1. READ OUR TERMS & CONDITIONS BEFORE BIDDING. Any person participating or registering for the Auction agrees to be bound by and accepts these Terms and Conditions of Auction.
2. Your bid is a contract. Place a bid only if you're serious about buying the item. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property bid on from the seller. You should contact the seller to resolve any questions before bidding.
CATALOG. Blackswan Antiques believes, to the best of its knowledge that the information presented in any listing has come from reliable sources. Such information is presented solely for the convenience of the Purchaser. Blackswan Antiques makes no warranties of any kind related to the information presented in any listing. Blackswan Antiques further makes no warranties, either express or implied, relating to the value, marketability or condition of the lot described in any listing. Prospective bidders should investigate a lot thoroughly before bidding. By bidding the Bidder acknowledges that Bidder has investigated the lot to his or her satisfaction, or, that Bidder has chosen not to do so, and agrees to accept the lot being bid on with no objections after the sale closes. If you are uncertain please contact us with your questions prior to bidding. If you are still uncertain after we reply, please refrain from bidding. Catalog is merely an Opinion that is written as a guide to aid potential bidders & may contain errors or omissions. By Bidding, you acknowledge that our Catalog is an Opinion & not a Guarantee or Warranty. You, the bidder, also agree, before placing any bids, that YOU are Responsible for Researching item(s) up for bid & Determining their Authenticity, Genuineness, Age, Condition & Value or any other determinative factor. In no event shall Our Company be held responsible for any errors or omissions or for having made or implied any guarantee or warranty of authenticity, merchantability or fitness for a particular purpose. All items are sold as is and all sales are final.
PAYMENT. PAYMENT FOR ITEM TOTAL IS DUE WITHIN 5 DAYS OF THE AUCTION. No lots will be released until payment in full has been made. Payment (in U.S. funds) may be made via personal check or money order, PayPal or Bank Wire Transfer. There will be a 4% service fee for PayPal transactions and $20 service fee for Bank Wire Transfer.
Unpaid accounts 30 days post-sale are subject to a 2% monthly finance charge; administrative fees may also apply. Each returned check is subject to a $50 service charge. Merchandise not removed within 2 weeks of the sale is subject to a storage fee.
INTERNET BIDDING. Our Company is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Our Company or anyone else if the Internet service fails to work correctly before or during the live auction. Our Company will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Our Company reserves the right to withdraw or re-catalog items in this auction.
SHIPPING. Shipping will be handled in-house unless otherwise specified by buyer. This is in an effort to maintain the lowest shipping and handling cost for our buyers. We provide handling, packing and shipping services solely as a convenience for our Bidders. Because Bidders most often opt for these services, we include an estimated amount in the auction invoice.?Our responsibility for damage to or loss of any lot ends once it has been turned over to the USPS, or other shipping enterprise for delivery and/or packing. By bidding, the winning Bidder agrees that any and all claims for loss or damage to the lot will be handled solely through the insurance claims process (if insurance was available) or the carrier and acknowledges that insurance may be subject to deductibles or other limitations which are not the responsibility of Blackswan Antiques. Blackswan Antiques is not responsible to any loss resulting from items being shipped to an alternate address or recipient provided by Bidder. INTERNATIONAL bidders are also responsible for all of the customs fees and charges. International bidders are responsible for checking the shipping restrictions to their country. The actual cost of shipping, insurance, registry and confirmation services is charged to the Bidder, as well as a packing/handling fee not to exceed $10 per item, to defray the cost of labor and supplies involved. Large, heavy, fragile or otherwise unusual items will incur additional charges.
RETURN POLICY: If our description of the item is not as described, we will accept return of the item; however, WE MUST HAVE NOTIFICATION OF RETURN WITHIN TWO BUSINESS DAYS FROM RECEIPT OF ITEM BY BIDDER, as shown by FedEx, UPS or USPS tracking data, and the item must be received by us within ten days in the condition received. A written letter from a recognized expert in the field pertaining to the item in dispute must be presented for refund. No lots may be returned without prior written consent. Late remittance constitutes just cause for revocation of all return privileges. Return shipping is at the bidder's expense. In no event may any lot(s) be returned after fifteen (15) days from the date of the auction.
LIABILITY. Bidder Understands & Agrees that by Bidding, They Agree to all Terms & Conditions. Bidder Also Expressly Acknowledges & Agrees that in NO Event Shall Our Company be Held Liable for Any Damages Including but not Limited to Compensatory, Consequential or Incidental Damages. Bidder also Understands, Acknowledges & Agrees that any Legal Action Taken Against Our Company will Result in Possible Countersuits and also agrees to pay any and all Legal, Court & Attorney Fees incurred by Our Company.
