1. Lots Sold to The Highest Bidder: The highest bidder acknowledged by the auctioneer shall be the buyer. If you are deemed the buyer of a lot you are entering a legal obligation to continue with the sale. The auctioneer has the right to reject any bid, to advance the bidding at his or her absolute discretion and, in the event of any dispute between bidders or any other issue with respect to the highest bidder, to determine the successful bidder, to continue the bidding or to reoffer and resell the lot in question. In the event of any dispute after the sale, The Gabel Gallery, record of final sale shall be conclusive. 2. Condition: Lots are new or refinished to new unless otherwise stated. 3. Shipping: Insured shipping is provided free of charge. The Gabel Gallery will only ship to the lower 48 US states. 4. Authenticity: Bid with confidence. All pieces are viewed by a GIA Graduate Gemologist and diamonds are guaranteed to be authentic. 5. Certifications: If an item comes with a third party certification, The Gabel Gallery is not to be held responsible for variations in other gemological laboratory's grading. 6. Estimates: Any estimates provided are solely for the convenience of the bidder and The Gabel Gallery makes no warranties of any kind relating to them. 7. All Sales Final: Notwithstanding any other terms of these conditions, any and all refunds shall be given at the sole discretion of The Gabel Gallery. Any lot in question must be returned to The Gabel Gallery in the exact same condition as when sold. There are no exceptions to this refund policy. 8. The Right to withdraw Lots: The Gabel Gallery reserves the right to withdraw any lot before or at the sale. 9. Buyer's Premium: The Gabel Gallery does not charge any buyer?s premium 10. Removal of Purchased lots: All items sold may not be removed from The Gabel Gallery's premises, or the premises of the auction, until the buyer has paid in full the purchase price therefore or has satisfied such terms, as The Gabel Gallery, in its sole discretion, shall require. Subject to the foregoing, all lots are to be paid for no later than the third calendar day following the sale. 11. Applicable taxes: Unless exempted by New York state law, the buyer shall be required to pay any applicable state and local sales tax or compensating use tax on the purchase price.
