1. Condition of Goods
In publishing this catalog Noel Barrett Antiques & Auctions Ltd. has endeavored to accurately describe all items being sold but all property being offered is to be sold "as is". No statement in this catalog, bill of sale, invoice, or elsewhere by any representative of, or person in the employ of Noel Barrett Antiques & Auctions Ltd. shall be deemed to be a warranty, representation, or assumption of liability with respect to age condition, size, quality, variety, importance, provenance, or historical relevance of any of these items.
1a. Regarding dolls' houses, shops etc. - Many of the houses and shops have older electrical lighting that should be inspected for safety and repaired/replaced as needed.
2. Disputes
The Auctioneer will be the final judge as to who is the successful bidder. In the event of any dispute the Auctioneer shall at his discretion decide to re-open the bidding or not.
3. Title to Goods
Title to all merchandise shall pass to the successful bidder at the fall of the Auctioneer's "hammer". The purchaser shall assume full responsibility for the lot purchased once title has passed.
4. Removal of Goods (attending bidders only)
All property must be removed from the premises by 9:00 PM on the final day of the sale, unless other arrangements have been made in advance.
5. Payment Terms-
Payment is due upon receipt of invoice and must be settled within 30 days max of auction date. Payment terms: cash, check, Visa/Master Card, Travelers Check. All funds must be drawn in USD on U.S.banks. WE DO NOT ACCEPT PAYPAL FOR AUCTION PURCHASES !!!!!!. In any event, Noel Barrett Antiques & Auctions Ltd. reserves the right to hold all merchandise paid for by check until such check clears.(Usually 5-10 business days.)
6. Errors
Noel Barrett Antiques & Auctions Ltd. is not responsible for any typographical or any other errors or omissions in this catalog or subsequent price key.
7. Sales Tax
This sale is subject to 6% Pennsylvania Sales Tax. To qualify for an exemption bring a photocopy of your resale certificate for our records. Out of state resale certificates also qualify the buyer for sales tax exemption. There is no sales tax for items shipped outside of Pennsylvania.
8. Buyer's Premium
This sale is subject to a 24% buyers premium added to the auction hammer price. (3% discount applied to purchases settled with cash, check or money order. A bank fee of $40 will be applied for international money transfers ( please note this is the fee the bank charges us for you to do transfer in addition to whatever costs your bank may charge you.
9. Shipment of Goods
Small items will be shipped by Noel Barrett Antiques & Auctions Ltd. for a charge of $15.00 per container (packaging and handling, SOMETIMES lesser based on the special miniatures in this sale) up to a 14" cube in addition to actual shipping and insurance charges. Larger shipments will incur additional charges based on time and materials. Unless other arrangements have been made, oversize items will be out-sourced for packing and shipping at the purchaser's expense and will incur a fee of $20 handling charge for transport from the auction gallery.We provide this service as a courtesy and of course you are welcome to make your own shipping arrangements. PLEASE NOTE: Depending on the number of absentee and internet winning bidders, the following 2 weeks after the sale are spent confirming results and calculating invoices. As the date of the sale is close to the Holidays, we cannot guarantee delivery before then. While we do our best to expedite shipping. We are working with hundreds of winning bidders after a sale and appreciate your patience.
10. Agreement to Terms
In bidding on any lot here offered the bidder indicates acceptance of these Terms of Sale.
11. A note on Grading
In describing the condition of the items to be sold, as much care as possible is given to note obvious flaws, major and minor. We have made every effort to be as thorough and accurate as possible but cannot hope to list every flaw in every item. When important flaws are noted, some minor flaws may be passed over in light of the major flaws cited. Catalog condition descriptions are subjective. Instead of a number system we use descriptive terms: mint, near mint, excellent, very good, good, fair, poor, and hyphenates of those terms, i.e. good to very good. Rather than try to define those terms exactly we rely on what we think is the generally accepted definitions of those terms. These terms are flexible and often an early and rare item that seldom turns up might be given more latitude in describing general condition. Thus we say that when an item is listed as excellent we mean that it has no major flaws and if it does have minor flaws they are not such that they would keep the item from being considered in excellent condition given the age and rarity of the item. WHEN IMPERFECTIONS ARE NOTED, THE BUYER SHOULD BID ACCORDINGLY. ABSENTEE BIDDERS CAN CALL FOR ADDI- TIONAL DETAILS AS TO CONDITION. In any event, the ultimate judge is the buyer as stated in Section 1 of the Terms of Sale.
