North Dakota Museum of Art Annual Auction

When bidding on a lot offered by the North Dakota Museum of Art, the bidder indicates acceptance of the following Terms and Conditions. Participation in the auction binds you to agreement of these terms whether you have read or understand said terms. Items shipped, delivered, or picked up within North Dakota will be charged state sales tax of 7.25%. A 5% Buyer's Premium will be added to the successful bid price (hammer price) on LiveAuctioneers, and it is payable by the BUYER as part of the total purchase price. If payment is made via the LiveAuctioneers' system, its processing fee is passed along to BUYER (unless prohibited by state law). Your bid is a legally binding contract. At the conclusion of the bidding, as the gavel falls, the highest bid shall record the final sale. At the call of "sold" by the auctioneer, title to and full risk and responsibility for the lot shall pass to the buyer. All sales are final. No refunds or credits will be issued. The highest bidder acknowledged by the auctioneer will be the purchaser. The auctioneer's decisions as to disputed or tie bids will be final. The North Dakota Museum of Art reserve the right to accept or decline any bid. Bids must be for an entire lot and each lot constitutes a separate sale. All bids are per lot. The invoice must be paid in full and merchandise picked up or shipping arrangements made within 5 days of the date of sale. A storage fee of $5 per lot per day will be charged if merchandise is left longer than 10 days. Any merchandise not removed within 30 days of the sale is considered abandoned, and the buyer loses all claims/titles to said merchandise. Buyers pay all shipping, insurance and packaging supply costs. We do not ship any items. Arranging shipping with a third party is the buyer's responsibility. You are welcome to arrange shipping through a provider of your choice. The North Dakota Museum of Art makes every attempt to describe all items accurately and to call any flaws that may affect the value of an item, but final determination is left to the buyer. The North Dakota Museum of Art does not guarantee the authenticity or attribution of property listed in the catalog or online. The North Dakota Museum of Art makes no warranties as to the merchantability or fitness for a particular purpose, the correctness of the catalog, or any other description of the physical condition, size, quality, rarity, importance, provenance, literature, or historical relevance of any property. No oral or written statements made in the catalog, online listing, advertisement, flyer, announcement, social media, website, or elsewhere, or made by employees or auctioneer, shall be construed to be a warranty. The North Dakota Museum of Art make no representations and warranties, express or implied, as to whether the BUYER acquires any copyrights, including but not limited to, any reproduction or intellectual rights of any property. The North Dakota Museum of Art is not responsible for errors and/or omissions in the catalog, online listings, website, social media, or any other supplemental material, whether written or verbal. We reserve the right to amend our terms and conditions at any time without notice.

If you have not contacted North Dakota Museum of Art to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
