Chargebacks and Fraudulent Claims 1. In the event a customer initiates a chargeback or payment dispute without valid grounds, and the marketplace incurs financial loss as a result, the customer shall remain liable for the full amount owed, including any associated fees or penalties. If the customer is located outside the marketplace?s country of operation and initiates a chargeback that is deemed fraudulent or unjustified, we reserve the right to appoint an international debt recovery agency operating in the customer?s jurisdiction to recover the outstanding balance. Claim damages for any costs or losses resulting from the chargeback, including administrative costs, legal fees, and any other related expenses. Failure to Fulfill Obligations and Compensation 1. Failure to Fulfill Obligations 1.1 If you fail to fulfill your obligations under the sale event terms, including but not limited to failure to make payment, or failure to comply with any other contractual duties, it may result in financial damages to Live Antique Auctions. 1.2 Such failure to comply may cause disruptions to the marketplace and financial loss, including administrative costs, re-listing fees, and potential loss of other sales opportunities. 2. Right to Compensation for Financial Loss 2.1 Live Antique Auctions/or the associated vendor reserve the right to seek compensation for any financial loss incurred as a result of your failure to fulfill your obligations. 2.2 This compensation may include, but is not limited to, the recovery of costs such as unpaid offers, penalties, administrative fees, shipping fees, and other related damages directly resulting from your non-compliance. 3. Enforcement of Payment 3.1 Live Antique Auctions/or the vendor have the right to enforce the payment of any outstanding debts, damages, and penalties owed to us by you through out-of-court methods, such as using a debt collection agency. If the customer is located outside the marketplace?s country of operation, we reserve the right to appoint an international debt recovery agency operating in the customer?s jurisdiction to recover the outstanding balance. 3.2 In the event that out-of-court methods are unsuccessful, we/or the vendor may pursue legal action in court to recover the owed amounts. 3.3 You agree to pay any reasonable costs incurred by us in the process of recovering these debts, including legal fees, court costs, and debt collection charges.
