CONDITIONS OF SALE
All lots are sold to the highest bidder AS IS WHERE IS. Live on floor bidders will take precedence over online bidders if the amount bid is the same.
All items offered online will have a minimum starting bid as displayed on the online catalogue. Online bids lower than minimum will not be accepted.
Online purchases must be paid in full 7 days from the date of the auction. Legal action will be taken and disputes will be filed with Live Auctioneers for non-paying bidders.
All prospective bidders are advised to inspect each lot they wish to bid on and to satisfy themselves as to the description, authenticity, overall condition of each lot and to bid accordingly.
All lots are sold AS IS WHERE IS, with no guarantees. Catalogue descriptions and auctioneers statements are opinion only, with no warranty implied.
All items are sold as genuine articles with no reproductions or copies knowingly being offered. Descriptions are given to the best of our ability and knowledge regarding condition or vintage.
That being said, each bidder must accept his or her own judgment regarding condition & authenticity of each item. All pieces are sold AS IS WHERE IS, NO RETURNS OR REFUNDS.
Bidders can pay by Check, Bank Wire, Email transfer direct to our account, Bank Draft or Money Order.
Visa & Mastercard accepted up to a limit of $2000.00. Items will only be shipped to the Credit Card billing address, which must be provided with the security code on the credit card.
No Pay Pal or Western Union, no exceptions.
Michael Spooner & Son Auctions Inc. will communicate with all successful online bidders within 48 hours after auction to arrange payment method and shipping details. All sales are final.
Successful Bidders paying via Visa & Mastercard must provide full billing address, security code on the back of the credit card & phone number for bank authorization.
BUYERS PREMIUM:
All items sold online, absentee and via phone are subject to a buyers premium of twenty percent.
Sales Tax:
All items are subject to HST of 13% unless shipped out of Country.
International bidders: Provided items are shipped directly out of Canada from our auction facilities, no taxes are applicable.
SHIPPING:
Buyer Pays Shipping Cost.
As a convenience to BUYERS, Michael Spooner & Son Auctions Inc. will package your items for a fee and transport items to a 3rd party shipper: UPS, Puralator, Fed EX or Canada Post. If you require insurance for damages UPS must do the packaging. All items will be sent with a tracking #, no exceptions.
Michael Spooner & Son Auctions Inc. will not be RESPONSIBLE for loss or damages caused by shipping or packaging.
There will be no returns or refunds.
All Duties, Import Tariffs & Taxes are the responsibility of the Buyer.
Michael Spooner Auctions Inc. will not be responsible for any searches and seizures at International Borders and their functional equivalents.
All Buyers who purchase furniture must make their own SHIPPING ARRANGEMENTS. Storage & local delivery is available for a fee.
If your item(s) are damaged or lost in shipping, you will need to contact the shipper to file a claim. Michael Spooner & Son Auctions Inc. will not be RESPONSIBLE for loss or damages caused by shipping.
There will be no returns or refunds.
Bidding at this auction, whether in person, by agent, absentee bid, telephone, internet or other means, constitutes your acknowledgment and acceptance of these Terms and Conditions.
Ontario law applies and jurisdiction and venue over all disputes involving these Terms and Conditions shall be adjudicated in Ottawa, ON, Canada.

Grading is the subjective description in the opinion of the cataloguer as to the state of preservation, method of strike, and overall appearance of a particular coin. Adjectival descriptions and terminology (which can and does vary among experts and knowledgeable purchasers), when used in the catalogue, are strictly the opinion of the cataloguer. Where Michael Spooner and Son Auctioneers Inc. sells a numismatic item graded and/or encapsulated by a grading service, Buyer acknowledges and agrees that other or knowledgeable purchasers might reach a different conclusion as to the state of preservation. Any such information provided by Michael Spooner and Son Auctioneers Inc. is the opinion of the third party, without recourse against Michael Spooner and Son Auctioneers Inc. in any way whatsoever.
Michael Spooner and Son Auctioneers Inc.acts as an agent only between Consignor and Buyer. Michael Spooner and Son Auctioneers Inc does not represent that any coin catalogued will meet the standards, or the grade, of any third party of third party grading services; that third party graded numismatic items will receive the same grade if resubmitted; that any third party soft flip is secure or that a numismatic item has a particular provenance. Michael Spooner and Son Auctioneers Inc here disclaims all liability for damages, incidental, consequential or otherwise, arising out of or in connection with the sale of any property by Michael Spooner and Son Auctioneers Inc to the purchaser.
