1. All catalogue descriptions are believed to be accurate in the matter of authenticity and condition, but ultimately all lots are sold "as is." Antiques, by their very nature, will exhibit wear, minor losses and breaks, and small repairs commensurate with age. 2. All measurements are approximate. Please contact us if you require more exact measurements. 3. All requests for additional information will be accepted until 24 hours prior to the start of the auction. Call 540-836-0258 or email stillie@masonsauction.com. 4. Typically we provide additional condition information, when it is requested by a potential bidder. However, the absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections, repairs, restorations or the effects of aging. We shall have no responsibility for any error or omission regarding an item's condition. 5. Terms: Cash or we will accept your personal or company check accompanied by a current driver's license and a major credit card, if the customer is known by the auctioneer. All other checks must be accompanied by a bank letter. We accept Visa, MasterCard, American Express and Discover credit cards in payment. All purchases must be paid for within 48 hours of the the day of sale. We reserve the right to hold a purchased lot until until a check has cleared. The purchase price for each lot shall equal the hammer price, buyer's premium, sales tax and, where applicable, all packing, handling, insurance and shipping costs. Unless buyer gives special instructions, the shipping method shall be at the sole discretion of Mason Auction Company, Inc. Mason's is not responsible for the acts or omissions of independent handlers, packers, or shippers of purchased items or for any loss, damage or delay from the packing or shipping of any property. Buyer's are required to pay for all packing , shipping and insurance charges. Any overseas duty charges are the responsibility of the successful bidder. Please note that shipping charges can be substantial. We do not ship paintings and the winning bidder(s) are responsible for arranging shipping after paying for their purchases. 6. We have endeavored to catalogue and describe the property correctly and neither the auctioneer nor its consignor will be responsible for the description, authenticity, genuineness, provenance, or condition of the property. No statement contained in the catalogue or made orally, prior to the sale or elsewhere shall be deemed to be such a warranty or representation of an assumption of liability. 7. The auctioneer reserves the right to withdraw any item at any time before the sale. 8. The Auctioneer shall have absolute discretion to determine the successful bidder, in which event his/her determination shall be final, or to re-offer and resale any article in dispute. If any dispute arises after the sale, Auctioneer's sale record shall be conclusive as to who was the purchaser, the amount of the highest bid and, in all other respects. 9. No properties purchased during the auction may be removed prior to the end of the session,until paid for. All purchases must be removed from the premises following the sale, unless prior arrangements have been made. Auctioneer will not be responsible lost or damaged merchandise, held in storage and no refunds will be made if lost or damaged. 10. There is not a buyer's premium for this auction of paintings. This is an internet only auction. 11. International bidders must pay with wire transfer, money order or cashier's check or applicable credit card calculated in USD. 12. Except for internet only auctions, absentee and phone bidding directly with our auction is offered as a courtesy, at no additional cost to the bidder. We enter bids based on lot number only. We are not responsible for for errors or unexecuted absentee or telephone bids. All absentee bids must be in written form. We do not accept verbal absentee bids. Submitted bids that are not commensurate with our standard bid increments will be rounded up to the correct bid increment. 13. International bidders are welcomed. However, all communications must be in fluent English. 14. Make sure you are bidding on the correct lot number. If you accidentally bid on a lot and win, you are still liable for payment as we are liable to the consignor of that lot. 15. Absentee bids are subject to competition from various LIVE bidders, including "On-site", "Floor" or "House" bidders who are present at the auction, Internet bidders who are participating in real time via computer or phone bidders who are bidding in real time via telephone. 14. Except for internet only auctions, all phone bids must be arranged by 7:00 P.M. the day prior to the auction. We may reject request submitted after our deadline. We notify all successful bidders by email, or by phone if no email. 15. Winning bidders are required to contact us to confirm receipt of invoice and to make arrangement for payment and shipping or pick up. Email is preferred. 16. Any returned checks are subject to a $50.00 service charge. 17. Additional conditions of sale may apply, as noted on our website and/or as announced by the auctioneer prior to the auction. These terms and conditions, as well as the respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of Virginia. The purchaser shall be deemed to have consented to the jurisdiction of the state courts, of and the federal courts sitting in, the Commonwealth of Virginia. The buyer is responsible for all liable for all fees/costs associated with the collection of any balances due, including attorney's fees. 18. Bidding on any item, whether in person, by phone, by absentee bid or via a live internet auction indicated the bidder's agreement to be bound by these Terms and Conditions for Bidders. Any right of the bidder under this agreement shall not be assignable.
