Welcome to FOC Books auctions on LiveAuctioneers. By participating in our auctions, you agree to the following Terms & Conditions. Please read them carefully. 1. General Provisions Binding Agreement: Bidding in our auctions constitutes acceptance of these Terms & Conditions, forming a legally binding contract between the bidder and FOC Books. Auctioneer's Discretion: FOC Books reserves the right to withdraw, postpone, or cancel any lot or auction, reject any bid, or refuse participation at our sole discretion without prior notice. 2. Item Condition and Descriptions As-Is Sales: All items are sold "as is, where is," with no returns or refunds. The images provided in the auction listing serve as the official condition report. Condition Disclosure: We strive to accurately describe each item, disclosing significant defects or damage in the listing or through photographs. Minor wear, imperfections, or odors typical of pre-owned or vintage collectibles (e.g., slight fading, mustiness) may not be explicitly noted but should be expected. Image Accuracy: Please review all images carefully, as they depict the item's condition at the time of sale. Note that slight color variations may occur due to screen settings or lighting, which do not constitute a defect. Collector-Focused Approach: As collectors ourselves, we aim to present items with the transparency and detail we?d expect when bidding, ensuring you can make informed decisions. Grading: For CGC, CBCS, or other graded items, grading is performed by a third party. FOC Books is not responsible for grading disputes or errors in third-party labels. 3. Bidding Process Registration: Bidders must register on LiveAuctioneers and provide accurate information. FOC Books may require verification before approving accounts. Bid Increments: Bids must adhere to LiveAuctioneers? minimum increment schedule. FOC Books reserves the right to advance bids on behalf of absentee or reserve bidders. Reserve Prices: Some lots may have reserve prices. If the reserve is not met, the lot may remain unsold. Winning Bids: The highest bidder acknowledged by the auctioneer wins the lot, subject to any reserve or auctioneer approval. In case of a tie, the auctioneer's decision is final. Disputes: In disputes between bidders, the auctioneer may re-open bidding or award the lot at their discretion. 4. Bidder Obligations and Auction Rights Legally Binding Contract: By placing a bid, you enter a legally binding agreement to purchase the item(s) if you are the winning bidder. Payment is due within 48 hours of auction close, unless otherwise arranged with FOC Books. FOC Books? Rights: We reserve the right to cancel or replace an order after the auction if: The item fails to meet our quality control standards prior to shipping. The item becomes unavailable (e.g., lost or damaged before shipment). The item was listed or sold in error by our auctioneer. In such cases, FOC Books will notify the buyer promptly and issue a full refund or offer a comparable replacement, if available. 5. Buyer's Premium A buyer's premium, as specified in the auction listing, will be added to the hammer price and is payable by the buyer. The premium is non-refundable. 6. Storage and Pickup Policy Pickup/Shipping Deadline: All items must be picked up or have shipping arranged within 14 days of the auction's close. Storage Fees: Items not retrieved or shipped within this period will incur a storage fee of $25 per day, per item, starting on the 15th day. Abandoned Property: Items unclaimed after 30 days may be considered abandoned and subject to resale or disposal at FOC Books? discretion, with no refund or compensation to the buyer. 7. Title and Risk of Loss Title Transfer: Title passes to the buyer upon full payment and FOC Books? confirmation of the sale. Risk of Loss: Risk of loss or damage transfers to the buyer upon full payment, regardless of possession. 8. Authenticity and Provenance No Guarantee: While FOC Books strives to ensure authenticity, no guarantees are made regarding provenance, attribution, or authenticity unless explicitly stated. 9. Legal Compliance Governing Law: These Terms & Conditions are governed by the laws of the state where FOC Books is headquartered, without regard to conflict of law principles. Export/Import Restrictions: Bidders are responsible for complying with all applicable export and import laws. FOC Books is not liable for delays or restrictions. 10. Liability Limitation of Liability: FOC Books, its agents, and LiveAuctioneers are not liable for errors in lot descriptions, technical issues, or losses arising from auction participation, except as required by law. Force Majeure: FOC Books is not liable for delays or failures due to events beyond our control, including natural disasters, technical failures, or government actions. 11. Dispute Resolution Mediation: Disputes arising from these Terms & Conditions or auction participation shall be resolved through mediation before pursuing legal action. Jurisdiction: Any legal action shall be filed in the courts of the state where FOC Books is headquartered. 12. Amendments FOC Books reserves the right to amend these Terms & Conditions at any time.
