There will be an 18.5% Internet Premium Charge added to the Hammer Price Payment & Bidder Agreement: The following verbiage, as modified by any posted notices or announcements during the auction sale, encapsulates the entire terms and conditions on which items listed in the auction shall be presented for sale or sold by Auction Hit, LLC. Please Read The Entire Agreement For Current Terms & Conditions: All auction items are sold as is and with any faults. Please note that all sales are final. There will be no refunds or exchanges. Auction Hit, LLC, and any manufacturers we work with disclaim any and all warranties, expressed or implied, including but not limited to the implied warranty of merchantability or fitness for any particular purpose. No warranties are made that any of the merchandise complies with any applicable Governmental rules, regulations, or ordinances of any kind or nature whatsoever. All items are available for inquiries prior to bid time. Any written and oral descriptions of any of the items are merely our opinions and should not be relied on by you the bidder as a guarantee of any kind as to authenticity, age, condition, materials used, or any other feature of the item being sold. Auction Hit, LLC, attempts to sequence every auction accurately and will try to point out any defects known, but will not be responsible or liable for the accuracy of the auction, the item descriptions, or any other information used in evaluating the items up for auction. We encourage all potential bidders to examine any item(s) in which they may ultimately decide to bid on. By submitting a bid, either in person, via phone, absentee, or via the Internet, you denote that you have examined the item(s) as fully as you desire to or that you have chosen not to examine the item(s). If you require absolute certainty in all areas of authenticity, age, condition, materials used, or any other feature of the item being sold, and the results of your assessment leave uncertainty in your mind, we recommend you have an expert inspect the auction item for you or simply do not bid on the item in question. All auction items are sold as is, where is, and with any faults, and neither Auction Hit, LLC, or any of the manufacturers we work with make any warranties or representations of any kind with respect to any auction item(s) or its value, and in no way shall Auction Hit, LLC, be responsible for the accuracy of any descriptions, realness, attribution, authenticity, composition, completeness, condition of item(s) or estimate of value. No statement whether it be oral or written with regard to our auctions, or at our sales, or anywhere else, shall be considered such a warranty, representation, and/or assumption of responsibility. Please note that we do our sincere best to make certain that all descriptions and measurements are accurate but due to the nature of the item(s), many times measurements and accuracy can be imprecise. The winning bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute among bidders, or in the event of uncertainty on Auction Hit, LLC?s part as to the validity of any bid, the auctioneer will have the final discretion either to declare a successful bidder or to resell the item(s) in dispute. If any dispute arises after the bidding, Auction Hit, LLC's sale record is final. ? The purchaser (winning bidder) assumes full responsibility for items at the fall of the hammer ? An 18.5% buyer's premium will be added to the hammer price on each lot sold ? For all residents of California, applicable sales tax will be added to your invoice ? The auctioneer reserves the right to reject any bid at any time and at his sole discretion ? Will Call of items is not allowed ? Coming to our office location to view an item is not allowed ? Auctioneer has final decision on the sale of an item. ? Auctioneer?s word is final PAYMENT: We accept bank wire transfers, Visa, MasterCard, Discover and American Express. We do not accept PayPal payments, and we do use TSYS Merchant Services for safe, dependable, and PCI Compliant credit card transactions. If we are prevented by earthquake, fire, theft, or any other reason whatsoever from supplying any item(s) to the winning bidder, our liability shall be limited to the sum actually paid, by the winning bidder for said item(s). If there is ever a case of a refund being issued, there will still be a 10% restocking fee charged. In the event of a refund, all shipping fees are your responsibility. Please note that any Buyer?s Premiums will not be included in a refund should a refund be granted. Please bid responsibly and ask all questions pertaining to any item before placing a bid. Auction Hit, LLC, reserves the right to withdraw any auction item or auction at any time before, during, or after the auction without liability. A low estimate and a high estimate are given on each auction item. Estimates should not be relied on by bidders as a likelihood of the actual selling price. Upon the fall of the auctioneer's hammer, ownership of the offered item passes to the highest bidder acknowledged by the auctioneer, subject to fulfillment by such bidder, of all the conditions set forth herein, and such bidder thereupon; 1) Winning bidder assumes full risk and responsibility thereof, but not limited to earthquake, insurance, fire, theft, removal, and storage or damage from any and all causes 2) Winning bidder will pay the full purchase price thereof or such part as we may require. In addition to other remedies available to us by law, we reserve the right to impose a late charge of 1.5% per month of the total purchase price if payment is not made in accordance with the conditions set forth herein. Regarding any Purchaser who may be represented by a bidder, please note that it is the bidder who is personally and individually responsible for any obligations of the purchaser set forth in the terms and conditions of the sale. If any applicable conditions herein are not complied with by the purchaser, in addition to other remedies available to us and the manufacturers we work with by law, including, without limitation, the right to hold the purchaser liable for the total purchase price, we at our option may either; a. Cancel the sale, retaining as liquidated damages all payments made by the purchaser. b. Resell the property privately or at public auction without a reserve, and the purchaser will be liable for any deficiency costs including handling charges, the expenses of both sales, our commissions on both sales at our regular rates, reasonable attorney's fees, incidental damages, and all other charges due hereunder. In the event that such a buyer pays a portion of the purchase price for any or all lots purchased, Auction Hit, LLC shall apply the payment received to such lot or lots that Auction Hit, LLC's in its sole discretion deems appropriate. In the case of default, purchaser shall be liable for legal fees and expenses. In addition, a defaulting purchaser will be deemed to have granted us a security interest in, and we may retain as collateral security for such purchaser's obligations to us, any property in our possession owned by such purchaser. In the unlikely event we lose our internet connection, Auction Hit, LLC reserves the right in its sole and absolute discretion to cancel the remainder of the auction. As you have acknowledged by agreeing to the terms of this auction, there are no refunds or exchanges. In the event that you request and are granted by Auction Hit, LLC, a return, cancellation, or refund, you agree that you are still responsible to pay a 10% restocking fee based on the final sale price (which is the hammer price at auction) of each item that is returned plus the entire Buyer?s premium for each item as well as all of the Shipping and Handling charges. Simply put the restocking fee, Buyer?s premium, and all Shipping and Handling charges are never eligible for a refund or return. Shipping Prices are for both Shipping and Handling. Shipping Costs for small items are $30 per item and may not be combined with any other purchases to save on shipping. If the item is over $500.00, we will add $1.00 for each $100 of your winning bid. Shipping insurance is included in above prices. It is important to note that due to how the insurance is structured you cannot combine purchases to save on shipping costs. Should expedited shipping be requested, additional fees will apply. We reserve the right to adjust shipping charges. Additional fees apply when shipping internationally. If you are still unsure, please enjoy the auction but please refrain from bidding. Important Notices & Disclaimers - Please Read Regarding Appraised Jewelry and Loose Stones ? Auction Hit, LLC may send them out to a third party for Retail Replacement Value Appraisals, which are the most common. These types of evaluations are written for insurance needs. This would be the cost to replace the jewelry with an item of equal quality and kind, considered to be the current market price or the replacement value. This type of appraisal is done to protect you in the event of damage or loss of a valuable item. Our appraisals are conducted by independent 3rd Party appraisal firms that utilize Certified GIA Gemologist. Appraisals should be used for verification of gemstone and/or metal weight, size, and grade only, not actual value. Appraisal value should be considered for insurance purposes only, not actual value, as price varies greatly from retail locations throughout the world. Items should not be purchased with the expectation to resell for appraisal price, or for profit.
