YOUR BID IS A CONTRACT: All bids placed with San Jose Auction LLC, are legally binding. By registering and bidding in this auction you are entering into a legal contract. By bidding in this auction you expressly agree to all of the Auction Terms and Conditions. If you are the successful bidder on a lot, you will be considered the buyer of the lot. If a winning bidder does not honor his or her bid with payment in full within 7 days of receipt of your invoice, then it is agreed that San Jose Auction LLC, may at its sole discretion sell the given item(s) to an under bidder or re-offer the lot(s) in a future sale, and that the original bidder is responsible for any losses incurred and that the non paying winning bidder explicitly agrees to pay any and all reasonable legal fees incurred by San Jose Auction LLC, in the collection of these losses. San Jose Auction, LLC, reserves the right to refuse to honor any bid which in its sole discretion, is not submitted in ?good faith?, or is not supported by satisfactory credit, collectibles references, or for any other, or no reason. CALIFORNIA STATE SALES TAX: California State sales tax will be charged on all orders shipped within the US other than the 5 states not required. The sales tax amount is based on the hammer price plus the buyers premium of the lots purchased. In no event will San Jose Auction, LLC be liable for any sales tax, duties or customs for any items purchased or shipped outside the United States. All items in this auction are sold as is. No other warranties other than those outlined above , are expressed or implied. Descriptions of lots, other than those of authenticity and grade are the subjective opinion of the auctioneer and can and do differ among experts. STARTING BIDS, RESERVES, ESTIMATES, CONSIGNERS Consigners to this auction may in some cases submit reserves on their lots in advance of the auction. This reserve may be above the starting bid of the lot. In addition, in some cases an estimate of a lot may be provided. This estimate is a subjective opinion of an item?s retail value and could differ substantially, either higher or lower, from the opinion of other experts and collectors. The auctioneer or its affiliates may consign items to be sold in the auction and may bid on those lots or any other lots. San Jose Auction LLC, expressly reserves the right to modify any such bids at any time prior to the closing based upon data made known to the San Jose Auction or its affiliates. RELEASE In consideration of participation in this auction and placing a bid, Bidder expressly releases and holds harmless San Jose Auction LLC, its officers, directors, employees and affiliates from any and all claims, losses or damage that could arise for any reason from participation in this sale. This includes, but is not limited to inability to deliver product, system failures, power outages, internet related problems, typographical errors or any other errors or reasons, human or otherwise, that could arise.
