TERMS & CONDITIONS Your bidding on items in First Strike, Art in Action, and The Russell Live Auction events indicates your acceptance of the terms and conditions set forth in these Bidding Procedures. These terms are subject to amendment before or during the sale. The art and items depicted in this catalogue will be offered for sale on March 19?21, 2026 at The Russell auction events hosted by the C.M. Russell Museum (?Museum"). The Museum is not responsible for postponements of the sale due to conditions beyond its control. Bidders need not be present to participate in The Russell auction events. Absentee, Telephone, and Internet bidding are permitted. A 2026 Absentee/Telephone Bid Form is available in the auction catalogue and on the Museum website. For the First Strike Friday Night auction, this form must be received at the Museum by noon on Friday, March 20, 2026. For The Russell Live Auction, this form must be received by noon on Saturday, March 21, 2026. PURCHASE PRICE & PAYMENT The purchase price shall be the hammer price plus the applicable buyer?s premium. For all lots created by contemporary (living) artists, a 12% buyer?s premium will be added to the hammer price. For all other lots, a 17% buyer?s premium will be added to the hammer price up to and including $1,000,000, and 12% on any amount above $1,000,000. A 3% transaction fee will be applied to credit card purchases made directly through the Museum. Successful bidders shall pay for purchases during or immediately following the auction. All sales are final. There will be no exchanges or refunds. Accepted forms of payment are cash, check, cashier?s check, wire transfer, or credit card (Visa, MasterCard, Discover, American Express). ABSENTEE / TELEPHONE BIDDING Absentee and Telephone bidders must submit completed and signed bid forms including a valid credit card number. By signing the form, the bidder authorizes the Museum to charge the credit card for the total purchase price (including buyer?s premium) unless alternative payment arrangements are completed within three (3) days of sale conclusion. Forms must be completed in full and signed to be accepted. Maximum bid amounts must be stated EXCLUDING the buyer?s premium. If identical bids are received for the same lot, the first bid received shall take precedence. Absentee bids will be executed in competition with absentee, telephone, internet, and live bids, and against applicable reserves. The Museum will make reasonable efforts to contact telephone bidders but assumes no responsibility for missed calls or failure to execute any bids. Unsuccessful bids will not be acknowledged. Sales results will be posted and available within ten (10) days of sale conclusion at cmrussell.org. ONLINE / INTERNET BIDDING Online bidding is available through LiveAuctioneers. Online bidders are subject to all Terms & Conditions and Bidding Procedures set forth herein. Online winning bidders through LiveAuctioneers are subject to an additional 5% fee on the hammer price. This fee will be reflected in the buyer?s premium amount on the invoice. A 3.75% transaction fee applies to all payments processed through LiveAuctioneers and supersedes the standard 3% credit card fee for online purchases. If a bidder intends to pay with a method other than the credit card used for LiveAuctioneers registration, the bidder must contact knichols@cmrussell.org within twenty-four (24) hours of auction close. Otherwise, the credit card on file may be automatically charged within seventy-two (72) hours of invoice issuance. LIVEAUCTIONEERS LIVESHIPPING Certain eligible lots may be enrolled in LiveAuctioneers? LiveShipping program at the sole discretion of the Museum. If LiveShipping is selected by the buyer at checkout: Shipping, packing, handling, and insurance charges are separate from the hammer price, buyer?s premium, and applicable transaction fees. Shipping charges will be calculated and processed through LiveAuctioneers? integrated shipping system. The Museum acts solely as a facilitating agent in transferring the purchased lot to LiveAuctioneers? designated shipping provider. The Museum is not the shipper of record. All packing, shipping, and insurance services are performed by independent third-party providers. The Museum assumes no liability for shipping quotes, carrier selection, insurance coverage, transit times, delivery performance, loss, damage, or acts or omissions of third-party service providers. Title to the property passes upon acknowledgment of the winning bid by the auctioneer. Risk of loss transfers to the buyer at that time and remains with the buyer thereafter, including during storage, packing, handling, and shipment, regardless of whether LiveShipping or Local Pickup is selected. LiveShipping eligibility is determined at the sole discretion of the Museum. Oversized, fragile, framed works, sculpture, high-value works, or otherwise designated lots may be excluded from LiveShipping. LOCAL PICKUP & ALTERNATIVE SHIPPING Lots designated as ?Local Pickup Only", or purchases for which the buyer selects Local Pickup at checkout, are not eligible for LiveShipping services. Buyers selecting Local Pickup must arrange removal within thirty (30) days of auction conclusion. After thirty (30) days, a storage fee of $5 per day may be assessed. If LiveShipping is not selected, the Museum may, as a courtesy, coordinate packing and shipment of purchased items through a third-party carrier (such as UPS) upon the buyer?s request. Shipping charges will be billed directly to the buyer by the carrier. The Museum acts solely as a facilitating agent in coordinating shipment and assumes no liability for packing, transit, carrier performance, insurance coverage, loss, or damage. Buyers may alternatively arrange shipping through a carrier of their choosing at their sole risk and expense. No lot may be removed from Museum premises until payment is received in full. CONDITION & AUTHENTICITY All property is sold AS IS, WHERE IS, WITH ALL FAULTS. The Museum acts solely as agent for the owner of the art pieces. There are no guarantees, warranties, or representations of merchantability, fitness, or of any other kind, express or implied. The Museum assumes no risk, liability, or responsibility for the genuineness, authenticity, or authorship of any offered or purchased item. Catalogue descriptions are for informational purposes only and shall not be deemed affirmations of fact or warranties of any kind. No statement, oral or written, whether made in the catalogue, advertisement, bill of sale, salesroom posting, announcement, or elsewhere, shall be deemed a warranty, representation, or guarantee of authenticity. RESERVES & BIDDING Some lots in this sale carry confidential reserves or minimum selling prices. The reserve will not exceed the low estimate. The Museum may act to protect the reserve by bidding through the auctioneer as agent for the owner. The auctioneer may open bidding below the reserve and may place consecutive bids up to the amount of the reserve. Reserves and estimates are subject to change prior to offering each lot. If the reserve is not met, the lot may be withdrawn. All bids are per lot as numbered in the catalogue unless otherwise announced. Bidding increments and opening bids are determined at the sole discretion of the auctioneer. No bid of less than one-half the low estimate will be accepted from any source. The final winning bid may be less than or more than any printed estimate. In the event of dispute between bidders or doubt as to validity of any bid, the auctioneer shall have final discretion to determine the successful bidder, cancel the sale, or reopen and resell the lot. The Museum?s sale record shall be final and conclusive. TITLE, RISK & DEFAULT Upon acknowledgment of the winning bidder by the auctioneer, title to the property shall pass to the bidder subject to compliance with these Terms & Conditions. The buyer assumes full risk and responsibility for the lot at that time. The Museum reserves the right to impose a late charge of 18% per annum on unpaid balances. Unless exempt by law, buyer is responsible for applicable sales or use taxes. If the buyer fails to comply with these conditions, the Museum may: (a) cancel the sale and retain payments as liquidated damages; or (b) resell the property publicly or privately and hold the buyer liable for any deficiency, costs, commissions, warehousing, reasonable attorney fees, and incidental damages. GOVERNING LAW & LIMITATION OF LIABILITY These conditions of sale shall be governed by and construed in accordance with the laws of the State of Montana. If the Museum is prevented by fire, theft, or any other cause from delivering property, liability shall be limited to the sum actually paid by the buyer. In no event shall the Museum?s liability exceed the purchase price actually paid for the item.
