AUCTION TERMS & CONDITIONS
SHIPPING & PICK-UP
Orion Antiques LLC does not provide in-house shipping services. Successful bidders will receive a list of trusted third-party shipping vendors following the sale. Please refer to your invoice and post-sale communications for available shipping information.
Buyers are responsible for making their own shipping arrangements and for all costs associated with packing, handling, transportation, insurance, and delivery. Orion Antiques LLC is not responsible or liable for any acts, omissions, delays, damages, losses, or other issues arising from the services provided by third-party shipping vendors, including vendors recommended by Orion Antiques.
All purchases must be paid in full prior to release or pick-up. No exceptions.
Local pick-up is available by appointment, Monday through Friday, from 10:00 a.m. to 5:00 p.m. The buyer or an authorized representative is responsible for arranging collection of all purchased property within 14 calendar days of the auction date.
Items not collected within the applicable pick-up period may be subject to relisting or a storage fee of $2.00 per day. Items remaining unclaimed for more than 60 days may be considered forfeited and may be relisted or otherwise disposed of at the discretion of Orion Antiques LLC.
INTERNATIONAL BUYERS
International buyers are solely responsible for all customs requirements, duties, tariffs, taxes, brokerage fees, and other charges associated with importing purchased property into their country. Buyers are also responsible for ensuring compliance with all applicable laws, regulations, and import requirements.
PHONE BIDDERS & ABSENTEE BIDS
Due to recent fraudulent activity involving telephone bidding, Orion Antiques LLC requires additional verification for all phone and absentee bidders.
Phone bidders must provide a valid credit card number to secure their bids. A valid government-issued identification document, such as a driver's license or passport, must also be provided by email.
Following registration, Orion Antiques will provide the bidder with a Telephone/Absentee Bid Agreement. The bidder must review, sign, and return the agreement before bids can be accepted.
Phone and absentee bids must be paid in full within 14 days of the auction. If payment has not been received within this period, the credit card provided on file may be charged for the outstanding balance in accordance with the signed bidder agreement.
If you are unable to comply with these requirements, you may place an absentee bid directly through LiveAuctioneers, subject to that platform's terms and conditions.
GENERAL TERMS
The auction is conducted in Hollywood, Florida, and all Orion Antiques LLC sales are governed by these Terms and Conditions and any applicable platform-specific terms.
Please carefully review all Terms and Conditions before registering to bid or participating in an auction. By registering to bid, submitting a bidder registration form, placing a bid, or otherwise participating in an auction, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
If you do not understand or agree to these Terms and Conditions, do not register or place bids.

AUTHENTICITY & DESCRIPTION GUARANTEE
All descriptions are guaranteed for a period of thirty (30) days from the date of sale, subject to the terms and limitations stated herein.
If a buyer questions the authenticity of a work of art, the buyer may, at the buyer's sole expense, obtain a written opinion from a recognized and qualified expert in the artist or subject matter.
If the work is determined by such qualified expert to be inauthentic, the work may be returned to Orion Antiques LLC in the same condition in which it was sold, and the purchase price may be refunded in accordance with these Terms and Conditions.
Any refund will be limited to the applicable purchase price and will not include the buyer's premium, online platform fees, transportation, shipping, insurance, appraisal or authentication costs, or any other expenses incurred by the buyer.
It is the buyer's responsibility to complete payment in a timely manner so that the property can be released, examined, and returned, if applicable, within the thirty (30) day period.
ARTIST ATTRIBUTION & AUTHENTICITY
For works that do not have established documented provenance or a verifiable prior auction history, authorship and attribution are described using the following terminology:
Signed [Artist Name]: The work bears a signature that is legible and identifiable as the named artist's signature. No additional attribution is implied unless specifically stated.
By [Artist Name]: The work is represented as being by the named artist.
Attributed to [Artist Name]: The work may be ascribed to the named artist based upon style, characteristics, or other considerations; however, questions regarding actual authorship may remain.
In the Style of [Artist Name]: The work was executed by an unknown artist and was intentionally created to emulate the style of the named artist.
After [Artist Name]: The work was executed by an unknown artist and is a deliberate copy or reproduction of a known work by the named artist.
Works described as ?Attributed to? an artist are offered without proof or warranty of authenticity unless otherwise expressly stated.
All lots are sold ?AS IS, WHERE IS?, with all faults and without warranties or representations, express or implied, except for any limited warranties specifically stated in these Terms and Conditions.
Prospective bidders are strongly encouraged to contact Orion Antiques LLC before bidding regarding any matter that may be important to their purchasing decision, including condition, dimensions, authenticity, provenance, repairs, restorations, alterations, or other characteristics of the property.
Any condition reports provided by Orion Antiques LLC are offered solely as a courtesy to prospective bidders. Condition reports represent the opinions of Orion Antiques LLC and are not guarantees of condition.
BEFORE THE AUCTION
Property may be available for examination prior to the sale. Bidders are strongly encouraged to personally inspect any property in which they have an interest or to have an independent representative inspect the property on their behalf.
While Orion Antiques LLC makes reasonable efforts to accurately describe and photograph each lot, all property is offered ?AS IS, WHERE IS,? with all faults.
It is the bidder's responsibility to determine the condition, authenticity, age, dimensions, provenance, and other characteristics of any property before placing a bid.
No written or oral statement contained in the catalog, advertisement, invoice, gallery posting, auction announcement, condition report, or made by the auctioneer or representatives of Orion Antiques LLC shall be deemed to create a warranty or assumption of liability unless specifically stated in these Terms and Conditions.
The absence of a condition report does not indicate that an item is free from wear, damage, defects, repairs, restoration, or age-related characteristics. Unless otherwise noted, antique and previously owned property may exhibit ordinary signs of age and use, including scratches, nicks, abrasions, discoloration, crazing, wear, or other imperfections.
Auction estimates are provided as an indication of anticipated market value and are intended to help bidders determine the potential purchase price. Estimates do not include the buyer's premium, applicable taxes, or other fees.
By placing a bid, the bidder acknowledges that they have either personally examined the property, elected not to examine it, or engaged an independent representative to examine it on their behalf.
DURING THE AUCTION
Bidding as Principal
Any bidder placing a bid accepts personal responsibility and liability for payment of the purchase price, including the hammer price, buyer's premium, applicable taxes, platform fees, and any other applicable charges, unless otherwise agreed to in writing prior to the auction.
Telephone Bidding
Telephone bidding must be arranged by completing and submitting the applicable Telephone Bid Form by 5:00 p.m. on the day prior to the auction.
Telephone Bid Forms may be obtained by contacting the Orion Antiques office by email or telephone.
All telephone bids must be secured with a valid credit card and are subject to the applicable verification requirements.
Telephone bids will be executed in a fair, competitive, and confidential manner. Orion Antiques LLC will make reasonable efforts to contact the bidder before the lot is offered.
Orion Antiques LLC assumes no liability for failure to reach a telephone bidder, missed calls, communication problems, bidding errors, or other errors or omissions associated with telephone bidding.
WINNING BID
The winning bid is the highest bid acknowledged by the auctioneer.
In the event of a tie, bidding dispute, or other question concerning the successful bidder, the auctioneer shall have sole discretion to determine the successful bidder or to re-offer the lot.
In the event of any dispute following the sale, the records maintained by Orion Antiques LLC shall be considered conclusive.
Title to purchased property passes upon acknowledgment of the winning bidder, subject to these Terms and Conditions. Upon the closing of the lot, the winning bidder assumes full risk and responsibility for the property.
OWNERSHIP & RISK
Ownership of a lot is conveyed to the successful bidder upon the closing of the lot, subject to these Terms and Conditions.
While Orion Antiques LLC makes reasonable efforts to safeguard purchased property, Orion Antiques LLC shall not be responsible for loss, theft, or damage occurring after the lot has closed, except where required by applicable law.
BUYER'S PREMIUM & TAXES
In addition to the hammer price, the buyer agrees to pay Orion Antiques LLC a 25% buyer's premium, applicable Florida sales tax, and shipping or other applicable charges.
Online bidders may also be subject to additional fees assessed by the auction platform through which the bid was placed. These fees are determined by the individual platform and are separate from the buyer's premium charged by Orion Antiques LLC.
The final invoice may include the hammer price, Orion Antiques buyer's premium, applicable online platform fees, Florida sales tax, and shipping or other applicable charges.
LIMITATION OF LIABILITY
Orion Antiques LLC acts as an agent for the consignor unless otherwise expressly stated.
Orion Antiques LLC shall not be responsible for any breach, default, misrepresentation, or other act or omission by a consignor, including representations made by a consignor regarding the property.
To the fullest extent permitted by applicable law, bidders and buyers acknowledge that they are responsible for conducting their own due diligence before bidding and for reviewing all available information regarding the property.
AUTOPAY
This auction may utilize Autopay through LiveAuctioneers.
If you place a winning bid, the payment method associated with your LiveAuctioneers account may be automatically charged following the conclusion of the auction, subject to the applicable LiveAuctioneers terms, payment requirements, and any restrictions associated with the purchase.
SALES TAX
Purchases from Orion Antiques LLC may be subject to applicable sales tax.
Buyers who qualify for tax-exempt status are responsible for providing valid and appropriate tax-exemption documentation before applicable taxes are charged, in accordance with applicable law and platform procedures.
IMPORTANT NOTICE TO BIDDERS
By registering to bid or placing a bid, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Please review all lot descriptions, photographs, condition information, buyer's premiums, taxes, shipping requirements, and applicable platform fees before placing your bid.
All sales are final except as specifically provided for within these Terms and Conditions.
Autopay
This auction uses Autopay by LiveAuctioneers. If you place a winning bid, your card will be charged shortly after the conclusion of the auction.
