These Conditions of Sale represent the entire agreement between A.B. Levy?s (A.B.L?s), the Consignor, and the buyer for all property offered at auction. All property is sold AS IS without any guarantees or warranties regarding description, authenticity, condition, provenance, or value. Buyers are responsible for inspecting items prior to bidding. Authenticity Guarantee: If a lot is proven to be counterfeit within 30 days of the sale (with written notice and notarized expert opinions), A.B.L?s will refund the purchase price. Buyer's Premium: A 25% premium applies to the hammer price up to $1,000,000; 20% on amounts above. Withdrawal Rights: A.B.L?s may withdraw lots at any time and is not liable for errors in absentee or phone bidding. Bidding Discretion: The auctioneer may reject bids, resolve disputes, and reoffer lots at their sole discretion. Sale records are final. Title & Payment: Title passes to the highest bidder upon the auctioneer?s acknowledgment. Payment is due in full on the day of sale. Items must be removed within 3 business days. Late payments accrue 1% monthly interest. Default: In case of non-payment, A.B.L?s may retain payments, resell the property, and hold the buyer liable for losses, fees, and damages. A security interest is retained in the buyer?s property until full payment is made. Reserves: Lots may be subject to a reserve (minimum price), not exceeding the low estimate. A.B.L?s may bid on behalf of the seller up to the reserve. Sales Tax: Buyers must pay applicable sales tax unless a valid resale certificate is provided at payment. Jurisdiction: Florida law governs all transactions. Buyers consent to the jurisdiction of Florida state and federal courts. Shipping: Shipping and handling are at the buyer?s expense and risk. A.B.L?s is not liable for damage, including to frames or glass. Payment Methods: Accepted payments include cash (up to $10,000), personal checks, money orders, cashier?s checks, wire transfers, and in-person credit cards (max $10,000).
