Terms and conditions: The following are Rare Posters Inc entire agreement with the purchaser relative to the property listed in the auction catalog. By participating in any sale, the purchaser acknowledges that it is bound by these terms and conditions. Auction Overview Rare Posters' Inc POP ART auction will be conducted on-line, and by telephone on Tuesday, June 19th , starting at 9 am Pacific time (12 noon Eastern Time). You may bid on-line at LiveAuctioneers.com with direct bids or call our toll-free number at 800-378-8899 (US & Canada), 718-788-0791 (International). Payment for won items is expected following completion of the auction, an invoice form will be issued and sent by e-mail from a representative of Rare Posters Inc. once the event has been completed. Conditions of Sale Values set forth on items are fair market value estimates. EVERYTHING IS SOLD "AS IS" with condition noted and without any representations or warranties by Rare Posters Inc. as to merchantability, fitness for a particular purpose, the correctness of the catalog or other description of the physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature or historical relevance of any property and no statement anywhere, whether oral or written, whether made in the catalog, an advertisement, on-line, a bill of sale, a salesroom posting or announcement, or elsewhere, shall be deemed such a warranty, representation or assumption of liability. Rare Posters Inc. gives no representation or warranty, express or implied, as to whether the purchaser acquires any copyrights, including but not limited to, any reproduction rights in any property. Rare Posters Inc. is NOT responsible for errors and omissions in the catalog, on-line, or any supplemental material. All sales are final. No exchanges or refunds will be honored except by mutual agreement between the purchaser and Rare Posters Inc. Rare Posters Inc. is not obligated to offer any exchange or refund. No statements made at the sale, on the invoice or elsewhere shall be deemed such a representation or warranty or be subject to liability. Purchasers are advised to inspect and satisfy themselves of the items being sold prior to the sale. Rare Posters Inc. reserves the right to withdraw any lots without prior notice. All lots will be sold in numerical order unless otherwise stated by the auctioneer. Rare Posters Inc. has the right to reject bids based on the auctioneer's sole discretion. Some lots in the sale may be subject to a reserve. The reserve is a confidential minimum price agreed upon between Rare Posters Inc and LiveAuctioneers. The highest bidder is the purchaser as determined by the auctioneer. Shall a dispute on a bid arise, the auctioneer will have sole discretion in determining the purchaser, or to cancel the sale, or to re-offer and resell the article in dispute. If any dispute arises after the sale, Rare Posters Inc. sale record is conclusive. There is a 15% buyer's premium added to hammer price. For items purchased through LiveAuctioneers.com, Rare Posters Inc. will contact and send an invoice to all winning bidders via e-mail at the completion of the auction. Payment can be made by bank wire transfer, via PAYPAL, personal and certified checks, Visa, Mastercard, and American Express. If paying by personal check, Rare Posters Inc. reserves the right to hold the item(s) until the check has cleared. There is a 4% transaction fee added to all international credit cards. There is a $30.00 fee added to all incoming wire transfers. All purchases sold to or shipped to a New York State address are subject to the New York State 8.875% sales tax unless the purchaser possesses and provides a valid New York State sales tax exemption certificate, FORM NYS-120. Sales tax will not apply if the item is being billed and shipped out of the state of New York. The purchaser assumes all risks and responsibilities for items purchased at the time the highest bidder is acknowledged by the auctioneer. Arrangements for pickup or shipping to the purchaser are the responsibility of the purchaser. All shipping and handling costs, and any risk of loss, are the direct responsibility of the purchaser. Furthermore, international bidders are responsible for all respective duties and taxes (VAT) imposed by the final country of destination. In case of return, the bidder will have to pay full re-shipping fees. Any merchandise not paid for in full will be kept in storage no more than 30 days. After 30 days (July 19th, 2012) the merchandise becomes the property of Rare Posters Inc.. Applicable Law and Remedies These terms and conditions, and the respective rights hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of New York. By bidding at the auction, the purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the State of New York. If any applicable term or condition is not complied with by the purchaser, the purchaser shall be in default and in addition to any and all other remedies available to Rare Posters Inc. by law, including, without limitation, the right hold the purchaser liable for the total purchase price, including all fees, charges and expenses associated therewith, and Rare Posters Inc. may, at its option, (a) cancel the sale of that, or any other lot or lots sold to the defaulting purchaser, retaining as liquidated damages all payments made by the purchaser, or (b) resell the purchased property, whether at public auction or by private sale, or (c) effect any combination thereof. In any case, the purchaser will be liable for any deficiencies, costs, expenses or fees (including, without limitation, reasonable attorneys' fees) incidental to such default. In no event shall Rare Posters Inc liability to any purchaser exceed the purchase price actually paid.

All purchases sold to or shipped to a resident of New York State are subject to the NYS of 8.875% sales tax unless the purchaser possesses and provides a New York State sales tax exemption certificate, FORM NYST-120. Sales tax will not apply if the item is being shipped out of the state of New York.
