**AUCTION TERMS AND CONDITIONS** 1. **Auction Presented by Animation Gallery**: This auction is conducted under the terms and conditions outlined here and in compliance with applicable state and local laws. Any announcements made on the day of the auction, whether orally or in writing, will override the information in the printed catalogue. 2. **Buyer's Premium**: All successful bids are subject to an additional Buyer's Premium, which will be added to the final bid amount. 3. **Binding Agreement**: By participating in or registering for the auction, all bidders and buyers agree to be bound by and accept these Terms and Conditions. 4. **Bidder Qualification**: To participate, all bidders must meet the qualifications set by the auctioneer. The auctioneer reserves the right to disqualify any bidder who is not in good standing with the auction house, and such disqualification can occur at the auctioneer?s discretion before, during, or after the auction. 5. **Exclusion Rights**: The auctioneer has the right to exclude any individual or entity from bidding or attending the auction, at their discretion. 6. **Payment Guarantee**: The person placing a bid is personally responsible for ensuring full payment for any successful bid. 7. **Credit Requirements**: Bidders must establish their creditworthiness with the auctioneer before bidding. If a bidder is not already known to the auctioneer, they must submit satisfactory credit information at least five business days before the auction. This information includes credit references, a social security number, and relevant credit card details. The auctioneer reserves the right to conduct a credit check on any prospective bidder. Payments via check must meet certain criteria, and deposits for bidding may be required up to 10 business days prior to the auction, depending on the type of check. Internet bidders must pre-register at least one business day in advance. 8. **Mail or Fax Bids**: Bids submitted by mail or fax must be signed. 9. **Bidding Increments**: The bidding increments will follow a structured format as outlined in the auction terms. If a bid does not meet the increment requirement, it will be adjusted to the highest acceptable bid level. ?Half-increment? bids are allowed, but only once per lot. 10. **Identical Bids**: In the event of identical bids, preference will be given to the bid that is received first. 11. **Auctioneer?s Role in Bid Execution**: The auctioneer is not responsible for errors in bid submissions. It is the responsibility of the bidder to verify their bids before submission. Bids submitted by mail, fax, or other methods after the auction begins may not be executed. 12. **Technology Failures**: In case of a technological failure, such as an internet outage, the auctioneer may extend bidding times for affected lots. 13. **Lot Delivery**: Successful bidders will not receive items on the day of the auction. 14. **Transfer of Title**: Ownership of a lot only transfers once full payment, including applicable taxes, buyer?s premiums, and shipping fees, is received. 15. **Bidding Increments**: A detailed range of bidding increments is outlined based on the price of the item. 16. **Auctioneer's Submission of Items**: The auctioneer or its affiliates may submit items to the auction. 17. **Concessions to Consignors and Bidders**: The auctioneer may, at its discretion, offer financial support, such as loans or guarantees, to consignors. 18. **Minimum Bids**: The auctioneer may set minimum bids, and any bids below these thresholds may not be accepted. Very low opening bids may also be rejected. 19. **Winning Bidder**: The highest qualifying bid recognized by the auctioneer is considered the winning bid. In the event of a tie, the bid received first will prevail. 20. **Good Faith Bidding**: All bids must be made in good faith. Bidding by individuals with questionable credit or non-compliance with auction terms will be rejected. 21. **Lot Sales Order**: Lots will be sold in numerical order unless otherwise specified. The auctioneer reserves the right to withdraw any lot before the auction ends. 22. **Sale Rescission**: The auctioneer reserves the right to cancel a sale due to non-payment, disputes, or clerical errors. 23. **Post-Auction Sales**: Some lots may be sold after the auction. The terms outlined here still apply to those sales. 24. **Payment Terms**: All payments must be made in U.S. Dollars. Payment is due immediately after the auction ends, and if full payment is not made within 7 calendar days, the auctioneer may void the sale. Sales tax will be collected unless the buyer provides a valid tax-exempt certificate. 25. **Payment Charges**: In addition to the auction price, the buyer will be responsible for the Buyer's Premium. Payment is due within 7 days after the auction ends, and failure to pay may result in voiding of the sale. 26. **Shipping and Insurance**: Shipping and Insurance is covered in your buyer's premium as long as you select Buyer Arranged Shipping at checkout. 27. **Interest and Attorney's Fees**: Unpaid invoices will accrue interest. The buyer agrees to cover any reasonable legal fees incurred by the auctioneer in pursuing unpaid debts. 28. **Security Interest**: The buyer grants the auctioneer a security interest in the lot to ensure payment is made. 29. **No Warranties**: The auctioneer makes no warranties regarding the descriptions of items in the catalogue or on auction day. Buyers are encouraged to inspect items before bidding. 30. **Disclaimer of Liability**: The auctioneer is not liable for any damages, including consequential or incidental damages, arising from issues with the sale or delivery of items. 31. **Release of Claims**: By participating in the auction, bidders release the auctioneer and its affiliates from any legal claims, even if unknown at the time of the auction. 32. **Arbitration**: All disputes will be resolved through arbitration in Los Angeles County, California, and parties agree to split the costs equally. 33. **Prohibited Agreements**: Any private sales or non-sales agreements between bidders and consignors are prohibited, and the auctioneer may charge the buyer a fee for violating this rule. 34. **Compliance with California Law**: The auction is conducted in compliance with applicable California laws, including required bonding and licensing. 35. **Autographed Memorabilia**: As required by law, a certificate of authenticity will be provided for autographed memorabilia. 36. **Rights to Reproduction**: The buyer acquires the physical item, but not the right to reproduce or publicly display the item without prior written consent from Disney or its affiliates.
