By bidding with GVAM either directly or through an online auction provider (e.g. Live Auctioneers), you are agreeing to abide by all associated auction terms and conditions. 2. Bidder approval is at the sole discretion of Green Valley Auctions & Moving, Inc. (GVAM). If you have limited or no history on Live Auctioneers (LA) or with GVAM, we may require references. 3. Your bid constitutes a legally binding contract. If you bid on a lot and win, you are legally responsible for payment. 4. The auctioneer reserves the right to reopen bidding on a sold lot (under extreme circumstances only) and is the sole determinant concerning all bid disputes and the final authority in regard to all auction terms and conditions. 5. Each lot won through LA is subject to a 16% buyer's premium. 6. All sales, including any applicable Buyer's Premium, are subject to 5% sales tax. Lots shipped out of state are not subject to VA State Sales Tax. 7. VA state law requires that all dealers have a valid, signed VA Dept. of Taxation Sales & Use Tax Certificate of Exemption on file with us (form ST-10 or ST-14). Non-Virginia dealers must provide the appropriate form AND a current copy of the dealer's tax exemption certificate issued by the dealer's home state. 8. Absentee bids placed in person at our gallery are accepted any time prior to the sale of the lot. THE DEADLINE FOR ALL OTHER ABSENTEE BIDS IS TWO HOURS PRIOR TO THE START OF THE AUCTION. 9. Competing bidders (those not bidding through LA) include floor bidders (present at the sale), telephone bidders (bidding remotely by phone), and absentee bidders (absentee bids directly with GVAM). 10. All catalogue descriptions are believed to be accurate in the matter of authenticity, condition, etc.; however, all lots are sold "as-is." Bidders are advised to personally inspect lots on which they bid. GVAM makes no guarantees, warrantees, or representations of any sort, nor assumes any liability, concerning the age, condition, size, quality, variety, importance, provenance, or historical relevance of any of the lots offered for sale. 11. Requests for additional photos or information should be made by calling 540.434.4260 or by emailing info@greenvalleyauctions.com. We cannot guarantee a timely response to any inquiries made within 48 hours of the sale or made using the LA messaging system. 12. INVOICING & SHIPPING SERVICE: WE WILL EMAIL INVOICES TO WINNING BIDDERS WITHIN 2 BUSINESS DAYS OF THE AUCTION (initial invoices are usually sent the Monday after an auction). WE PACK FOR SHIPPING ONLY UPON REQUEST FROM THE BUYER. We do not crate/ship furniture or over-sized objects; however, we can pack and ship most other items. Our prorated packing fee is billed at $15/hour and buyer pays cost of packing materials when applicable. 13. WINNING BIDDERS MUST CONTACT US BY 5:00 PM ET ON THE THURSDAY FOLLOWING AN AUCTION to confirm receipt of initial invoice and make arrangements for payment and shipping or pick up. Lots won should be reflected in your LA account. Contact by phone should be made during OUR office hours (Mon-Thurs., 8AM to 5PM ET). 14. METHODS OF PAYMENT: WE DO NOT ACCEPT PAYPAL. We accept cash, check, money order, VISA, MasterCard, or Discover. If payment is made with an uncertified check, items may be held for up to 10 business days before we ship or release for pick up. CREDIT CARD: To process a credit card payment, you may call us during OUR office hours (Mon-Thurs., 8AM to 5PM ET). 15. PAYMENT IS DUE WITHIN 5 DAYS OF THE DATE OF YOUR INVOICE IF YOU ARE PICKING UP YOUR ITEMS. If your request for packing/shipping is made by 5:00 PM ET on the Thursday following the auction, payment in full is due within 5 days of the date of your FINAL invoice (includes shipping cost). If your request for packing/shipping is made AFTER the Thursday following the auction, your item total must be paid immediately (before we pack) and you may pay the shipping charges separately after packing is completed. 16. Accounts that are unpaid after 30 days of the sale date will be subject to a 2% monthly finance charge. 17. Each returned check is subject to a $50.00 service charge. 18. The buyer is liable for all fees/costs associated with the collection of balances due, including attorney's fees. 19. Unless prearranged with GVAM, merchandise not removed within 2 weeks of the sale date is subject to a storage fee; merchandise not removed within 60 days of the sale date is considered abandoned. 20. No refunds or returns. 21. Additional conditions of sale apply as noted on our website and/or as announced by the auctioneer prior to the auction. 22. These terms and conditions, as well as the respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of Virginia. The purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the Commonwealth of Virginia.
