All items are sold "AS IS" and "WITH ALL FAULTS" without any representations or warranties, express or implied, as to authenticity, provenance, origin, age, condition, or value. Buyer agrees that the Auctioneer shall not be liable for any errors, omissions, or misrepresentations in such descriptions. 4. Waiver and Release By placing a bid, Buyer expressly waives and releases any claims against the Auctioneer arising from or related to the authenticity, provenance, or condition of any item purchased through this online auction. Buyer hereby waives any right to seek damages, refunds, or other remedies based on allegations that an item is not authentic or does not match its description. 5. Indemnification Buyer agrees to indemnify, defend, and hold harmless the Auctioneer, its officers, directors, employees, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to any dispute regarding the authenticity, provenance, or condition of any item purchased by Buyer. 6. Governing Law and Jurisdiction This agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law provisions. Any dispute arising out of or relating to this agreement or any transaction conducted through this online auction platform shall be resolved exclusively in the state or federal courts located in New Jersey, and the parties hereby consent to the personal jurisdiction of such courts.
