ARTFAIRE.US TERMS AND CONDITIONS OF SALE 1. All bidders and buyers shall present satisfactory documentation, and place a credit card on file with LiveAuctioneers; as well as register prior to participation, for a particular auction with ArtFaire.us: A] No Buyers Premium is charged by ArtFaire.us to winning bidders. B] No tax is charged to buyers except to residents of Florida. C] Buyers shall be responsible for payment of transaction processing fees. D] Transactions fee's for payments in USD are 2.9% + $0.30 for the total transaction, including when multiple items are involved. E] Winning bidders will be invoiced via PayPal and may pay with the credit/debit cards listed. Payment is due upon being invoiced. Invoices are generated within 24 hours of auction's end. F] Winning bidders should be prepared to pay for items promptly after the sale, and are therefore encouraged to contact ArtFaire.us prior making a bid should there be questions. G] International Sales are customary and encouraged. ArtFaire.us has a large customer base abroad and is prompt in shipping in accordance with US customs laws. Transaction fee's for international sales may amount to a 4.4% transaction fee plus a fixed fee based on currency received. H] Shipping: The default shipping method is the United States Postal Service, First Class w/ Tracking. Domestic shipping and handling details are itemized within each description of artwork. Buyer pays shipping costs as itemized when invoiced. Combined shipping rates are available for multiple "same size" items. Buyers that bid on different items of different sizes may need to pay separate shipping fee's. International shipping is provided via USPS First Class w/ tracking plus Customs Forms. Due to each country having different customs laws, practices and restrictions-your item(s) cannot be tracked beyond the US border. Nonetheless the USPS shipment paid for will indeed be transferred and delivered by each country's proprietary mail delivery system at no extra cost after being processed by that country's Customs Personnel and Policies; (*See Section 13. Force Majeure). Shipping rates quoted for USPS do not include insurance unless specifically noted in the item description. Packaging and handling are carefully expedited by ArtFaire.us and therefore seller shall not be held responsible for incidental damage caused by the carrier or other parties after shipment. If not designated, Insurance can be requested by the buyer for domestic or international shipping. Items without insurance posted within description are responsibility of the buyer to request and will be billed accordingly, as are requests for shipping to be undertaken by 3rd party global carriers not designated as the default carrier, (such as FedEx etc). Third party global carriers will manage point-to-point delivery from the seller directly to the bidder's international address without a change in carriers at the US border. Be advised that global carriers bill at a higher rate than the default USPS carrier. * Further enumeration of said provisions and additional details of terms and conditions: 2. This auction contains items with either "no reserve" or "reserve" pricing, as indicated in each item description. An item with "no reserve" means there is no minimum price set, so the item is guaranteed to sell regardless of what the winning bid price is. An item containing a "reserve" means that there is a minimum price that the bidding must reach to sell. Buyers are encouraged to contact us directly with any questions or concerns you may have about the process before bidding. Once your payment has been verified, items will be shipped within 1-3 business days via United States Postal Service, First Class with tracking, or by other global carriers accordingly. 3. All property is sold "as is", ArtFaire.us makes no warranties or representation or any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, or description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice, or in the catalog, or elsewhere shall be deemed such a warranty of representation or an assumption of liability. Prospective buyers are urged to inspect those lots in which they have an interest. 4. ArtFaire.us will invoice the winning bidders including shipping information as per item desciption after the auction. Buyer pays shipping cost indicated in the auction description and invoice, as well as any applicable taxes, duties or fees for items originating from outside of the buyer's home country. For buyer?s outside of the Continental United States ArtFaire.us will provide a shipping quote per USPS rates with tracking to the border of the United States. Should the buyer seek an alternative global carrier or white glove shipping partner, then a premium global shipping quote shall be provided. Import duties, taxes and charges are not included in the item price or shipping charges. These charges are the buyer?s responsibility. Please check with your country?s customs office to determine what these additional costs will be prior to bidding/buying.? ?These charges are normally collected by the delivering freight (shipping) company or when you pick the item up ? do not confuse them for additional shipping charges.? We do not mark merchandise values below value or mark items as ?gifts? - as US and International government regulations prohibit said behavior. 5. The highest bidder as determined by ArtFaire.us shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or re-offer the lot for sale. The auctioneer shall have sole discretion to refuse any bid, or refuse to acknowledge any bidder. 6. All merchandise purchased is payable directly to ArtFaire.us via LiveAuctioneers and must be paid for upon receipt of the invoice. Invoices are sent the day after the auction. Any consignment merchandise must be removed from ArtFaire.us within fourteen business days of the auction, and in no event shall ArtFaire.us or LiveAuctioneers have any liability for any damage to property left on its premises for more than fourteen business days after the sale, or lack thereof. If any property has not been removed within fourteen business days from the date of sale, at the option of ArtFaire.us (a) the merchandise may be transferred to and stored at a bonded warehouse and the purchaser agrees to pay all transfer and storage expenses, and/or (b) ArtFaire.us may place the merchandise in a subsequent auction, without reserve, to be sold to the highest bidder, and after deducting the standard commission and any additional charges that may apply, remit the proceeds to the purchaser. 7. Acceptable forms of payment are PayPal, VISA, MasterCard, American Express and Discover card. Invoices must be paid in full. ArtFaire.us reserves the right to hold merchandise purchased until the funds have cleared. Sales tax on merchandise will only be applicable to local bidders; State of Florida. 8. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, ArtFaire.us may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach, and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has breached any of its obligations, including its obligation to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale. 9. ArtFaire.us may, in its discretion and at purchaser's request, package and arrange for delivery as directed by the purchaser with a non-default carrier. In such event, purchaser agrees that (a) all such packaging, handling and delivery is at the sole risk of the purchaser and that ArtFaire.us shall have no liability for any loss or damage to such items, and (b) purchaser shall pay in advance, all packaging expenses, including labor, materials, carrier fees and all insurance charges. ArtFaire.us shall not be responsible for obtaining any permits or licenses on behalf of purchaser and no sale shall be cancelled or refunded for lack of purchaser's noncompliance with permitting and licensing issues. ArtFaire.us will not cancel sale due to shipping. 10. ArtFaire.us currently does not charge a Buyers Premium. 11. Bidding on any item indicates your acceptance of these terms and all other terms printed within, posted, and announced at the time of sale. 12. All sales are final and presented ?As Is? and no refunds will be granted. {*Legitimate concerns of an item must be presented to ArtFaire.us within 24-hours of receipt of merchandise. Return requests are not standard, per potential of reproduction of works on paper post auction by parties other than the consignor or auctioneer. Grounds for consideration require pre-approval by the seller and in the event of an approval, items must be shipped with insurance and tracking at the buyers expense within 3 days of the original delivery}. 13. Force Majeure: No party shall be liable for any failure or delay in performing any obligation under this Agreement that is due to a Force Majeure event, such as Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service). If a Force Majeure event occurs, the affected party will notify the other party and make commercially reasonable efforts to mitigate the adverse effects of the Force Majeure event on the performance of this Agreement. However, this provision does not excuse Company's obligation to pay for services actually received. 14. Amendments And Future Terms: ArtFaire.us is entitled to amend, modify, add or remove any of these terms and conditions from time to time if and as needed. If we do so, we will post such modifications here in our Terms and Conditions. 15.
