paid by the buyer and shall in no event include any compensatory, incidental or consequential damages. 9. As auction bids progress, the increments as to how much the bids will increase are listed below. The bid increments are also listed with every lot in the auction.
