DeFina Auctions Terms and Conditions A 20% buyers premium, for online bidders, will be added to the successful bid price and is payable by the purchaser as a part of the total purchase price. ESTIMATES Price ranges listed below the lot description are estimates and nothing more. We base the estimates on our experts’ opinions and past auction results, taking into account rarity, condition, and other subjective criteria. Use the estimates only as approximations, since they often do not reflect the actual selling price. CONDITIONS OF SALE We encourage you to call us with questions about our service or items in our auctions. Make certain that you are satisfied with our description before you bid! Your satisfaction with both our merchandise and our auction house is important to us. We try to describe all auction lots completely, fairly, and conservatively, and we make a concerted effort to include defects in descriptions. The lots listed in each auction will be offered by DeFina Auctions to the following terms and conditions: The property is sold "as is", and neither the auctioneer nor any consignor make any warranties or representations of any kind or nature, and in no event shall be responsible for the correctness, nor deemed to have made any representation or warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property, and no statement made at the sale, or in the bill or sale or invoice, or elsewhere, shall be deemed such a warranty or representation of an assumption of liability. All measures and weights are approximate. DeFina Auctions reserves the right to reject any bid, as well as the right to refuse to acknowledge any bidder. The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of a dispute between bidders, the auctioneer has the final discretion to re-offer the lot in dispute. If any dispute arises after the sale, DeFina Auctions’ sale record shall be conclusive. TERMS OF SALE Cash or checks are accepted with positive identification; out of state checks will need a bank letter of credit. PayPal will be accepted from internet bidders only. All purchases are subject to state tax, unless the buyer has proof of exemption. Gallery bidders must pay for items at the end of each session. We must receive payment from absentee, phone, and online bidders within one week of the auction. Personal or business checks must clear before shipment is made. (This could take as long as twelve business days.) BIDDING We will not be held responsible for failing to execute absentee bids. We extend this service as a courtesy to our customers who cannot attend the sale or who do not wish to be identified as bidders. Remember, you are bidding at a live auction. Tie bids: Placing an early internet or absentee bid prior to the auction does not give you any advantage over other bidders in the case of a tie bid. All bids will be executed in a competitive manner on auction day. The highest bidder acknowledged by the auctioneer will be the purchaser of the lot. BIDDER REGISTRATION All bidder registration will end three hours prior to the start of the auction. Please do not call to register beyond this point as we will not be able to help you. The auction house and shippers will not be responsible for loss or damage to uninsured items. - All purchased items can be picked up at the DeFina Auctions Gallery from 9:00 a.m. to 5:00 p.m. Monday through Friday. Call DeFina Auctions first for all pick-ups and for special arrangements, if necessary. - For domestic and international shipping arrangements, please email vinecityservices@velocity.net with the purchased item number (eBay transaction number), auction lot number, a short description of item, and a physical shipping address. - International shipping – All customs duties or international taxes will be the total responsibility of the buyer. - Contacts with professional packing and shipping companies will be provided for shipping estimates on request, and for large or extremely fragile items. - Other items will be shipped from the Auction Gallery. A minimum handling fee of $15 per lot will be added to all shipping charges. - Payments for shipping should be made separately to the shipper.
