All properties offered and sold through Muse Auctioneers shall be offered and sold on the terms and conditions set forth below. Buyers must accept the following Terms & Conditions to participate in Muse Auctioneers auctions. By signing up as a bidder, you acknowledge that you have read and understood our Terms & Conditions and agree to abide to them. 1.BUYER'S PREMIUM: For lots $100,000 and under, a 28% Buyer's Premium will be added to the final price of each lot purchased through Muse Auctioneers. For lots $100,001 and over, a 25% Buyer?s Premium will be added to the final price of each lot purchased. The Buyer?s Premium will be paid by all bidders without exception. 2.Lots: Though all description and commentary are believed to be correct, neither the auctioneer or the consignor makes any guarantee of the authenticity of the merchandise. Any descriptions, condition reports, and any other statements are our opinions and are not to be relied upon as facts. No employees are authorized to make any warranties of any kind on behalf Muse Auctioneers. Potential buyers must rely only on their own inspection of the merchandise.Muse Auctioneers offers free previews and high-resolution photos for potential buyers to review and make their own conclusions about the piece. 3.All property is sold "as is", "where is", with any and all faults. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact.Muse Auctioneers shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections, restorations or the effects of aging. ALL SALES ARE FINAL. NO REFUNDS, RETURNS, EXCHANGES, OR REFUSALS. There are no warranties or representations of merchantability, of fitness, nor of any kind, express or implied. Your bid will signify that you have examined the items as fully as you desire, or that you have chosen not to examine the item. Property is open to the public for thorough inspection during business hours, and is the bidder's responsibility to determine condition, etc.Muse Auctioneers is not responsible for any variations in appearance of online photographs. 4.Payment Due: Complete payment is due upon receipt of notification of a successful bid and must be done by the Buyer no later than 10 days after an invoice is received. Title shall pass to the Buyer once payment in full has been made. Any item that has not been paid within 10 days after the receipt of the notification may be put back on the auction block for sale. Any buyer that does not make payment will automatically be blocked from future auctions and will be filed with a collection agency and the credit bureau. 5.All purchases (including buyer?s premium) will be subject to a CA state sales tax, unless lots are being shipped out of state, or if the purchaser has a valid tax exempt or resale certificate (an actual resale certificate must be presented or a copy held on file with Muse Auctioneers). 6.Shipping & Packing: We will ship all over the world. Payment for shipping, customs, and duties, if any, is the buyer?s responsibility. Please allow up to 30 business days after receipt of cleared invoice payment for purchases to be packed for shipping. For domestic service, shipping service may be by any of the following: USPS, FedEx, or UPS. For international shipping, service may be by any of the following: USPS, UPS, FedEx, or DHL. Shipments include mandatory insurance, tracking, and signature delivery confirmation. Once shipped, buyers receive their shipment tracking information by email.Muse Auctioneers assumes no responsibility for lost or damaged items received through shipment. All shipping damage / loss claims must be processed and resolved through the organization by which they were shipped or insured. 7.**For shipments outside of the USA, customs and duties may apply upon entry into said country; this fee, if any, is the buyer's responsibility. Also, please be aware that Muse Auctioneers will NOT falsify customs value on any international shipments - what you pay is what we declare, no exceptions. There are a small number of international countries we cannot ship to. If you have questions about this, please inquire BEFORE bidding** 8.Request to Delay Shipping for Lots Won: We are happy to delay shipping on all paid lots for up to 30 days with no storage fees. After 30 days, storage fees will accrue daily based on a 2% of invoice total. Once storage fees have exceeded the actual purchase price of the item(s)Muse Auctioneers can exercise the right to re-auction. 9.All items are sold to the highest bidder acknowledged by the auctioneer. The auctioneer is the arbiter of any disputed bid. He may reopen bidding at his discretion and reject bids deemed inappropriate. The auctioneer reserves the right to withdraw any item and to reoffer the item at another time. Every effort is made by the auctioneer to execute all bids, including floor, absentee, telephone and internet bids. We are not responsible for any missed bids.Muse Auctioneers reserves the right to cancel any sale or bid before, during, and after the auction. 10.Right to refuse sale:Muse Auctioneers reserves the right to refuse any sale due to unforeseen circumstances including, but not limited to: damage to an item, withdrawn consignment, or other such issues. In the event of a refused sale for which payment has already been received, a full refund will be issued equal to the purchase price of the given piece. 11.Withdrawal Prior to Sale:Muse Auctioneers reserves the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal. All starting bids and estimates are subject to change before the start of the auction. 12.Some properties sold at auction may include materials from protected or endangered species subject to laws governing imports and exports to or from the United States or other countries. Obtaining of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of receiving an import/export license will not constitute grounds for cancellation or delay in payment for the total purchase price of lots. If you have not contacted Muse Auctioneers to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
