All property offered and sold through Doyen's LLC, ("Auctioneer", or "Broker", or the "Company") shall be offered and sold on the terms and conditions set forth in these Conditions of Sale. By participating in any sale, you acknowledge that you are bound by these terms and conditions. Doyen's LLC has made every effort to catalogue and describe accurately property to be sold. The Company, however, assumes no risk, liability or responsibility for the identification or authenticity or authorship, or weight, count, or measure of any property identified in its catalogue or lists of sale. This shall include, among others, the identity of the creator, the period, culture, source of origin, as the case may be, with which the creation of any property is identified in any publication. Warranties and Representations: ALL PROPERTY IS SOLD "AS IS". THE CONSIGNOR MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND WITH RESPECT TO ANY PROPERTY OFFERED FOR SALE, SINCE THE AUCTIONEER IS ACTING SOLELY AS AN AUCTION BROKER, AND, UNLESS OTHERWISE STATED, DOES NOT OWN THE PROPERTY OFFERED FOR SALE. THEREFORE, THE AUCTIONEER MAKES NO WARRANTY OF TITLE, WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY OTHER WARRANTY OR REPRESENTATION OF ANY KIND OR NATURE WITH RESPECT TO THE PROPERTY. (Please Note, For Jewelry & Watches More than $1000 We Only Accept Wire Transfer.) Storage: The invoice must be paid in full and shipping arrangements made within three days of the date of sale. A storage fee will be charged if merchandise is left longer than two weeks of $10.00 per lot per day. If the property is left longer than 30 calendar days, it will be considered abandoned SALES TAX: California State sales tax will be applied to all in house invoices and any online invoices where the bidder resides in California. A completed tax exemption certificate is required at time of registration for all buyers who wish to qualify for tax exemption. Buyer is responsible for payment for all successful bids. Any item not paid for by the deadline may be returned to the sales floor and will be eligible for resale. a. All taxes assessed or imposed by the United States, the State of California, or any other government entity on this transaction will be paid by the buyer direct to the agency due, if applicable. b. Buyers are responsible for the removal of all their purchases. Doyen's LLC does not deliver. RISK OF LOSS: In the event delivery cannot be made because of loss due to fire, theft, or any other reason, Doyen's LLC shall only be liable for the return of any deposits or payments made by the purchaser. BID DISCREPANCIES: In case of any discrepancy, from any source, the auctioneer's record is the official record of the sale. In case of any tie bids, the auctioneer's ruling is final. Doyen's LLC will have sole and absolute discretion to determine who the successful bidder is and/or may withdraw the Lot or re-offer the Lot for sale, in the event of a dispute. BUYER'S PREMIUM: Buyer agrees to pay Doyen's LLC a buyer's premium based on winning bid amounts of 30%. ESTIMATES: Auction price estimates are given on each lot. Estimates should not be relied on as a prediction of the actual selling price or the actual value of any lot. MODIFICATIONS: Doyen's LLC reserves the right to modify, add, or remove any section of these terms and conditions of sale at any time, with or without notice. SHIPPING: Shipping is the responsibility of the purchaser. Merchandise will be picked up, packaged or shipped by arrangements made by the buyer. (Merchandise must be removed with 10 days after the auction date) ANY ITEMS NOT REMOVE ARE SUBJECT TO $10 PER DAY PER ITEM STORAGE FEE. Doyen's LLC has the right to sell any items left over 30 days. All invoices are due to be paid with 5 business days. All items are sold and shipped As Is. Upon request, a list of shippers will be provided to buyers for domestic and international shipping. Some property that is sold at auction can be subject to laws governing export from the U.S., such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of licensing will not constitute cancellation or delay in payment for the total purchase price of these lots. If you have not contacted Doyen’s LLC to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
