Buyers participating in Objects, Furnishings & Decorative Arts, Inc.'s Century 20: Modern Design auction acknowledge and accept the following Terms & Conditions. By registering to bid or a bid placed by a bidder will constitute acceptance of the following terms; Auction conducted by: K&M Auctions & Liquidations Sales Inc., Mark Davis FL Lic. #AU2340. All lots are owned by Objects, Furnishings, & Decorative Arts, Inc. dba Objects In The Loft Payment: Payment must be made within 5 business days following the auction. Payment may be made by wire transfer, check, cashiers check, money order, Visa, Mastercard, and Discover. Checks should be made payable to "Objects, Furnishings, & Decorative Arts Inc.". Note to international Bidders: We only accept wire transfers on international bidders. Bidder gives Objects, Furnishings, & Decorative Arts Inc. the right to charge the credit card on file if bidder does not pay within 5 days. Buyers Premium: Bidders will be charged a 5% buyers premium. The total sales price of an item will be calculated as follows; the hammer price of the item plus the 5% buyers premium plus 6.5% West Palm Beach sales tax (unless exempt, see "Sales Tax below). Sales Tax: Sales tax will be added to all purchases at the rate of 6.5% (West Palm Beach County sales tax rate) of the final purchase price. No sales tax will be charged if the successful bidder provides us with a copy of a valid "Resale Form or Tax Exempt Certificate". Items shipped out of state are not subject to sales tax as long as the successful bidder furnishes us with a copy of a shipping document from a shipper showing the lots are being shipped out of state. Lot Descriptions: Objects, Furnishings & Decorative Arts Inc. has described each lot as accurately as possible. Bidders should call, e-mail, or fax us with any questions prior to placing their bids. All items are sold "as is". If any item is materially different than was described, Buyer shall have 48 hours from the date the property is received to notify the Seller. After the 48 hour period all items are considered "as is" without recourse. Inspection of Merchandise: Prospective buyers may view lots at our gallery (Objects In The Loft) located at 3611 S. Dixie Hwy., West Palm Beach, FL 33405 from Monday(10/19/2009) through Saturday (10/24/2009)from 10:00A.M. - 5:00P.M. Estimates: Estimates are provided only as a guide for prospective buyers. Reserve Price: Some lots offered are subject to a reserve. A reserve is a confidential minimum price below which the lot will not be sold. We will act to protect the reserve by bidding through the auctioneer. The auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the Seller and may continue to bid on behalf of the Seller up to the amount of the reserve. Inquiries: If you have a question on a lot, please e-mail us specific questions. Withdrawals: Objects, Furnishings, & Decorative Arts Inc. reserves the right to withdraw any item from the auction for any reason and shall have no liability whatsoever for such withdrawal. Shipping/Pick-up/Storage: Many customers have shipped merchandise that they purchased from Objects, Furnishings & Decorative Arts Inc. with very good results. We will assist customers in obtaining shipping quotes and with the shipping process after the auction is completed. If you would like to obtain a shipping quote prior to the auction please contact us by phone or email for a list of shippers or contact your own shipper (we do not pack or ship items for insurance reasons and any shipping list provided is only provided as a service to our clients, we do not endorse any of these companies). We will not obtain shipping estimates prior to the auction but highly recommend that bidders obtain shipping quotes prior to bidding. Final arrangements regarding shipping, and costs associated with shipping, are the responsibility of the buyer. Shipping is a contract between the buyer and the shipper. Objects In The Loft is not a party to the shipping contract. No items will be released for shipping until payment is received in full. All checks must clear before a lot will be released to a shipper. Items that are paid for in full may be picked up in our gallery Monday through Saturday between 10:00A.M. - 5:00 P.M. by the winning bidders or their shippers. Please call us the day before pick-up to make sure the item is at our gallery. If a shipper is picking the item up, please e-mail us a short note giving us permission to release the items to your shipper. All winning lots must be picked up within 30 working days following the close of the auction. After 30 days, each lot will become subject to storage fees of not less than $5 per day.

Sales tax will be added to all purchases at the rate of 6.5% (West Palm Beach County sales tax rate) of the final purchase price. No sales tax will be charged if the successful bidder provides us with a copy of a valid ÃâResale Form or Tax Exempt CertificateÃâÂ. Items shipped out of state are not subject to sales tax as long as the successful bidder furnishes us with a copy of a shipping document from a shipper showing the lots are being shipped out of state.
