This is a legal document that affects your legal rights and is legally binding for all lots that you are awarded as the highest bidder within this auction. BIDDING/BUYERS PREMIUM: ALL BIDS ARE BINDING. If you are the highest bidder, you immediately become the legal owner. A buyer's premium will be added to each item sold per the buyer's premium advertised. PAYMENTS: Buyer is responsible for secure payment fees and all payments must be made in full prior to the release of merchandise. Payment must be made in U.S. Dollars through our secure Bank of America payment options. NO CHECKS Please review our two (2) payment methods below:PAYMENT METHOD 1: FREE Bank of America secure bank wire transfer or bank teller deposit. There is no charge from Bank of America to receive your payment into our business account. You will be charged a Bank of America processing fee for each transaction as follows: 3% on all credit cards & debit cards.Pangaea-Auctions does NOT accept mailed checks or money orders.DAMAGES: Outstanding invoices greater than 14 days after the auction date will be considered an unpaid invoice. Damages will be incurred daily starting at the beginning 15 days after the invoice issue date. The invoice and damages will be sent to a 3rd party collections agency. Damages are defined as Buyers Premium, $50 per lot listing fee, and $25 per lot daily storage fee. Bidding on an item makes this a binding contract and the bidder agrees to full liability of these damages.SHIPPING: All shipping costs will be paid 100% by the buyer. Pangaea Auctions will arrange shipping with the seller. Shipping costs will include shipping insurance, and applicable handling fees. Pangaea-Auctions requires shipping insurance on all lots, and therefore is not liable for any damage during shipping. All shipping issues/disputes will be handled between the shipping company and the buyer. Any lots that are damaged during, or after shipping, shall not be returned to or refunded by Pangaea-Auctions under any circumstances. Pangaea-Auctions enforces its insurance policy and verifies it prior to the seller shipping the lot.WARRANTIES: Pangaea-Auctions does not give any warranties on any lots sold at auction, and does not make any guarantees to the estimated value of any lot. Our descriptions are simply suggestions and we do not make any claims to the representations of the quality, origin, value, marketability, or age of any lots. It is up to the buyer at his/her discretion and expense to determine the market value of the lots within our auction. AUTHENTICITY: If within 10 calendar days after the auction date, any lot the purchaser gives notice in writing to Pangaea-Auctions that a lot is counterfeit that was described as "authentic" or "certified", and the purchaser within 10 calendar days after the auction date demonstrates evidence to Pangaea-Auctions by providing a legally notarized affidavits by two (2) recognized industry experts in the field of the particular lot stating that the lot is in fact counterfeit, Pangaea-Auctions will coordinate a refund from the seller to the buyer for the hammer price. In situations in which the lot can only be qualified by a single source such as the artist or represented gallery, a legal notarized affidavit must be provided within 10 days of the auction. If the lot is damaged in any way, shape or form the refund will be null and void. All lots must be returned in the exact condition as their photos.ARBITRATION: All disputes that cannot be resolved between the buyer and seller will be determined by the State of Nevada. Buyer expressly agrees to such Arbitration, and gives up its constitutional right to have any such dispute decided in a court of law before a jury. Such arbitration award shall be final and binding and may be taken to a court of competent jurisdiction and judgment may be entered thereon. As a bidder you are agreeing that all issues/disputes will be determined through an arbitrator and that you are giving up your right to take the dispute to a court trial. As a bidder, by placing a bid during this auction, you agree to ALL of the terms and conditions within this document.
