This constitutes Auctions and Estate Sales of Los Angeles (AESofLA) and the Consignor's entire agreement with the purchaser relative to the property to be sold at auction. The following Conditions of Sale are the complete and the only terms and conditions on which all property is offered for sale at auction. In connection with making Bids, Bidders agree that the registered Bidder with the highest Bid at the close of the Auction will be obligated to purchase the Lot. By bidding on any Lot, you agree to purchase the Lot at the price you have Bid. You agree that should you Bid on a Lot and that Bid is the winning Bid, that you are bound to pay AESofLA the winning bid amount for the Lot. All sales are final and winners cannot cancel. No exceptions will be made. You further acknowledge and agree that the winning Bid you submit for each Lot is subject to: (i) additional fees, including the Buyer's Premium and Online Service Fee (if applicable), and (ii) additional costs, including taxes, shipping (if applicable), storage (if applicable), and customs (if applicable), and that you are obligated to pay such fees and costs in connection with your winning Bid. It is unlawful and illegal for Bidders to collude, pool, or agree with another Bidder to pay less than the fair value for Lot(s). Bidders participating in the auctions acknowledge that the law provides for substantial penalties for those who violate these provisions. All property is sold "AS IS" and neither AESOFLA nor the Consignor makes any guarantees, warranties or representations, expressed or implied, with respect to the property or the correctness of the catalog or other description of the authenticity of authorship, provenance, exhibitions, literature or historical relevance of the property or otherwise. No statement anywhere, whether oral or written, shall be deemed such a guarantee, warranty or representation. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. AESOFLA shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Prospective bidders should inspect the property before bidding to determine its condition, size or if it has been restored. AESOFLA and the consignor makes no representation or warranty as to whether the purchaser acquires any reproduction rights in the property. AESOFLA reserves the right to withdraw any property before sale. Unless otherwise announced by AESofLA, all bids are per lot as numbered. AESOFLA accepts Online bids on Liveauctioneers.com. The auction software is provided "As Is" and "As Available." High speed internet access is required to access the Service effectively. The Service is subject to limitations, delays and other problems inherent in the use of the Internet and electronic communications. AESofLA is not responsible for any delays, delivery failures, or other damage resulting from such problems. AESOFLA reserves the right to reject any bids. The highest bidder acknowledged by AESofLA will be the purchaser. In the event of any dispute between bidders, or in the event of doubt on our part as to the validity of any bid, AESofLA will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, AESOFLA sales record is conclusive. AESOFLA is not responsible for any errors or omission in connection therewith. All sizes are approximate. All transactions must be complete before property is removed from the premises. Possession of purchased property will not turn over to bidder until full payment has been received. If an article sold cannot be delivered by reason of theft, breakage, damage, or other reason, the sale shall be deemed canceled and refunded (if payment had been received) without any liability on the part of AESOFLA. All merchandise must be paid for and picked up or shipping arranged within 7 calendar days of the completion of the auction. In the event an item that has been paid in full for has not been picked up within 15 calendar days, a storage charge of at least $5.00 per lot per day will begin to accrue and be charged to the account. In the event that storage fees for any lot exceed the amount of the high winning bid, the lot shall be forfeited to AESOFLA for fees due. Merchandise not paid for, or arrangements have not been made within 7 calendar days of the completion of the auction will be re-auctioned or resold without further notice to the purchaser and any deposits will be forfeited. Further, in the event of loss or such resale, the original winning bidder will be responsible for completion of the transaction or overage due to loss at resale. If Merchandise is picked up, merchandise will be packed and transported by the purchaser or purchaser's agents, and at Purchaser's own risk and expense. Bidding on merchandise automatically constitutes agreement with these terms. IMPORTANT NOTICE: A 12% buyers premium will be applied to all property (each lot) sold and is to be paid by buyer as part of the purchase price. A 3% credit card processing fee will be applied to all credit card payments. Sales Tax applies to all purchases

Each buyer of the Property acknowledges and agrees that by acquiring any of the Property, such buyer will not acquire any intellectual property rights, including, without limitation, copyright or similar rights, whatsoever to the Property so purchased, including without limitation, any writings or any images or likenesses contained therein. Each buyer of the Property also acknowledges and agrees that such buyer may not in any way reproduce, distribute or create derivative works based upon or derived from the Property or any intellectual property rights embodied in the Property or cause anyone else to do so, in each case without the express prior written constant of current owners of such intellectual property, each of which shall retain all right, title and interest in their respective intellectual property rights in the Property.
