1. Buyer's Premium, Purchase Price, Taxes, and Billing Buyer's Premium: All bidding at auction and all purchases will be in U.S. Dollars. A buyer's premium in the amount of 13% of the successful high bid will be added to the amount of the successful bid price for all lots purchased at auction. Purchase Price: Upon the announcement by the auctioneer, the successful bidder becomes the purchaser and is responsible for the amount of the successful bid, the buyer's premium, applicable taxes, and other charges provided for in the Terms of Sale. Taxes: Applicable taxes shall include Minnesota sales tax (6.875%). Valid resale certificates are the only accepted as proof of exemption from Minnesota's sales tax by U.S. dealers. No Minnesota sales tax is charged for purchases shipped out of state. 2. Methods of Payment and Fees: Accepted methods of payment are cash, check, money order, also (credit card with %3 fee), and (wire transfer with varying fees). Payment is due within 7-10 days of notification of successful bids. All other payments are due upon receipt of invoice. We reserve the right to hold all goods paid for by check until payment has cleared. 3. Disclaimer: All announcements made by the auctioneer shall take precedence over any previously written or oral statements made. Conduct of the auction, increments of the bidding and decisions as to the high bidder will be at the discretion of the auctioneers. The information contained herein is subject to the inspection and verification by all parties relying on it; no guarantee, expressed or implied, is given on the information contained herein. The owners or their agents assume no liability for its accuracy, error or omissions. Buyers shall rely entirely on their own judgment and inspection of the merchandise. All sales are final. 4. All Sales Final: All property is sold AS IS, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. We may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall we be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. We shall endeavor to describe in detail each item and any pertinent information about it. We will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. 5. Technology Disclaimer: We are providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against us or anyone else if the Internet service fails to work correctly before or during the live auction. We will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. We reserve the right to withdraw or re-catalog items in this auction. 6. Shipping, handling, and insurance fees are the responsability of the buyer. Buyer must provide payment before shipment processing will begin. Purchased objects will be shipped as fast as possible but may not be shipped for a least 1 or 2 weeks post auction. Jay Anderson Auction will provide some "in house" packing and shipping of objects, though with certain objects we require third party shipping, or local pickup. Jay Anderson Auction can provide coordination with third party shipper. (Third party shipper at bottom of terms page) When Buyers objects are in the possession of a third party shipper, Andersons is not responsible for loss, damage, or theft.
