Payment must be paid in full before property is released. Funds will be due upon closing of the Auction or presentment of invoice. Payment accepted includes: Check, Cash, Visa, and MasterCard. Checks may be held for up to 5 days for the funds to clear before releasing the property. In cases of non-payment, the Auctioneer?s right to void the sale does not relieve the bidder from their obligation to pay both seller's and buyer's premium and any damages incurred from loss of sale.
An 20% Buyer's premium will be in affect and is additional to the hammer or purchase price. All bidders will be subject to a 7% Florida State sales tax; dealers are exempt from this if they have a valid Florida State Resale Certificate on file with E. M. Wallace Auctions prior to bidding.
Sold property must be removed from premises within 14 days otherwise a $5 per day storage fee will be assessed per lot, per day. Packing, shipping and insurance of purchased lots is the responsibility of the buyer. E. M. W. Auctions offers in house packing and shipping services for most items at the buyer's expense. If shipped in house, it may take up to 15 days after payment is received to ship property. Once E. M. Wallace Antiques has received payment, delivery method and shipping instructions, a shipping quote will be sent with the exact cost. For faster processing, buyer can contact a shipping company of their choosing. The buyer will not hold E. M. W. Auctions liable for any damage or loss after merchandise has been released from our possession.
We will not be liable for any tariffs, VAT, GST or other taxes or charges levied by the receiving countries for property shipped internationally. Nor will E. M. W. Auctions be liable for providing insurance; that is the responsibility of the buyer. We will not ship ivory internationally.
The vast majority of property offered at E. M. Wallace Auctions comes directly from estates and private collections, and may show signs of use and age. The absence of condition remarks in the description does not mean the item is in perfect condition; nor is it meant to deceive. We encourage you to contact us with any questions or requests for additional photographs. You may request a condition report prior to bidding. This service is provided for guidance to the buyer and is without legal obligation. All lots are sold "as is".
Lots may be subject to a reserve (the confidential minimum price below which the property will not be sold) and we may implement such a reserve by bidding behalf of the consignor. If the consignor is indebted to or has a monetary guarantee from us, and in certain other circumstances, we may have interest in the offered lots and the proceeds there-from other than our commissions, and may bid through a representative or agent to protect such interest. We are entitled to our standard commission rate where a lot is "bought-in" to protect our interest. The owner, consignor or agent thereof has reserved the right to bid.
