By registering for, bidding in, or purchasing from any Burns Auction & Appraisal LLC auction through LiveAuctioneers, you agree to be bound by the following Terms & Conditions. Please read these terms carefully before bidding.
All sales are final. All items are sold ?as-is,? ?where-is,? with no guarantees or warranties of any kind unless expressly stated in writing by Burns Auction & Appraisal LLC.
1. Buyer's Premium
A buyer?s premium of 23% will be added to the final hammer price of each lot purchased through LiveAuctioneers unless otherwise stated in the auction listing.
2. Payment Terms
Payment is due promptly upon receipt of your invoice.
Accepted forms of payment may include credit card, cash, ACH, wire transfer, cashier?s check, or money order, subject to the restrictions below.
Credit card payments are limited to $2,500 unless payment is made in person, face to face.
If your invoice total exceeds $2,500 and you are not paying in person, payment must be made by ACH, wire transfer, cashier?s check, or money order.
A 3.5% card processing fee applies to all credit card transactions. Buyers who wish to avoid the card fee may make arrangements to pay by ACH, wire transfer, cashier?s check, money order, or cash in person when applicable.
Burns Auction & Appraisal LLC does not accept personal or business checks.
For vehicles, payment must be made by cash, cashier?s check, ACH, or wire transfer.
Burns Auction & Appraisal LLC may require invoices over $2,500 to be paid by bank transfer/ACH.
3. Autopay
If you have not contacted Burns Auction & Appraisal LLC to arrange payment within 2 days of the invoice being sent, we may charge the credit card used to register for the auction for the amount due, plus the applicable 3.5% card processing fee.
4. Non-Payment
Failure to pay for your invoice may result in forfeiture of your purchases, filing of a non-paying bidder complaint, suspension from future auctions, and/or other collection efforts.
If unpaid items are relisted, Burns Auction & Appraisal LLC may identify the prior winning bidder as a non-paying bidder.
5. Sales Tax
Sales tax will be collected where applicable unless a valid tax exemption is on file with LiveAuctioneers, the bidding platform, or Burns Auction & Appraisal LLC before payment.
If you are tax exempt, please make sure your exemption information is submitted through LiveAuctioneers or emailed to [info@burnsbid.com](mailto:info@burnsbid.com) before paying your invoice.
6. As-Is / No Refunds
All items are sold as-is, where-is, with no refunds, returns, chargebacks, exchanges, or adjustments.
Burns Auction & Appraisal LLC does its best to describe all items accurately and to provide clear photographs. However, we cannot guarantee the age, authenticity, condition, completeness, operation, originality, or fitness for any purpose of any item.
The absence of condition details does not mean an item is free from defects. Bidders are responsible for reviewing all photos, reading descriptions, and asking questions before bidding.
If a part, accessory, component, or item is not shown in the photographs or specifically mentioned in the description, do not assume it is included. If we have it, we will generally photograph it. If it is not visible, assume it is not included.

7. Descriptions, Photos & Condition Reports
Burns Auction & Appraisal LLC sells a large volume of used, antique, vintage, estate, and secondhand items. Many items have age, wear, defects, repairs, missing parts, unknown histories, or other condition issues.
We make reasonable efforts to identify and disclose important condition information when known, but bidders should not rely on the description as a complete condition report.
Photographs are part of the description. Please review all images carefully before bidding.
8. Mechanical, Electrical & Motorized Items
Do not assume any mechanical, electrical, electronic, motorized, battery-operated, or timekeeping item works unless the description specifically states that it has been tested and describes the degree to which it works.
This includes, but is not limited to, watches, clocks, radios, electronics, tools, vehicles, equipment, appliances, toys, machinery, and similar items.
Even if an item is described as working at the time of cataloging, Burns Auction & Appraisal LLC does not guarantee that it will continue to work at pickup, after transport, or after shipping.
9. Authenticity
Burns Auction & Appraisal LLC does not guarantee authenticity, age, attribution, origin, manufacturer, artist, maker, materials, or completeness unless expressly stated in writing.
All bidders are responsible for conducting their own due diligence before bidding.
Sports cards, trading cards, autographs, memorabilia, and similar collectibles are not guaranteed authentic or in any particular condition unless professionally graded or authenticated by a recognized third-party service and specifically described as such.
10. Diamonds, Jewelry & Gemstones
Diamond weights for stones mounted in settings are approximate and are based on measurements. Loose diamonds may be weighed on a diamond scale when possible.
Statements regarding diamond clarity, color, gemstone identity, metal content, or jewelry quality are given to the best of our ability, but Burns Auction & Appraisal LLC is not a certified GIA gemologist.
When GIA or other third-party reports are available, they will be noted in the item description when known.
11. Bidding Platforms & Tie Bids
Burns Auction & Appraisal LLC may list auctions on multiple bidding platforms.
In the event of a tie bid between LiveAuctioneers and another bidding platform, Burns Auction & Appraisal LLC?s in-house bidding records and platform timestamps will determine the successful bidder. Tie bids may be awarded to the bid placed through Burns Auction & Appraisal LLC?s in-house platform, [www.burnsbid.com](http://www.burnsbid.com).
12. Reserve Auctions
All Burns Auction & Appraisal LLC auctions are reserve auctions unless otherwise stated.
Burns Auction & Appraisal LLC, consignors, consignor agents, employees, contractors, friends, or family members may bid in any auction in good faith, provided they are bidding with the intent to pay for purchases, including buyer?s premium, like any other bidder.
For items with a reserve, Burns Auction & Appraisal LLC may bid on behalf of the reserve.
13. Pickup
Buyers are responsible for picking up their purchases during the scheduled pickup time.
Pickup details, including date, time, and location, will be provided in the auction listing, invoice, or pickup instructions.
If you cannot pick up during the scheduled pickup time and request a different pickup day at our Lancaster, Ohio facility, a fee of $5 per lot may apply.
All items must be picked up or shipping arrangements must be completed within 14 days of the sale unless other written arrangements are made with Burns Auction & Appraisal LLC.
Items not picked up, shipped, or otherwise arranged for within 14 days may be considered abandoned and forfeited without refund.
14. Loading & Moving
Buyers are responsible for bringing appropriate help, tools, packing materials, boxes, equipment, vehicles, and moving supplies needed to safely remove their purchases.
Please bring enough people to safely move and load your items. If you buy a large quantity or heavy items, bring a crew.
Burns Auction & Appraisal LLC staff may assist when possible to keep pickup moving efficiently, but we are not obligated to provide moving or loading help and may refuse to move extremely large, heavy, bulky, fragile, unsafe, or difficult items.
By bidding, buyers agree that they and any helpers have the experience, equipment, training, and ability needed to safely move, load, and secure their purchases. If not, buyers agree to hire qualified movers.
Buyers agree to hold Burns Auction & Appraisal LLC harmless for injury, death, damage, loss, or property damage occurring during pickup, moving, loading, or transport.
Children are prohibited at Burns Auction pickup locations.
15. Items Left Behind
Buyers are responsible for confirming that all purchased items have been removed before leaving the pickup site.
Any items left behind after pickup hours may be considered abandoned and disposed of at the discretion of Burns Auction & Appraisal LLC without refund.
This applies even if items are left behind because of confusion, oversight, mix-up, misunderstanding, or failure to check the invoice before leaving.
Burns Auction & Appraisal LLC often cleans out sale locations immediately after pickup and may dispose of any remaining items.
16. Contents of Furniture & Container Lots
Contents of furniture, cabinets, drawers, boxes, containers, shelves, or similar lots are not included unless explicitly stated in the lot description.
17. Partial Removal of Lots
Buyers do not have to take every item in a lot if they do not want everything. However, dumping, abandoning, or illegally disposing of unwanted items on, near, or around the auction property is strictly prohibited.
If a buyer dumps or illegally disposes of items on or near the auction property, Burns Auction & Appraisal LLC may charge a $200 disposal fee and may file a police report if necessary.
18. Shipping
Burns Auction & Appraisal LLC provides in-house shipping on many items, but not all items are eligible for in-house shipping.
For LiveAuctioneers purchases, buyers who want Burns Auction & Appraisal LLC to handle shipping in-house should select ?Self Arranged? shipping through LiveAuctioneers. Selecting ?Self Arranged? allows Burns Auction & Appraisal LLC to pack and ship eligible items through our in-house shipping process.
If the buyer does not select ?Self Arranged,? the order may be handled through LiveAuctioneers LiveShipping. LiveShipping can be significantly more expensive and slower than Burns Auction & Appraisal LLC?s in-house shipping.
Each lot description should indicate whether the item can be shipped in-house, must be picked up, or must be handled by a freight partner.
If you are not local and do not pick up, we will generally assume you are requesting shipping if shipping is available for your items.

19. In-House Shipping Process
Burns Auction & Appraisal LLC uses Shipping Saint to manage in-house shipping.
If your items are being shipped in-house, you may receive updates by email and/or text when your purchase is moved to the shipping department, when your order is packed, when your shipping invoice is ready, and when tracking is available.
Shipping Saint may also ask you to confirm your shipping address before shipment.
Once your shipping invoice is paid, your package will be shipped and tracking information will be provided.
20. Shipping Charges
Shipping is handled as a separate service. Burns Auction & Appraisal LLC charges for boxes, packing labor, packing materials, carrier postage/shipping charges, and a 30% overall markup on shipping-related costs.
Large, heavy, fragile, oversized, or complicated orders can be expensive to ship regardless of provider.
Burns Auction & Appraisal LLC packs carefully and aims to provide reliable, streamlined shipping with minimal breakage. However, if our in-house shipping terms are not acceptable, buyers may arrange pickup or another permitted removal method within 14 days of the auction.
21. Outside Shipping Labels
Burns Auction & Appraisal LLC does not accept outside shipping labels.
22. Shipping Insurance
All invoices paid by credit card and requiring shipping may be required to include shipping insurance.
If an item is lost or damaged in transit, Burns Auction & Appraisal LLC may assist the buyer with the insurance claim process through Shipping Saint or the carrier when applicable.
Buyers understand that shipping carriers, insurance providers, and third-party claims processes may determine the outcome of any shipping claim.
23. Freight & Transport Fees
Some items may need to be transported from an estate location to our facility for shipping or to a freight partner. A transport or handling fee may apply.
Small items may have a modest transport fee. Large, heavy, or bulky items may require a larger fee to transport to a freight provider.
24. Shipping Non-Payment
If shipping is invoiced and not paid within 14 days, Burns Auction & Appraisal LLC may file a non-paying bidder complaint and the buyer may forfeit the items without refund.
25. Firearms
Burns Auction & Appraisal LLC is a Federal Firearms Licensee.
Firearm purchases are subject to all federal, state, and local laws.
For Ohio residents picking up firearms in person, the purchaser must complete ATF Form 4473 and pass the required background check. The person picking up the firearm must be the person whose name appears on the bidder registration.
If a firearm is shipped, it will be shipped to a valid FFL only.
These restrictions generally apply to firearms dating from 1898 and later. Pre-1898 antique firearms are generally not classified as modern firearms and may be handled differently under applicable law.
26. Vehicles
Vehicle purchases must be paid by cash, cashier?s check, ACH, or wire transfer.
Titles, transfer documents, pickup arrangements, and any applicable taxes or fees are the responsibility of the buyer unless otherwise stated.
27. Buyer Responsibility
By bidding, buyers acknowledge that they have read the item description, reviewed all photographs, understand the pickup and shipping requirements, and accept the Terms & Conditions of the auction.
Do not bid if you are unsure about condition, authenticity, pickup, shipping, payment, shipping cost, pickup requirements, LiveAuctioneers shipping selection, or any other term.

Bank Account (ACH) Requirement
To ensure secure payment, Burns Auction & Appraisal LLC may require invoices over $2,500 may be required to be paid using a Bank Transfer (ACH). This can be done directly at checkout.
Autopay
