ALL REGISTRANTS ARE REQUIRED TO CAREFULLY READ ALL TERMS AND CONDITIONS AND MUST ACCEPT THESE TERMS IN WHOLE PRIOR TO BIDDING. BY ACCEPTING THESE TERMS YOU AGREE TO THE FOLLOWING: TRANSACTION OF BUSINESS By Accepting these terms and participating in this auction, you(buyer) and Noreaster House Auctions, it’s employee’s or it’s consignors, if applicable, further to be referred to as "Noreaster House", are entering into a legal and binding contract whereby both parties will execute any involved transactions in a professional and timely manner. By bidding on an item placed up for bid you have indicated that you intend to buy said item unless superseded by a higher bidder or bid. If you (buyer) have the highest bid when the lot is closed, you have indicated your intention to purchase this item from Noreaster House Auctions. In an effort to ensure proper notice to all bidders that the lot is about to "close", the term "Fair Warning" will be used to indicate that all final bids should be placed at that time and serve to give notice to the "High" bidder(buyer) that they are agreeing to purchase the lot(merchandise). In exchange, Noreaster house Auctions agrees to fulfill it’s obligations by providing and delivering the purchased lot (merchandise) in a timely manner once funds have been received and cleared. No merchandise will not be shipped or delivered until payment has been received (No Exceptions). BIDDER REGISTRATION Prospective Buyers are required to register prior to or during the auction. Registration is available at www.ebayliveauctions.com. ALL REGISTRANTS ARE REQUIRED TO CAREFULLY READ ALL TERMS AND CONDITIONS PRIOR TO BIDDING. Any questions regarding registration should be directed to Noreaster House prior to the start of the auction. BUYER'S RESPONSIBILITY Subject to fulfillment of all of the conditions set forth herein, upon the close of a lot by Noreaster House Auctions, ownership to the offered lot will pass to the highest bidder acknowledged by Noreaster House except in the case where the bid is held by the reserve. The bidder thereupon (a) assumes full risk and responsibility therefore (including, without limitation, liability for any damages), and (b) will immediately pay the full purchase price including the Buyers premium, shipping, handling and delivery costs for the item. All property must be removed from our premises by the Buyer at his expense not later than ten (10) days following its sale and, if it is not so removed, at it’s full discretion, Noreaster House may deem the transaction null and void and upon so, the item will be automatically forfeited and Buyer agrees to completely forfeit all interest in the item. AUCTION CATALOG Item descriptions have been carefully created and scrutinized to most accurately describe the lots (merchandise) included in the auction. While we stand behind our items with a money back guarantee should an item be described in error, Noreaster House will not be held responsible for any errors or omissions in the listing information for any item up for auction. This includes, but is not limited to title, description, estimates, pictures, size, weights, quality, and quantity. Further, Noreaster House makes no claims as to the descriptions being 100% accurate. They are complete and accurate to our best knowledge and intention. Items described represent a likely opinion by Noreaster House, Noreaster House cannot be held responsible for any inaccuracies or differences which could occur by examination of the item by other Gemological Laboratories or other experts in the field of grading gemstones and jewelry. The catalog descriptions and any amendments thereto reflect only the sole opinions of the item(s) being auctioned by Noreaster House. All property is sold "AS IS" without any representations or warranties by Noreaster House as to merchantability, fitness for a particular purpose, the correctness of the catalog or other description of the physical condition,. All sales shall be considered final. All images in the catalog are for identification purposes only and are not intended to represent the actual color or clarity of the item being auctioned. All photos are of the actual items being auctioned. In the instance where there are identical items up for auction, it is at the sole discretion of Noreaster House to utilize the one image to represent multiple listings of the identical items. All images have been enlarged to reflect the greatest detail for the benefit of viewing auction Items. Camera angle, lighting and other variables do alter the actual representation of the physical item to a certain extent. Noreaster House will not be held responsible for these variables and differences between the images and the physical items up for auction. Buyers shall note that some natural gemstones may be processed by a variety of different techniques, including but not limited to, treatments using oil, heat and resins, which offer an enhanced appearance. Noreaster House makes no representations or warranties, express or implied, as to whether any natural stones have been treated or not. Noreaster House will provide Buyers any available gemological certificates or reports which were acquired with the item or obtained by Noreaster House during the preparation for the auction. In an unlikely event Noreaster House reserves the right to withdraw any item from the posted catalog. Noreaster House also reserves the right to further add to or correct items descriptions; lot numbers and catalog presence at anytime without notice. Please note: As part of the image preparation, capture, display and posting process, Noreaster House may use "displays" or "props" in images to further enhance the viewing experience of said images contained within the catalog. Unless otherwise noted, the auction is for just the item described in Lot Description. And should be understood as such. INSPECTION As this is an "On-Line" only auction, Items are not physically available for personal inspection. Prospective bidders should use the provided catalog information before bidding to determine their interest and further action. If you are uncertain about any item being auctioned or would like additional information, if available, we recommend that you contact us for more detailed information prior to bidding. If you are still uncertain about the item after contacting us, please refrain from bidding. ESTIMATES Quoted replacement values are for insurance purposes only and shall not be considered in any manner whatsoever, as to the actual value of the item. Since jewelry evaluation and appraisals are extremely subjective, an estimate of the retail replacement value may vary from one appraiser to another and such a variance does not necessarily constitute an error on the part of any appraiser. Diamonds and Colored Stones are generally graded only as mounting permits observation. The weight of Diamonds and Colored Stones are estimated by formula and may not be completely accurate. Due to the extremely subjective nature of gemstone analysis, Buyer assumes all risk in purchasing any item(s) auctioned by Noreaster House. Noreaster House shall not be held responsible for any claims or disputes arising from any item described herein and Noreaster House, its employees, members, agents and/or affiliates shall not be liable for any loss, damage or expense for any errors or omissions arising from any information provided herein. Noreaster House has made no representation or warranty in connection with any item(s) described herein. BIDDING Bidding will be considered "open" when the lot is displayed as "open". Advanced Absentee Bidding will be allowed up to one half hour prior to the start of the auction. Bidding will be considered closed after a "Fair Warning" has been issued and the lot has been closed by Noreaster House concluding bidding for that item. Noreaster House will not be held responsible for any attempts to bid outside of this timeframe due to technical difficulties or hesitations from any bidders. Absentee Bidders may request final closing details on any item(s) they placed absentee bids on. We reserve the right to accept or reject any bid for any reason whatsoever. The highest bidder acknowledged by Noreaster House will be the actual Buyer. In the event of any dispute between bidders, or in the event of doubt as to the validity of any bid, Noreaster House, will have the exclusive final discretion to determine the successful bidder, cancel the sale, or to re-offer and re-sell the item in dispute and are not responsible for any errors or omissions in connection therewith. ABSENTEE BIDDING In the event that you are unable to attend the auction but wish to bid in absentee, eBay provides an On-Line bidding system that allows prospective Buyers to place absentee bids. We encourage all absentee bidders to place their bids early. RESERVE All lots offered are subject to a reserve, which is the minimum price acceptable to Noreaster House Auctions and/or the Consignor. No reserve will exceed the low presale estimate stated in the catalog, or as amended by oral or posted notices. Noreaster House will open the lots and such opening may be on behalf of the reserve. Noreaster House is authorized to bid up the lot on behalf of the reserve. If Noreaster House decides that any opening bid is below the reserve of the article offered, he may reject the same and withdraw the article from sale, and if, having acknowledged an opening bid, he decides that any advance thereafter is insufficient, he may reject the advance. Once the reserve price has been met Noreaster House may not withdraw said item from further bidding and the lot will remain open until a successful high bid has been placed and the lot is deemed "closed" CONDITIONS OF SALE BUYER'S PREMIUM A Buyer's premium of 15% will be added to the successful closing price and is payable by the Buyer as part of the total purchase price. SALES TAX Noreaster House doing business in The State of Maine is required to collect Maine State Sales Tax of 5% on the total purchase price including the Buyer's premium. Exemption from collection of these taxes will only be honored with a valid a valid resale certificate. Please contact Noreaster House to arrange our receipt of your documentation. INVOICING Invoices will be sent to the buyers registered eBay email address. PAYMENT TERMS All payments for Auction purchases are due immediately upon the close of the Auction. Please see are accepted payment methods stated within the Auction Catalog. We accept MasterCard, Visa, American Express and Discover through PAYPAL. We also accept Money Orders and Cashiers Checks. Please note that items will not be shipped until monies have been received in full and cleared to our satisfaction. SHIPPING Noreaster House charges a flat rate fee of $9.50(US) for all US Continental locations. Residents of Alaska, Puerto Rico, and Hawaii please add $5(US) extra for shipping. International buyers assume the responsibility for paying custom fees, duties, and taxes if applicable. Bidders are required to provide telephone numbers with shipping instructions at time of payment. E-mail or call Noreaster House for shipping costs and estimated delivery time. International buyers may be subject to an additional $1.00(US) per $100.00(US) value for insurance. Noreaster House will combine any and all purchased items at a cost of $1.50 for each additional item up to and including $15.00(US). Orders are shipped via USPS. Orders with an Invoice Total greter than or equal to $100(US) will be shipped fully insured and return receipt required. Cost for insurance is $ 1.00(US) per $100.00(US) value of total "invoice". Orders are shipped within 7(seven) to 10(ten) business days after receipt of payment. For expedited shipping contact Noreaster House for available options. Under no circumstances, will Noreaster House be liable for loss or damage of property in transit. We are not responsible for the acts or omissions in our packing or shipping of purchased items or of other carriers or packers of purchased lots, whether or not recommended by us. Packing and handling of purchased items is at the entire risk of the Buyer. International buyers MUST provide a telephone number with shipping address instructions. NON-PAYING BIDDERS Noreaster House must receive payment within 5(five) business days of the end of auction unless other arrangements have been arranged and approved by Noreaster House. If payment is not received within 10(ten) business days, buyer will automatically be in default and right to the item(s) will automatically be forfeited. Noreaster House will then automatically file a Non-Paying Bidder Alert to eBay, which may result in suspended from eBay indefinitely. Noreaster House will also file negative feedback indicating a non-paying bidder. If any applicable conditions herein are not complied with by the Buyer, the Buyer will be in default and without limitation, Noreaster House at its' discretion shall have the full right to hold the Buyer liable for the total purchase price, including all fees, charges and expenses as described herein. In addition at it’s discretion, Noreaster House may hold the non-paying bidder liable for any deficiency, any and all costs, handling charges, late charges, expenses for re-auctioning the item, Noreaster House Auction’s commissions legal fees and expenses, collection fees and incidental damages. REFUND & RETURN POLICY Noreaster House will honor full or partial refunds on all items returned with the following limitations. If the return is due to an error Noreaster House made on shipment, Noreaster House guarantees a full refund. Buyers must contact Noreaster House via email within 3 days of receipt of item and it should be sent to us insured for their full value and must be received by us in their original condition within 7 business days of product receipts. Noreaster House will guarantee reimbursement of the actual return shipping and insurance fees. Please provide a receipt to expedite the reimbursement. Noreaster House will grant partial returns for any reason within 5(five) days of receipt of item. These Items will be assessed a 15 % restocking fee of the total purchase price. Merchandise must be returned undamaged and in original condition and insured for their full value. Refunds are generally made within 5(five) to 7(seven) business days after receipt of the returned merchandise. DISPUTE RESOLUTION & SATISIFICATION As it is in all our best interests to try and resolve any disputes or complaints resulting from participation in a Noreaster House Auction. While the Terms and Conditions set forth herein are to legally protect both the buyer and seller in the transaction of business and Noreaster House as the "seller" is within it’s full legal rights to execute and hold buyers to these Terms and Conditions, We will work towards resolving any issues or disputes in an effort to obtain an acceptable and reasonable satisfaction of our customers where issues exist. FEEDBACK Customer Satisfaction is extremely important to us and in doing business on the eBay platform; "Positive Feedback" is important to both buyer and seller. Upon a successful transaction of business and in receipt of payment, "Positive Feedback", will be promptly submitted on your behalf. We treat feedback as the final part of the transaction of business between buyer and seller. We greatly appreciate the little extra time it takes to provide us with a reciprocal feedback rating. Negative Feedback is highly discouraged and will be treated in a serious manner including but not limited to 3rd party investigation. Noreaster House has provided these Terms and conditions in good faith to protect both the buyer and seller. Noreaster House has provided adequate means to which to resolve any disputes. Noreaster House has provided to the best of its abilities and extent of knowledge the most accurate information in it’s’ presentation of it’s’ catalog, the contents of the catalog and the manner in which it conducts it’s’ business. By accepting these Terms and conditions you acknowledge and accept that posting or submitting Negative Feedback is unreasonable and will be considered argumentative. LIMITATION OF LIABILITY In no event will Noreaster House’s liability to a Buyer exceed the purchase price actually paid for an item. Noreaster House shall not be liable for any breach or default of a consignor. In no event shall Noreaster House’s liability for any breach, or act or omission exceed the purchase price actually paid by the Buyer, and in no event shall Noreaster House have any liability under any circumstances for special, indirect, incidental or consequential damages (including for loss of profits or revenue, costs of obtaining alternative property, claims of customers of Buyer or otherwise), whether in contract, tort, negligence, strict liability, or otherwise, arising out of, resulting from or in any way relating to the Property or its purchase, sale, delivery or non-delivery, or the acts or omissions of Noreaster House Auctions, it’s employees or it’s consignors.
