TERMS & CONDITIONS All Subjects offered and sold by August Winston Auction House Ltd shall be offered and sold on the terms and conditions set forth below. They may be amended by posted notices or oral announcements made during the sale. By bidding at auction you agree to be bound by these Conditions of Sale. Before the sale 1. We recommend prospective buyers examine any property in which they are interested before the auction takes place. Condition reports are usually available on request. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you not bid on the subject in question. We do not give refunds?all sales are final. All lots are sold ?as is? and neither August Winston Auction nor any consignor provides any guarantee in relation to the nature of the property. 2. All statements by us in the catalogue entry for the property or in the condition report, or made orally or in writing elsewhere, are statements of opinion and are not to be relied on as statements of fact. These statements do not constitute a representation, warranty, or assumption of liability by us of any kind. References in the catalogue entry or the condition report to damage or restoration are for guidance only and should be evaluated by personal inspection by the buyer or a knowledgeable representative. The absence of such a reference does not imply that an item is free from defects or restoration, nor does a reference to particular defects imply the absence of any others. Estimates of the selling price should not be relied on as a statement that this is the price at which the item will sell or its value for any other purpose. Neither August Winston Auction nor the seller is responsible in any way for errors and omissions in the catalogue or any supplemental material. 3. August Winston Auction always reserves the right to withdraw any property before the sale. All lots in this catalogue are offered subject to a reserve, which is the confidential minimum hammer price at which a lot will be sold. In executing a reserve, the auctioneer has the right to bid on behalf of the Consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. If the reserve is not met, the auctioneer has the right to withdraw the item from the sale. 4. International bidders are responsible to meet all customs and import&export regulations. August Winston Auction will assist but cannot be held liable for international laws affecting the delivery of purchased goods. At the sale 5. Prospective buyers must complete and sign a registration form and provide identification before bidding. As part of the Bidder registration process, each Bidder must attest that they have received, read, and understand these Terms. We may require bidders submitting bank or other financial references as a security measure to participate in auctions held by August Winston Auction House Ltd. 6. Bidding on an item will be considered sufficient evidence that the Bidder accepts all conditions outlined in these Terms and any conditions outlined on the day of the sale. If a purchaser breaches any of these Terms of Sale, including the obligation to pay for purchased items, August Winston Auction may seek all remedies under the law including canceling the sale and reoffering the property without reserve. 7. All items are sold to the highest bidder as acknowledged by the auctioneer. August Winston Auction has the right to complete discretion, to refuse admission to the premises or participation in any auction, and to reject any bid. 8. When making a bid, a bidder is accepting personal liability to pay the purchase price, including the buyer's premium, all applicable taxes, and all other applicable charges, unless it has been explicitly agreed upon in writing with August Winston Auction House Ltd before the commencement of the sale that the bidder is acting as an agent on behalf of an identified third party acceptable to August Winston Auction House Ltd and that August Winston Auction House Ltd will only look to the principal for payment. After the sale 9. A premium equal to 20% of the final bid price will be applied to each lot sold, to be paid by the buyer as part of the purchase price. 10. When a buyer wins an item, we will send him an invoice for it. Payment must complete in 3 business days after each auction. We do not guarantee to hold items past due. 11. Acceptable forms of payment are cash, VISA, MasterCard, American Express, Discover, or wire transfers, payable in U.S. dollars. The invoice must be paid in full. August Winston Auction House reserves the right to hold merchandise purchased until the funds have cleared. 12. August Winston Auction will contact the winning bidders with shipping information after the auction. Buyer pays shipping cost, as well as any applicable taxes, duties, or fees for items originating from outside of the buyer's home country. For the buyer's outside of the Continental United States, the August Winston Auction team will provide an introduction to global parcel or white glove shipping partners upon request. 13. August Winston Auction may, in its discretion and at purchaser's request, package and arrange for delivery as directed by the purchaser. In such an event, the purchaser agrees that (a) all such packaging, handling, and delivery is at the sole risk of the purchaser and that August Winston Auction shall have no liability for any loss or damage to such items; (b) purchaser shall pay in advance, all packaging expenses, including labor, materials, carrier's fees, and all insurance charges. Please arrange seventy-two hours in advance for collection and delivery. During COVID-19, it will take longer than normal to deliver. 14. August Winston Auction House Ltd follows international Auction Practice, August Winston Auction House Ltd reserves the right of final interpretation. please contact our customer service if you have any questions.

If you have not contacted August Winston Auction House to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
