International bidders WILL NOT be accepted for this auction. 18% buyers premium will be added to the hammer price for all in-house, absentee and telephone bids. 23% buyer's premium will be added for all live online bids. PURCHASES: Auction purchases must be paid for within seven (7) days of the date of the sale. Invoices will be emailed to each buyer including a written description and hammer price of each purchase as well as any applicable buyer's premium and tax. Texas residents are charged at our local San Antonio sales tax rate unless we are provided a copy of a valid Texas state resale certificate. Out of state residents are generally not charged Texas sales tax. We accept the following forms of payment: - Cash - Credit cards (NOT accepted for purchases >$5,000 without prior approval) - Personal checks / certified checks (funds must clear bank before purchases are released) - Wire transfers - Money orders NON-PAYMENT: By Texas law a winning auction bidder automatically enters into a legal and binding purchase contract with the auction house. In the rare case when a successful bidder fails to pay for their purchases within the time period allowed Vogt Auction will pursue available legal steps to protect its interests and may block the bidder from future auction participation. Reasonable interest and storage fees may also be added to past due invoices. COLLECTION OF ITEMS: The buyer must arrange for collection of a purchased lot within seven (7) days of the date of the auction. Vogt Auction will not release auction purchases until we have received payment in full (and until any checks have cleared the bank). If the buyer pays for their purchases but does not collect their items within seven (7) days of the auction, the buyer will incur a storage fee of $3 per item, per day, starting on the eighth calendar day following the auction. We will not release purchased lots to the buyer until all such charges have been paid in full. Vogt Auction reserves the right to run stored credit card details to obtain storage fees or any outstanding balances. If a purchased lot is paid for but not picked up within a reasonable time frame, the buyer authorizes Vogt Auction, upon notice, to arrange a resale of the item by auction or private sale, with estimates and a reserve set at Vogt Auction's reasonable discretion. The proceeds of such sale will be applied to pay for storage charges and any other outstanding costs and expenses owed by the buyer to Vogt Auction and the remainder will be forfeited unless collected by the buyer. Failure to comply with Vogt Auction's storage policies may result in further action being taken against the bidder and a ban against any future activity with Vogt Auction. . THE CONSIGNOR MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND WITH RESPECT TO ANY PROPERTY OFFERED FOR SALE, SINCE THE AUCTIONEER IS ACTING SOLELY AS AN AUCTION BROKER, AND, UNLESS OTHERWISE STATED, DOES NOT OWN THE PROPERTY OFFERED FOR SALE. THEREFORE, THE AUCTIONEER MAKES NO WARRANTY OF TITLE, WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY OTHER WARRANTY OR REPRESENTATION OF ANY KIND OR NATURE WITH RESPECT TO THE PROPERTY. Statements contained in the catalog, or elsewhere, are qualified statements of opinions only. Condition reports are available upon request; unless noted, items are not inspected out of their frames; condition of frames are available upon request. The absence of a condition statement does not imply that the lot is in perfect condition. It is recommended all prospective bidders examine carefully all items. NOTICE: All sales of firearms are subject to applicable jurisdictional law, including but not necessarily restricted to the successful completion of an NICS background check administered by Vogt Auction Galleries. A $20 fee per buyer will be charged for the background check for up to 3 individual firearms per auction; an additional $5 will be charged for each additional firearm over 3. Texas residents holding a valid Texas License to Carry may bypass this background check. It is the responsibility of the bidder to ensure the firearm is legal in their jurisdiction before bidding. All transfers are subject to the sole discretion of Vogt Auction Galleries. Nationwide in-house shipping is available on this item. All firearms purchased by out-of-state (non-Texan) buyers must be shipped directly to an FFL in their local area/applicable jurisdiction.
