Sales Tax Online purchases from Twila True Fine Jewelry may be subject to sales tax. If you are tax-exempt, you can submit your tax-exempt certificate to prevent the collection of tax. Terms 1.All bidders and buyers shall present satisfying documentation prior to the approval of this auction. 2.This auction contains items with 'reserve' pricing, as indicated in each item description. An item containing a 'reserve' means that there is a minimum price that the bidding must reach to sell. 3.All property is sold 'as is' and neither Twila True Fine Jewelry nor the listing agent makes any warranties or representation or any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, or description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice, or in the catalog, or elsewhere shall be deemed such a warranty of representation or an assumption of liability. Prospective buyers are urged to inspect those lots in which they have an interest. 4.Item Descriptions and Authenticity. We strive to provide accurate descriptions and photographs of the items; however, all descriptions, images, and condition reports are provided as a courtesy and should not be considered guarantees of authenticity, condition, or value. It is the buyer?s responsibility to request additional information before bidding. Once a bid is placed, the bidder acknowledges and accepts the item as is, with no warranties expressed or implied. 5. Shipping and Delivery. Buyer pays all applicable shipping costs, taxes, and fees as outlined in the auction description. Shipping insurance is highly recommended and may be available for purchase upon request. Twila True Fine Jewelry is not responsible for any loss or damage once the item has been transferred to the carrier. If an item is returned due to an incorrect address, the buyer is responsible for reshipping costs and any associated fees. True Fine Jewelry does not offer shipping to destinations outside of the United States. 6.Except as provided in item 2 above, the highest bidder above the reserve price as determined by Twila True Fine Jewelry shall be the purchaser. In the case of a disputed bid, the auctioneer will make reasonable efforts to review bidding records and determine the rightful purchaser. If a resolution cannot be reached, the auctioneer reserves the right to withdraw or reoffer the item for sale. Any disputes regarding bidding must be submitted in writing within 24 hours of the auction?s conclusion. 7.All merchandise purchased is payable directly to Twila True Fine Jewelry and must be paid for upon receipt of the invoice. Invoices are sent the day after the auction. Wire transfers, payable in USD are required for items above $5,000. Invoices must be paid in full. Twila True Fine Jewelry reserves the right to hold merchandise purchased until the funds have cleared. 9.If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, Twila True Fine Jewelry may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach, and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has breached any of its obligations, including its obligation to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale. 10.TWILA TRUE FINE JEWELRY WILL NOT CANCEL SALE DUE TO SHIPPING. Should items be returned to the Twila True Fine Jewelry listing agent due to incorrect address provided at checkout or shipping errors, the buyer will be obligated to make a 2nd payment for shipping, and will be liable for other fees and taxes that were associated with the lot(s) being directed back. Should the buyer not honor the obligation, they will violate the terms of the sale. Should the buyer want to be released from the sale after the initial payment, it is at Twila True Fine Jewelry's discretion to honor that request. However, the buyer?s premium, shipping cost and excess fees would be withheld from the refund as services rendered. 11.Twila True Fine Jewelry shall not be responsible for obtaining any permits or licenses on behalf of purchaser and no sale shall be cancelled or refunded for purchaser's noncompliance with permitting and licensing issues. 12.A buyer?s premium equal to 3% of the final bid price will be applied to each lot sold, to be paid by the buyer as part of the purchase price. 13.All sales are final and no refunds will be granted. No exchanges or returns will be accepted under any circumstances. 14.Any disputes arising from this auction shall be governed by and interpreted under the laws of the State of California. The buyer agrees that any disputes or claims shall be resolved through binding arbitration in Los Angeles County, California, and waives any right to bring a lawsuit in a different jurisdiction. Any claims must be filed within 15 days from the date of the auction, or they will be considered waived. 15.Bidding on any item indicates your acceptance of these terms and all other terms printed within, posted, and announced at the time of sale. 16.Twila True Fine Jewelry shall not be liable for delays, cancellations, or failure to perform due to unforeseen circumstances, including but not limited to natural disasters, cyberattacks, government restrictions, labor strikes, internet failures, or any event beyond its reasonable control. In such cases, Twila True Fine Jewelry reserves the right to cancel or postpone the auction without liability.
